COURT OF EQUITY RECORDS OF BARNWELL DISTRICT JOHN T. WISE vs. JANES COCHRKN and ISAAC COMETT. Accounting &c. Filed Nov. 5, 1859. Petitioner is a resident of B.D., and a creditor of Isaac Corbett., formerly of said District but now a non-resident, and he applies for relief and accounting by reason of having become surety for Corbett on a note, and alleges: That at the sales of real estate of Josiah Stallings estate made by the Com'r of this court in April 1837, the said Corbitt with James J. Stallings became the purchaser of a large portion of said Land, and to secure payment of balance due gave their bond (promissory note) to the Commissioner with a mortgage on the property in sum of $5510.00., dated April 3, 1837; the note was payable in 3 equal annual instalments and was signed by said Corbitt and Stallings as principals and B. B. Hankinson and said John T. Wise as sureties. The bond being in default the Commissioner sued same to judgment and obtained judgment Feb. 1842. In the settlement of the Stallings estate (of which a distributive share went to said James J. Stallings and another to Corbett) said shares were credited on the bond in accordance with the decree in re: George W. Stallings et.al. vs. William Ashley ADMR., in this court dated Feb. 18,1854, leaving bal. due of $3278.92. Corbett on Sept. 9, 1847, being in the custody of the Sheriff of Barnwell District, on a writ of capias ad satisfaciendum issued at instance of James Stallings, filed his petition in the Court of Common Pleas to obtain the benifit of the Insolvent Debtors' Act, and on July 13, 1849, assigned to James Cochran in trust for his [Corbett's] creditors, all his estate including his interest in the property of John Corbitt, deceased, late of Orangeburg Dist., and in the James Stallings estate. Cochran the Trustee received from the settlement of the John Corbitt estate $1021.43 on Jan. 9, 1854, and has received other sums at various times; however, plaintiff says the Trustee has been very negligent and failed to apply same on the oldest, lein whereby petitioner has had to pay more than what he should have. He, plantiff, therefore prays for an accounting and for a decree according to the rules of equity. Defendant filed no answer but in a letter admitted his liability.
