This Defendant now and at all times hereafter saving and reserving to himself all and all manner of benefit and advantage of exception that now or may be had to the many errors, uncertainties, insufficiencies, and other imperfections, or so much thereof, as this Defendant is advised is material for him to answer unto. Answering saith - That he admits the death of said Fielding J Brown intestate, as mentioned in Complainants Bill of Complaint, leaving the said Elizabeth A. his widow, and several children now in life, his heirs at Law. And this Defendant also admits that the said Elizabeth A. has intermarried with the said Lavorsier L. Antony mentioned in said Bill, and that the copy annexed to complainants Bill is a true copy of the original Marriage Settlement mentioned in said Bill and that the complainant is the Trustee under the same. This Defendant further answering says that he did obtain Letters of Administration on said Estate and caused an inventory of the same to be made out, and he returned the same to the Honorable the Court of Ordinary of Burke County. A copy of which is herewith filed as a part of this answer and is found on Exhibit A and also a sale of a portion of the personal estate a copy of which is found on said Exhibit A herewith filed. And this Defendant states that so the truth is that at the said sale of personal Estate the said Elizabeth A. then being sole purchased sundry articles amounting in the whole to the sum of Three Hundred and Seventy seven dollars and Sixty Two and a half cents, which said sum she has not paid to this Defendant, and he prays to be allowed the same out of her portion or share of said Estate as so much paid her thereon. This Defendant further answering says that he had made full returns to the Court of Ordinary of said County of Burke of all his actings and doings as said Administrator and files herewith copies of the same. Exhibit B contains his accounts for the year 1838. Exhibit C for 1839 and Exhibit D & E for 1840 and 1841, Exhibit F & G for 1842 and 1843 amd Exhibit H contains a full and complete return and account bringing(?) forward all the Balances on the former returns to January Eighteen Hundred and forty five showing a Balance due to this Defendant of the sum of Eight Hundred and Thirty nine dollars and fifty one cents for moneys paid laid out and expended for the use of said Estate and which said sum and the interest thereon the Defendant prays may be allowed him and he may be repaid the same from said Estate. This Defendant further answering says that the following named Negroes viz Charles, a man, Calway, a man, Betty, Patsy, Joe, Sam, Calvin and Bob belong to said Estate and subject to a Division among the Heirs. This Defendant also had possession of the following Negroes viz - Mary and her children Amy, Jack and Morrison. But that said last mentioned negroes Mary and her children are claimed by one JOSIAH HATCHER who has filed a Bill on the Equity side of this Honorable Court to recover the same, and this Defendant prays the aid and full and ample protection of of [sic] this Honorable Court touching said Negroes Mary and her children. This Defendant further answering says that there is a House and Lot in the City of Augusta in said State belonging to said Estate, and he is informed some Lands lying in the Original County of Cherokee of which said Lands this Defendant knows nothing but from report and has never had possession of them. This Defendant further answering says that since his last return as per Exhibit H he has paid out for the use of said Estate and received money leaving a Balance on that account in favor of the Estate of $210.67/100 as per his account herewith filed marked Exhibit I which deducted form $839.51 due this Defendant on his last account leaves a Balance due him of five hundred and twenty nine dollars and four cents, which he prays may be allowed him. Further answering this Defendent says that this Estate has four shares of the Capital Stock of the Mechanics Bank City of Augusta. Without that there is any other or further matter or thing contained in said Bill now well and sufficiently answered &c and he prays to be dismissed hereof. In Equity. Ebenezer Starnes Trustee &c vs William Murphree Admr Fielding J Brown decd.