Twelfth Street From the Pittsburgh Gazette under deaths November 16, 1899 - LUTZ - On Monday, November 13, 1899 at 11 a.m., CAROLYN LUTZ, aged 82 years. Funeral from her late residence, No. 108 South Twelfth street, on Thursday morning at 8 o'clock. Requiem high mass at St. Michael's church at 9 o'clock. Friends of the family are respectfully invited to attend. Records from the Archives of the Diocese of Pittsburgh give Caroline's age at her death as 81 years 6 months, which would make her birthdate April or May of 1818. WILL OF CAROLINE LUTZ ************************* IN THE NAME OF GOD, AMEN, I Caroline Lutz of Pittsburg (sic), S.S. County of Allegheny State of Pennsylvania, being of sound mind, memory and understanding, do make and publish this my last Will and Testament, hereby revoking and making void all former Wills by me at any time heretofore made: After all just debts and funeral expenses being fully paid by my executors hereinafter named, do hereby give to the rector of St. Michaels Church, (R.C.) of Pittsburg (sic), S.S. Pa the sum of One Hundred Dollars for Masses to be said for the repose of my soul and I do hereby direct my executors hereinafter named to give to the St. Michaels Orphan Society of Pittsburg (sic), the sum of Fifty Dollars, and I do hereby give unto my Son, Frank Lutz the sum of One Thousand Dollars, and all my household property and furniture, and all the rest of my property, real, personal and mixed of whatsoever kind and wheresoever the same may be found at the time of my death, I do hereby give, devise and bequeath unto my six children, in six equal shares as follows, John Lutz one share, Daniel Lutz one share, Philomena Schultz (nee Lutz) one share, Caroline Huebuer (nee Lutz) one share, Martin Lutz one share, and Frank Lutz one share, unto them their heirs and assigns forever. And I do hereby nominate, constitute and appoint my sons John Lutz and Daniel Lutz executors of this my last Will and Testament. The petition of John Lutz and Daniel Lutz respectfully showeth: That John Lutz and Daniel Lutz dated the 7th day of March A. D. 1898. That said decedent was a resident of Allegheny County, State of Pennsylvania, and departed this life at number No. (sic) 108 S. 12th Street, Pittsburg (sic), Pa. in the County of Allegheny and State of Pennsylvania, on Monday, the 13th day of November A. D. 1899 at 11 o'clock a.m. The said testatrix was possessed of real estate (less encumbrances) to the value of $12,000 as near as can be ascertained, situated as follows: 3 lots of 12th and Bradford Streets, 29th Ward, Pittsburg (sic), Pa., having thereon erected a frame and brick dwelling and stable. Therefore, the said John Lutz and Daniel Lutz whose P.O. address is No. 108 S. 12th St., Pittsburg (sic), Pa., respectfully applies for Probate of the said last Will and Testament and for Letters Testamentary thereon. his John X Lutz mark Attest Daniel Lutz J. Bleichner and Henry Albrecht the subscribing witnesses to the foregoing instrument of writing, purporting to be the last Will and Testament of Caroline Lutz deceased, and on their solemn oath did depose and say, that they were present and did see and hear Caroline Lutz the testatrix therein named, sign seal, publish and declare the same as and for her last Will and Testament, and at the time of so doing she was of sound mind and memory, to the best of their knowledge and belief, and at her request, and in her presence they subscribed their names as witnesses thereunto. Weddell being duly sworn doth deposit and say, that on Tuesday, June 4, 1901 he served the within citation on Frank Lutz and Martin Lutz of Cecil, Washington County, Pa., by delivering to them by registered letter a true copy of this citation, receipts for which are hereby attached, and that he served said citation upon Philomena Schultz and Ernest Schultz-her husband, and Caroline Huebuer and John Huebuer, her husband within named respondents, by making personally known to them at their respective residences the entire contents of the within citation and leaving with them respectively true copies hereof. IN RE-PETITION of John Lutz and Daniel Lutz presented praying the court to award an inquest to make partition of the real estate of said decedent to and among the parties entitled thereto. Now, therefore, we command you, the said parties in interest that you be and appear before the Judge of our said Court on or before Saturday the 15th day of June A. D. 1901, at 10 o'clock A. No. , Term, 1901 To the Honorable the Judges of the said Court: The petition of John Lutz and Daniel Lutz, sons of Caroline Lutz, late of the County of Allegheny, Pennsylvania, deceased, respectfully represents: That said Caroline Lutz died on or about the 13th day of November, A. D. 1899, leaving a last will and testament bearing date the 7th day of March, A. D. 1898, and since her decease, duly proved before the Register of said county on November 21st, A. D. 1899, and remaining of record in his office in Will Book Volume 59 Page 436, a copy whereof is hereto annexed and made a part hereof. After making a few small bequests of personal property, the testatrix devised her real estate as follows: "All the rest of my property, real, personal and mixed, of whatsoever kind and wheresoever the same may be found at the time of my death, I do hereby give, devise and bequeath unto my six children in six equal shares as follows: John Lutz, one share; Daniel Lutz, one share; Philomena Schultz (nee Lutz), one share; Caroline Huebner (sic) (nee Lutz), one share; Martin Lutz, one share; and Frank Lutz, one share; unto them their heirs and assigns, forever". The real estate