Specifications -- In this, that he, the said Joseph Provost, a private in company A, First New York Volunteer Cavalry, an enlisted soldier in the service of the United States, did, on or about the nineteenth day of April, in the year of our Lord one thousand eight hundred and sixty-four, in the county of Morgan, State of West Virginia, and within the lines of the Military Department of West Virginia, enter the dwelling house of one Christian Miller, a peaceable citizen of said county and State and did then and there unlawfully, feloniously, willfully and of his malice aforethought, and in violation of the laws of war, shoot, with a revolver in his hand, then and there held, the said Christian Miller by which shooting as aforesaid, he, the said Joseph Provost, did inflict upon the head of the said Christian Miller two mortal wounds, of which said mortal wounds, or one of them, he, the said Christian Miller, afterwards, to wit: On the day and year and place aforesaid, did die. To which charge and specification the accused pleaded " Not Guilty " The Commission having maturely considered the evidence addressed , finds the accused, Joseph Provost, private of Company A, 1st New York Volunteer Cavalry as follows: Of the specifications of charge, " Guilty" Of the charge, " Guilty " And the Commission does, therefore, sentence him, the said Joseph Provost, private, 1st New York Volunteer Cavalry, " To be hung by the neck until dead, at such time and place as the General commanding shall direct - two thirds of the members of the Commission concurring therein. Provost is to be executed in Cumberland tomorrow, the Commanding General having so directed. Daily Register dated 29 Sept 1864 image #3 Joseph Provost, a private of the first New York Cavalry, who was recently taken from this city to Cumberland, who is charged with murdering, in cold blood, a citizen of Bath, Morgan County, VA will suffer the penalty of death tomorrow. The Cumberland Alleghenian says " the condemned man is about twenty-five years of age, and presents rather a fine personal appearance". He is a native of Montreal, East Canada, of French decent, and has a father and sister residing at that place. He asseverates that he is innocent of the charge for which he is to suffer, but admits the he was with the party by whom the murder was committed. The Daily Register dated 07 October 1864 image #3 Execution of Joseph Provost - The Cumberland Alleganian of this week contains the following notice of the military execution of Joseph Provost, the condemned man who was for sometime in the Athenaeum in this city: The execution of Joseph Provost, for the murder of Christian Miller, in Bath, Morgan County, Va. agreeable to the postponement took place on Friday last. At a quarter past eleven o'clock the prisoner was brought out of the jail, accompanied by Rev. Father Brennan, of St Patrick's Catholic Church, his spiritual adviser. He was placed in the cart, on either side of which a file of guards was placed. A procession was then formed, consisting of all the cavalry troops stationed here, and at 20 minutes past 11 o'clock, it moved from the jail to the place of execution. Arrived there, the brief space intervening before the appointed hour was passed in solemn devotion, the condemned man participating with apparent fervor and contrition. A few minutes before 12 o'clock the noose was adjusted about the criminal's neck, he was placed upon the trap, and at precisely 12 o'clock the trap fell. The rope by some means became loosened from the ring which was attached to the cross beam of the gallows, and the condemned man fell heavily to the ground; he was immediately raised up however, and supported in again ascending the steps to the platform by the Rev Father Brennan. But a few minutes elapsed when the necessary arrangements having been made, the noose was a second time placed about his neck, and in a very brief space of time the unhappy man was launched into eternity. After hanging until life was extinct, his body was cut down and interred. Located about 7 miles south of Berkeley Springs, WV., off Rt. 522 beside Hank Aaron Road. It is presently a development but was the site of the Miller Family farm for several generations. Christian Miller is the oldest known grave but there are numerous graves unmarked. [NOTE: Researchers should search records at the Berkeley Sprs. courthouse & library for better information than what they are showing. Perhaps Christian Miller (born 1776 & died after 1840) may have been one or at least supportive of the Timberland Millers near Rt 522. But Christian Miller (1807-1864) and his family were known as the Sleepy Creek Millers. His grave would have been on his farm located there. The floodings of the Potomac River & Sleepy Creek ruined the family farm cemetery.) -
