Note: d to the Bailey clan through her mother and father. (from Sandra Fender) Below are my notes on Charles Bailey. Much taken from "Heritage of the Toe River Valley". Most articles about these families written by Dr. Lloyd Bailey a noted Yancey County Historian. Charles Bailey was born between 1789 - 1794 on Storey/Story/Storie Branch, a tributary of Little King Creek in Wilkes County, NC (now Caldwell). His family moved to the Toe River Valley before he reached the age of 10, they lived on Lower Browns Creek in Celo. His wife's family were neighbors. In 1834 Charles obtained a grant from the state for 100 acres on Browns Creek. In 1837 he sold 630 acres near his home to Thomas Gibbs and bought 30 acres on Jacks Creek from Malcolm McCourry, adding 15 more from Thomas Deyton the next year. He thus moved to the vicinity of Day Book, on the ridge behind the present Bailey Hill Cemetery. Minutes of Zion Baptist Church record that Charles Bailey, Margaret Bailey and John Riddle were admitted to membership by letter on Sept. 21, 1839 The minutes of this church contain a number of other references to this family: Jan. 1840; Charles Bailey "kept his seat for misconduct and was restored to his seat again.(That is, he did not stand at the moment called for as a signal of being in "fellowship" with members of the congregation.) July 29, 1841; Charles Bailey and others appointed as representatives to the next Association. March 26, 1842; kept his seat for not attending church. April, 1842; Peggy Bailey kept her seat "for evil conduct", but took her seat again at the May meeting. Nov. 20, 1845; moved that Brother Bailey be set apart for examination for ordination for Deacon. Oct. 25, 1846; Brother Baley and Brother Hughes to visit and "laber with Brother Ayers" before out next meeting. Feb. 27, 1847; All members found to be in fellowship except Sister Peggy Baily who kept her seat against (illegible name); case continued until next meeting. March 27, 1847; Case of Peggy Bailey against Fanney Laws taken up and decided. In the spring of 1844, Charles Bailey served as security for Benjamin Riddle as Administrator for John Riddle, sr. decd. (father of Peggy Bailey). He lists his property as 550 acres, valued at 700.00. The 1850 Yancey census, mortality schedule contain the notation that Charles Bailey died at age 60 in Dec. 1849 of "viceral Calculi". after a sickness of 270 days. This affliction is kidney/bladder stones, a particularly painful circumstance which he endured for 9 months before it "did him in." Charles is buried in an unmarked grave at Bailey Hill Cemetery. Bailey, Charles in court records. P's & Q's Jan, 8, 1850 It appears to the court that Charles Bailey is dead, leaving no last will and testament. Ansil and James Bailey are appointed administrators. 1850 M/Census Age 60, died in December of 1849 of visceral calculi. P's & Q's Fall 1851 Court orders that Henry Rowland be appointed guardian of William Bailey and Jesse Bailey, minor heirs of Charles Bailey deceased. Deed Book #3 pg 264-68 Feb. 20, 1851 Special Court called to settle with the heirs of Charles Bailey deceased. Proceeded to draw lot at the dwelling house of Margaret, widow of Charles Bailey. Heirs are: John Bailey, Henry Roland and wife Elizabeth, James Bailey, John Randolph and wife Nancy, Harvey Bailey, Ancel Bailey, David Renfro and wife Mary, Nathaniel Bailey, William and Jesse Bailey minor heirs represented by their next friend Henry Roland.
