Hankinson in Trust Deed; South Carolina, Barnwell District: Whereas I Sarah Hankinson widow of the late Richard Hankinson deceased at the sale of the Estate of the said Richard Hankinson, Purchased the full shares of myself and of my two Daughters, Ann C. Hankinson and Elizabeth Hankinson who has lately intermarried with Charles Woodward [junior], with the intention of settling on my two said Daughters the Property so purchased to their sole and separate use when they shall obtain the age of Twenty-one years or Marry- Now this indenture made this Fifteenth day of December in the year of our Lord one Thousand Eight Hundred and forty nine, between Sarah Hankinson widow of the late Richard Hankinson of the one part and Milledge Hankinson of the other part Trustee Witnesseth that I the said Sarah Hankinson for and in consideration of the natural love and affection which I bear towards my daughter Ann C. Hankinson and the Promoting her comfort and also in consideration of the sum of Five Dollars to me in hand well and truly paid by the said M. Hankinson, at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged Have bargained and sold and by these presents Do bargain Sell and deliver unto the said M. Hankinson Trustee, the following negro slaves To Wit- Tom, Francis, Charlotte, Primus, they being one of the families of negroes Purchased by me at the sale of my deceased husband made by the order of the courts of Equity by A. P. Aldrich Esquire the commissioner thereof- on the ninth day of June Anno Domini one Thousand Eight Hundred and forty five To have and to hold the said negro slaves named Tom, Francis, Charlotte and Primus. To him the said M Hankinson Trustee his Executors Administrators and assigns forever- In Trust nevertheless to and for the several uses intents and purposes herein after Expressed and declared of and concerning the same, that is to say In Trust to and for the sale and separate use benefits and behoof of the said Ann C Hankinson without being liable for the debts contracts and engagements or subject to the control of any future husband, with full power and authority in her the said Ann C. Hankinson while she may remain sole and unmarried to dispose of the said negroes either by deed or will or otherwise as she may think proper- and upon this further Trust- in case the said Ann C Hankinson shall contract a marriage to and for the sole and separate use, benefit an behoof of the said Ann for and during her natural life, without being liable for the debts, contracts and Engagements or subject to the control of my future husband and after the death of the said Ann to be Equally divided between her said husband and such child or children the issue of said marriage, as she may leave alive at the time of her death and upon this further Trust in case any child or children the issue of any future marriage shall die in the lifetime of the said Ann, and the said future husband leaving issue alive at the death of the said Ann, Then the share of such deceased child or children to be Equally divided amongst such issue share and share alike- And upon the further Trust in case the said Ann shall marry and her said husband shall die before the said Ann, then in Trust for the child or children of the said Ann who may be alive at her death to be Equally divided between them share and share alike Grand children to take the share of their deceased Parents- And upon this further Trust- in case the said Ann C. Hankinson should marry and die leaving a Husband surviving her and no child or children or grand children living at the time of her death, then the whole of the said property to be delivered over to the said surviving husband freed and discharged from all Trust whatsoever To be held by him in Fee Simple, and to be disposed of by him as he may think proper- In Witness- whereof the Parties hereto have set their hand and seals the day and year first above written- Signed Sealed & delivered In the Presence of Sarah L. Hankinson To M Hankinson Trust Deed- South Carolina, Barnwell District- Know all men by these presents, that I Sarah Hankinson for and in consideration of the natural love and affection, which I bear Towards my two Daughters, Ann C Hankinson and Elizabeth the Wife of Charles Woodward Junior and also for the sum of five Dollars to me in hand paid at and before the sealing and delivery of these presents- By Milledge Hankinson the Trustee of the said Ann and Elizabeth, the receipt whereof is hereby acknowledged have bargained and sold, and by these presents Do bargain sell and deliver unto the said M. Hankinson Trustee his Executors, administrators and assigns the following negro Slave named Margaret. To have and to hold the said negro slave named Margaret and her increase into the said M. Hankinson Trustee his Executors, administrators and assigns Forever-. In trust Nevertheless that the said negro slave Margaret and her increase shall remain in te possession of the said Sarah Hankinson for and during the natural life of the said S. Hankinson and at her death to be Equally divided between the said Ann S. Hankinson and Elizabeth Woodward, share and share alike- the share of Each to be held by the said M. Hankinson a trustee for the same uses purposes and intents and subject to the same limitations and Declaration of uses as are expressed in two certain Indentures bearing dates the same day and year hereto written, and made between the said Sarah Hankinson and Milledge Hankinson Trustee.- and I the said S. Hankinson my Executors, administrators, the said slave Margaret unto the said M. Hankinson Trustee his Executors administrators and assigns from and against all Persons shall and will Warrant and defend by these Presents- In Witness Whereof I have hereunto set my hand and seal this fifteenth day of December in the year of our Lord one thousand Eight Hundred and forty nine-Signed Sealed & Delivered in the Presence of Sarah L.