} Bill for Discovery &c. The further and amended Answer of the defendent to the complaint Original and Amended Bill. This Defendant admits that complainant is trustee of Elizabeth Brown widow of the said Fielding J Brown and that the said Fielding J Brown departed this life leaving said Elizabeth his widow and three children as named in Complainants Bill of Complaint as his heirs and distributees. And this defendant says he is now and always has been ready and willing to account for the Estate of the said Fielding J. as far as the same has come to his hands or for which he is in any way accountable or liable. The Defendant says that since the filing of the Original Bill and Answer in this case that the cause in Equity in this Honorable Court Between Josiah Hatcher by his Guardian and this defendant as Administrator of said Fielding J Brown referred to in his original Answer had been settled by the decree of this Honorable Court and he prays leave to refer to said Decree as a part of this Answer. This Defendant further answering says the Estate or heirs at Law of Thomas Ward decd. late of Burke County and State aforesaid set up a claim against the Estate of the said Fielding J Brown for the sum of Eight Hundred Dollars with interest thereon from the ____ day of April Eighteen Hundred and thirty seven for so much money retained in hand by the said Fielding J Brown in his life time, who was the Administrator of the Estate of the said Thomas Ward decd. for the purpose of meeting and paying an outstanding claim against the Estate of the said Thomas Ward. And this defendant says that the said Fielding J. administrator as aforesaid of said Thomas Ward departed this life without paying said claim and with the said sum of money in his hands as said Administrator, as this defendant is informed and verily believes, And that the heirs at Law of the said Thomas Ward are Emily C. Ward widow of said Thomas and the said Elizabeth Antony, Thomas Ward, Georgianna Sturges (late Georgianna Ward) wife of William U. Sturges and William A Ward minor children of said Thomas Ward and this defendant prays the aid and protection of this Honorable Court in the premises. And for further answer he says that the said Fielding J. in his life time was the Guardian of the said Georgianna Sturges (late Georgianna Ward) and as said Guardian he died indebted to her his said ward in the sum of Two Hundred and fifteen Dollars and thirty two - a Balance due to said Georgianna on the first day of June Eighteen hundred and thirty seven as per his Returns made to the Honorable the Court of Ordinary of Burke County State aforesaid. And this defendant prays the aid and protection of the Court touching said Matter. Further Answering he says that since the filing his original answer he has paid out and received sundry sums of money which will fully appear by Exhibit 1 and 2 filed herewith as a part of his answer. As per Exhibit No 1 the balance due to this defendant on that account is one Hundred and ninety two dollars and Eighteen cents and the balance due this defendant per Exhibit No 2 is Eighty nine dollars and sixteen cents making in the whole the sum of Two Hundred and Eighty one dollars and thirty four cents. And he prays that aid and protection of the Court in the premises. Without that &c. F. J. Brown} 150.00 *********************************************** Augusta Chronicle and Sentinel 9 Sep 1847 p. 4 Burke County, Georgia: -- Whereas John B. Gordon, Guardian of Josiah A. Hatcher, a minor, applies for letters of dismission from said Guardianship: These are therefore to cite and admonish, all and singular, the kindred and creditors of said minor, to be and appear at my office with the time prescribed by law, to show cause, if any they have, why letters should not be granted. Witness, the Honorable Edmund Palmer, one of the Judges of the Court of Ordinary for said county. Edward Garlick, D. Clerk May 26, 1847. ******************************************** Deed Book 11 page. 93 & 94 dated 9 December 1852 appears to be a portion of property owned by Edward J. Hatcher some of which was sold by the executor of the estate Alexander J. Lawson [Deed Book 12, page. 140 -1 dated 31 October 1846]. It would seem that Josiah Alston Hatcher may be in for some financial trouble; remember the family story Josiah swam the Savannah River in the dead of winter running from�.. the time frame would be about right for flight to South Carolina. It is an interesting coincidence that Caroline Green the future wife of Josiah Alston is a fifth cousin once removed of Oliver H. Perry. Deed Book 11 page. 93 & 94 Georgia Burke County} This Indenture made this Ninth day of December in the year of our Lord One Thousand Eight Hundred and fifty two, between Josiah Alston Hatcher & D'Courey Antony of the County and State aforesaid of the one part and Oliver H. Perry of the same place of the other part, Witnesseth that the said Josiah Alston Hatcher and D'Courey Antony hath this day made and delivered to the said Oliver H. Perry their promissory notes subscribed with their hands and