devised as aforesaid consists of the following: All those two certain lots of ground situate in the 29th Ward of the City of Pittsburg (sic), County of Allegheny and State of Pennsylvania; being numbered Twenty-three and Twenty-four (23 & 24) in Dr. Fred. Bausman's plan of lots, (part of copy cut off0 Allegheny County in Plat Book Volume 1 Page 70 and together bounded and described as follows: BEGINNING on Bradford Street at the West end of lot number Twenty-two (22) in said plan; thence Westwardly along Bradford Street, forty (40) feet to Lot number Twenty-five (25); and extending back at right angles with said Bradford Street, Northwardly, preserving the same width throughout, a distance of eighty (80) feet to the line of lots numbers Thirteen (13) and Fourteen (14). Having erected thereon a two story brick dwelling. Also, a lot adjoining the above described piece; being Lot numbered Twenty-two (22) in Bausman's Plan aforesaid: BEGINNING at the North-west corner of Twelfth and Bradford Streets' thence Northwardly along said Twelfth Street, twenty (20) feet; and in depth, Westwardly, along said Bradford Street, a distance of eighty (80) feet, more of less, to line of Lot number Twenty-three (23) in said plan. Having erected thereon a two-story frame dwelling house and a one-story brick carriage shop. Said described real estate being part of the same premises conveyed to the said testatrix by John H. Hare, Sheriff, by deed dated December 30th, 1875 and recorded in Sheriff's Deed Book Volume 2 Page 257, and being the only real estate owned by the Testatrix. The said testatrix was a widow at the time of her death and left six children, as follows: John Lutz; Daniel Lutz; Philomena, wife of Ernest Schultz; Caroline, wife of John Huebner (sic); Martin Lutz; and Frank Lutz; all of whom are of full age and all reside in the County of Allegheny aforesaid, except Martin and Frank, who reside at Cecil, Washington County, Pennsylvania, and John, a petitioner, who resides at Warren, Ohio. And now, May 10, 1901, the foregoing petition being presented in open Court, upon due consideration thereof, on motion of George H. Lepper attorney for the petitioners, the prayer of the said petition is granted and a citation is awarded directed to all parties in interest to show cause why an inquest to make partition as therein prayed for, should not be granted returnable 25th (unreadable) at 10 o'clock A. Kramer, the sum of One hundred ($100) Dollars, payment in full of legacy to the Rector of St. Michael's Church R. C., as specified in the Last Will and Testament of Caroline Lutz, which said Will is recorded in the Register of Wills Office of Allegheny County, in Will Book Volume 59, Page 436. I, Frank Lutz, of the City of Warren, County of Trumbull, and State of Ohio, being one of the legatees under the Will of Caroline Lutz, deceased, which is probated and of record in the Register's Office of Allegheny County, Pennsylvania in Will Book Volume 59, page 436, do hereby certify and acknowledge that I have received from the estate of said Caroline Lutz, the sum of one thousand ($1000.00) dollars in full payment and satisfaction of the legacy to me as specified in said Will. I hereby authorize Wm. Conner, Clerk of Orphan's Court of said Allegheny County, to enter this receipt upon the records of his office. Shally Following is the description of the property obtained by Caroline Lutz at Sheriff's sale in December of 1875. Sheriff's Deed Book Vol. 2, pg 257 obtained in the Prothonotary's Office, City Building, Pittsburgh, Pennsylvania. For all the interest of Sebastian Kocher of in and to, the following described lot of ground in the 25th Ward, Pittsburgh. Viz. Beginning on the south side of Carson Street, 24 feet west from 22nd (?) Street, thence west along Carson Street, 24 feet and in depth south 120 feet to Carey Alley. On which is erected frame stables & out buildings. Also those two certain lots of ground on Bradford Street in the 29th Ward being lots 23 & 24 in Dr. Fred Bausman's Plan described as follows. Beginning on Bradford Street, at the west end of lot 22, thence west along Bradford Street 40 feet, and in depth south at right angles with said street ?? feet to line of lots 13 & 14. Also all that lot in the 29th Ward: Beginning at the corner of Twelfth Street at corner of Bradford Street, thence north along Twelfth Street in front or width 20 feet and in depth west along Bradford 80 feet. Being lot 22 in Dr. Fred Bausman's Plan. Sold on Fi Fa No. 5119 December 7 (?), 1875 From Deed Book Vol. 1469 pg 10 we learn in the description of property at 108 S. 12th Street, S.S., Pittsburgh, Pennsylvania, fourth paragraph, last sentence "Having thereon erected a 2-story frame building used as a store and residence and a 1-story shed in rear." that perhaps there is some truth in the family lore that Martin and Caroline operated a candy store at one time. (Source: Office of Registrar of Deeds, County Bldg., Pittsburgh Pennsylvania 15219) From Deed Book Vol. 2115 pgs 571-574 it is noted that the property of Caroline Lutz was sold on the 14th of March 1921. Before the property was finally sold John Martin Lutz had died with his one sixth of the property going to Catherine/Kate/Elizabeth (Elizabeth improperly used for Catherine's name in Vol. 1680 pg 21) on 31 August 1909. It also appears that Daniel's share was taken over by the German Savings and Deposit Bank on 10 January 1907 (Vol. 1680 pg 10). Daniel Lutz and Caroline Lutz Huber died before the house was finally sold to Domenico Mazzei on 14 March 1921. (Source: Office of Registrar of Deeds, County Bldg., Pittsburgh Pennsylvania 15219)
