The will of Ezekiel Layton Hinton dated Aug 7, 1825 was admitted to probate in the Dec, 1825 term of court in Nicholas Co., KY. John Caldwell was executor of the will and he posted bond of $4.000. The sureties on the bond were Thomas Caldwell, Joseph Caldwell, and Hugh Wiley. The will gives portions of his plantation to his sons, William Hinton and James Layton Hinton. He implies that William was over 21 years of age when the will was made in Aug, 1825, but that James Layton was under 21. Provisions are made in the will for his wife, Martha. He also makes provisions for his youngest daughter, Sally, Margaret and Elizabeth. The older daughters are not named in the will, nor is any provision made for them. Why he made no provision for his unmarried daughter, Rebecca and Jane, is not clear. The daughters, Susannah, Mary and Deborah were probably omitted because they were already married. John Caldwell was appointed executor of the Ezekiel Hinton estate. The total gross amount of the personal property estate was $1,056.98. In his accounting filed with the court the executor states that he spent $6.00 for a coffin. On Aug 31, 1836 Ezekiel Hinton and his family sold all of their lands on Cassady Creek and Little Flat Creek to Williamson Campbell for $1,640.00. The deed was signed in Boone Co., IN by Zachariah Pauley and his wife Susannah, by Thomas PaKersey and his wife Elizabeth, by Benjamin Kersey and his wife Jane, and by Martha Hinton, widow of Ezekiel Hinton, deceased, thus indicating that those people had all moved from Nicholas Co., KY to Boone Co., IN by Aug 31, 1836. It was signed in Rush Co., IN by William Lockridge and his wife, Mary, by James Downey and his wife, Rebecca, by John Downey and his wife Deborah, and by Jacob Downey and his wife, Margaret, showing that they had moved to that county by that date.