bearing even date with these presents whereby the said Josiah Alston Hatcher and D'Courey Antony hath promised to pay the said Oliver H. Perry or bearer Nine Hundred Dollars, four Hundred and fifty Dollars of which is due on or before the first day of January next ensuing the date hereof and four Hundred fifty due on or before the first day of January Eighteen Hundred and fifty four with interest from date for value received. Now for and in consideration of the Sum of Five Dollars by the said Oliver H. Perry to the said Josiah Alston Hatcher and D'Courey Anthony in hand paid the receipt whereof is hereby acknowledged as well as for the letter securing the payment of the aforesaid promissory notes the said Josiah Alston Hatcher and D'Courey Antony hath granted, bargained and sold and doth by these presents grant bargain and sell unto the said Oliver H. Perry his heirs and assigns all that tract or parcel of Land situate lying and being in the said State and County containing One Hundred and fifty Acres more or less adjoining lands of Robert Gordon Aaron Barrow Joseph E. Perry a minor of Hardy Perry and Wm. B. Cheeseboro with all the rights members and appurtenances to the said lot of Land in any wise appertaining or belonging. To Have and to hold the said bargained premises unto the said Oliver H. Perry his heirs and assigns to his and their own proper use benefit and behoof forever. And the said Josiah Alston Hatcher and D'Courey Antony for themselves, their heirs executors, and administrators the said bargained premises unto the said Oliver H. Perry will warrant and forever defend against the claim of themselves and their heirs and against the claim of all other persons whatsoever. Provided nevertheless that if the said Josiah Alston Hatcher and D'Courey Antony their heirs executors and Administrators shall and do will and truly pay or cause to be paid unto the said Oliver H. Perry his heirs and assigns the aforementioned Sum of Nine Hundred Dollars on the days and time mentioned and appointed for the payment thereof in the said promissory notes mentioned with lawful interest for the same according to the tenor of said notes, then and from thence forth as well this present indenture and the right to the property thereby conveyed, as the said promissory notes shall cease determine and be void to all intents and purposes. It is not known by whom or why, he would never speak of it, He was taken in by William Green in Barnwell, South Carolina, nursed back to health, and later married Caroline Green. He used the name Joseph after leaving Georgia. Recollections and Reminiscences ******************************** MERCHANT: Joseph Hatcher was one of two early Ellenton, South Carolina merchants who appear in the 1873 tax record and it was noted that he was a non-landowning merchant. By 1880 he was absent from the tax record. It is interesting that he never held property in his name, maybe it has something to do with the reason he swam the Savannah River. ****************************** BURIAL: He is buried in the Hatcher Family Cemetery on Green Pond Road, Jackson, South Carolina. His tombstone inscription says: We miss thee from our home, Dear Father We miss thee from thy place A shadow over our life is cast We miss the sunshine of thy face; We miss thy kind and willing hand Thy fond and earnest care Our home is dark without thee We miss thee everywhere In Loving Remembrance of our father, Joseph A. C, 2 Nov 1921, p. 7 LAND SALE: Notice Is Hereby Given that we will offer for sale at public outcry, to the higest bidder, in front of the Court House at Aiken, S.C. during the legal hours for public sales on salesday on November 7th, 1921, the following described real estate, to wit: All that certain tract, piece, or parcel of land situate, lying and being in the county of Aiken, and State of South Carolina, containing 407 acres, more or less; and bounded on the North by estate of Jasper Craig and George Craig; on the East by estate of Jesse Bradley; on the South by lands of Thomas J. Foreman and C. C. Johnson; and on the West by lands of C. C. Johnson and estate of Jasper Craig, being estate lands of Joseph A. Hatcher and Caroline Hatcher, deceased, and this sale is being made for a division thereof. This said tract of land will be sold first in four separate tracts of nearly equal square sizes, as shown on plat of John N. Hankinson, dated October 7, 1917, which may be seen at the office of J. B. Salley, attorney, and then sold as a whole. If it brings more when sold in separate tracts than when sold as a whole, the purchasers of the separate tracts shall be entitled to purchase the tracts bid in by them respectively.
