Library of Virginia Bedford County Chancery Court Index 1822-008 Transcribed by Nel Hatcher Eunice Hatcher vs Charles Saunders & wife 1820 August Court To the worshipful Court of Bedford County in Chancery sitting & humbly complaining sheweth unto your worships your oratrix Eunice Hatcher. That her father Richard Hatcher departed this life intestate on the 18th Day of April 1814, leaving a widow Judith Hatcher and Ward Hatcher, Demy Hatcher, Judith Hatcher and your oratrix, his Children and heirs that one hundred and one acres of Land lying upon Craddock creek in Bedford County were assigned to the said widow for her Dower and that all the other lands whereof the said Richard was possessed have been sold or disposed of and that his representatives are entitled by descent from him to another Third except the 101 acres aforesd. That Judith Hatcher departed this life on the 4th Day of April 1819 and the heirs and distributors of Richard Hatcher then living were Elizabeth Hatcher, widow and relict of Ward Hatcher and daughter of Demy Hatcher, Lucy Saunders and Charles Saunders her husband, Joanna Hale and John Hale her husband, Eunice Wright and Ambrose Wright her husband, & Richard and Eli Hatcher, which said Lucy, Joanna, Eunice, Richard and Eli, were the children and heirs of Ward Hatcher, Dec?d and all of whom reside beyond the limits of this commonwealth in parts to your oratrix unknown Except Ambrose Wright & Eunice his wife & Richard & Eli are Infants and under the age of 21 years & Celia Doss and Azariah Doss her husband which said Celia was also a daughter of Demy Hatcher Dec'd. Archibald Nichols who married Judith Hatcher since Dec'd leaving Daniel Nichols Kittura intermarried with Presley Binder, Byar, Lucy, Bartlett, Judith and Marthy her children and heirs, all of whom reside in foreign parts to your oratrix unknown and Lucy Bartlet and Martha are infants under the age of twenty one years. That the Land aforesd is not of the value of $300 to the distributive thereof each heir and your oratrix is advised that the same may be sold and the money divided, But that many of the parties concurred as is herein before Set forth being Infants and not residents this cannot legally be done without the interposition of a Court of Equity where ------- of this sort under such circumstances are peculiarly cognizable to this end therefore may it please the Court to cause Charles Saunders and Lucy his wife John Hale and Joanna his wife Ambrose Wright and Eunice his wife, Richard & Eli Hatcher, Azariah Doss and Celia his wife, Elizabeth widow of Ward Hatcher, Daniel Nichols, Presley Binder and Kittura his wife, Byar, Lucy Bartlet Judith and Martha Nichols, and Archibald Nichols their father to be made defendants to this Bill and ----------- & ------- and --- to ------ to the matters herein contained to assign to the Infant defenders a guardian or guardians for that purpose, the land to be sold and ------- distributed according to the rights & Interests of the parties and each other & further ------ to her extended as her [last two lines illegible as is the signature] Note: After a thorough review of the records, it appears Eunice erred in stating Ward Hatcher's wife was Elizabeth, daughter of Deme, and that his son, Richard, was a minor. Deme was the sister of Ward and her daughter, Elizabeth, married Ward's son, Richard. Richard's tombstone also shows he was born 1794 and hardly a minor in 1820. ***************** Bedford County Crt Eunice Hatcher of Lawful age this Day personally appeared before me Nicholas Robertson a Justice of the peace for said county and made oath that Daniel Nichols Kittura Binder & Presley Binder, Byer Nichols, Charles Saunders and Lucy his wife, Richard Hatcher & Elizabeth his wife, John Hale and Joanna his wife & Eli Hatcher, are not inhabitants of this commonwealth as she is well informed and verily Believes Given from under my hand this 28th August 1820 N Robertson Tne answer of Eli Hatcher Lucy Nichols Bartlet Nichols Judith Nichols and Martha Nichols Infants under the age of twenty one years by Archibald Nichols assigned them as their guardian to Defend this Bill with them and others in the Court of Bedford County in Chancery by Eunice Hatcher th--- ------- ----& having to themselves the Benefit of exceptions to the said Bill for answer thereto say that their grandfather died leaving the representatives in the Bill mentioned. That the land therein specified was assigned as they are informed and believe to their grand mother for her Dower and is the only land that the heirs of their grand father Richard Hatcher ---- --- ------ to in this commonwealth by Indenture or otherwise from him that they know of and that this land is not of the value of one Hundred Dollars to the distributors share, and that they are bi---ing that the same ----to be sold provided this worshipful Court upon Consideration of the matter Shall be of opinion that it will be for their Interest submitting themselves to the court in their behalf they pray to be ----- --- ------- and as is Duty etc Archibald Nichols The answer of Ambrose Wright and Eunice his wife to a Bill of Complaint ----------- by Eunice Hatcher against them and others in the County court of Bedford in Chancery. ----- the benefit of the ---ual or options & for answer to the said Bill say that the ------- therein alledged are as they believe true and that they with the matter thereof to be decreed accordingly & as in Duty etc.
