It survived only until 1791, when the county was abolished and the area reverted to being part again of Orangeburgh District. It was revitalized in 1800 as Barnwell District. The records of Winton County 1785-1791 survive, but the deeds in Deed Book I-A are not included in the deed indices of Barnwell records. Therefore, we are abstracting and publishing these deeds to make the record accessible. The original deed book is in the office of Clerk of Court at Barnwell Courthouse. As with the early deed books of most counties, there are deeds recorded therein which were executed before the formation of the counties, some prior to the Revolution. Recorded 21 Nov 1790. 1790: The South Carolina Magazine of Ancestral Research SCMAR, Volume XIII Number 3, Summer, 1985 Winton (Barnwell) County Deed Book 1-a (Continued from Volume XIII, p.3 ********************************** September Term 1792 THEREFORE, it is commanded that the sheriff of Charleston District in the State of South Carolina, do cause to come before the Chief Justice and the Associate Judges of the Court of Common Pleas of the said State at the Court to be holden at Charleston, in and for the District aforesaid , on the twenty fourth day of September in the year of our Lord One Thousand Seven Hundred and Ninety two , Fifty good and lawful men drawn by Ballot, according to the directions of the Acts of the General Assembly of the Sate aforesaid in such case made and provided by whom ands soforth; and who neither and so forth, because as well and soforth, The same day is given to the parties aforesaid, there and so forth; AFTERWARDS, to wit, on the said Twenty fourth day of September in the year of our Lord One Thousand Seven Hundred and Ninety aforesaid before his Honor the Chief Justice and Elisha Hall Bay Esquire one of the Associate Judges of the said State, at Charleston in the District and State aforesaid at the Court then and there held came as well James Gray as the said John Holmes Executor aforesaid by their attorneys aforesaid and the Jurors of the Jury of which mention as above made, being called, certain of them, to wit, George Anderson come and are sworn to say that the said Bond on which James Gray the Plaintiff founded his Action against the said John Holmes Executor aforesaid was given on the purchase described in the within Plat, that the said land was purchased by Robert Hankinson for the purpose of erecting a Saw Mill, that the Mill land and Seven hundred and fifty two acres of the aid land are claimed by Titles, prior to that of Gray, and that the object of said purchase was thereby defeated and the bargain Void: THEREFORE, it is considered that the said James Gray shall take nothing by his action aforesaid; but for his false claim be therefore in Mercy, And that the said John Holmes Executor aforesaid may go thereof without day, and it is further Considered by the Court now here that the said John Holmes Executor aforesaid do recover against the said James Gray for his Costs and Charges by him, in and about Defending the Action aforesaid of the said James Gray, expended, the sum of Seventy nine pounds Seventeen Shillings and Seven pence Sterling Money of the said State and so forth And be the said James Gray in Mercy and so forth: Calhoun Def Atty Transcribed by Jean Mayo Hirsch from documents located at the South Carolina State Archives in Columbia, South Carolina ******************************** Sept. 29th. 1792 We find that the Bond within mentioned was given on the purchase described in the within plat, that the said Land was purchased by Robert Hankinson for the purpose of creating a Saw Mill; that the Mill and seven hundred and fifty two Acres of the said lands and claims by Titles prior to that of Gray and that the object of said purchase was thereby defeated and the Bargain void, and we therefore find for the Defendant, with Costs of Court. Old George Stepney, Old Sasar, & Bess, & likewise I desire that a young lively negro Boy & Girl shall be bought such as my wife shall approve of & lent to her as above directed & likewise I lend the Plantation in Crackers Neck whereon I formerly lived joining to Island Creek to my wife untill my son Richard Hankinson arrives at the age of Eighteen Years & if my son Rich Hankinson should not choose that his Mother should not live on the said Plantation at the expiration of his Age limitted, the said Rich Hankinson is to find for his Mother a deacent Place such as she shall chuse to live upon, or else she may live upon the said Plantation during her life or as long as she shall live unmarried or single I likewise lend five Cows & Calves such as she shall chuse out of the Stock, I likewise lend her one good Bedd & furniture such as She shall chuse & Also all other Furniture as be deemed necefsary for keeping House by the others Executors. I likewise lend & order to be found her one good rideing Horse bridle & saddle such as She shall chuse, I like wise lend her six Sows & Pigs, all the above lent Articles at my wifes decease to the Estate to be equally divided amongst Children that is to say. Richard, Sarah, Patsey, & Mary Hankinson, likewise I desire that my wife shall keep all my Children above mentioned until they arrive to the Years of eighteen that is if She shall bring them up in a decent Christian Manner. & if She dont I desire NB Pages Robert Hankinson (Seal) Desire that the other Executor will take the Children and board them out & their Boarding, Clothing & Schooling to come out of the Estate & like wise if She continues A widow they are to continue with her & She to be found her lifetime out of the Estate, but if She Marries the other Executors is to take the Children and do with them as above directed-- Secondly I give and bequeath to my well beloved Son Richard Hankinson, The old Plantation where on I formerly lived in Crackers Neck and joining Island Creek, & also two hundred Acres known by the name of Millers Land & said Millers Land, also a tract of Land containing one hundred acres known by Fergusons Land, also one Tract of Land bought from Tradewell joining Millers Land Also a Tract of Land bought from Brown & Foreman joining the above Lands, Also Six Negroes named as follows, Simmon, Sarah, Butler, [St]? Hepney, Diana, Hannah together with their Increase, & one good riding Horse bridle & saddle to be found from now till he arrives to the Years of eighteen & then another good Horse bridle & saddle together with two good work Horse, a good breeding Mare to be found & given him out of the Estate, also Six Cows & Calves to be marked & branded in his own mark one year after by Decease, together with their increase, also six Sows & Pigs with Six good Beacon Hogs when he arrives at eighteen years, Also one good Waggon and four good Horses & Gears, together with all the Plantation Tools also one good Feather Bed & Furniture, also all my Wearing apparrel with my own Bridle & Saddle also one Silver Watch. Thirdly I likewise give & bequeath to my well beloved Daughter Sarah Hankinson, Five Negroes named as follows Young George, Sybe, March, Molly & Lucke, together with their Increase, also one good Horse bridle & Saddle when She arrives to the age of eighteen to the Value of Twenty five pounds also one good breeding mare to the Value from 10 to 20 pounds Six Cows & Calves to be marked in her own Mark one Year after my Decease together with their Increase to be taken care of by the Executors, also six Sows & Pigs & six good Beacon hogs whe She comes of Age, also one good Feather Bed & Furniture. Also one good breeding mare Value 15 to 20 pounds, also Six Cows & Calves, to be marked in her own Mark, one Year after by Decease, together with their increase and to be taken care of by the Executors, also Six Sows & Piggs, & six good Beacon hogs when She is of the age of eighteen, also one good Feather Bed & Furniture,--- Fifthly, I likewise Give and bequeath to my beloved Daughter Mary Hankinson Five Negroes named as follows Jammy,Mary, Dotty, Jeck & Tome. together with their increase & one good riding Horse bridle and Saddle when She arrives at the Year of Eighteen to the Value of Twenty five pounds, also one good breeding mare to the Value of 15 or 20 pound, also Six Cows & Calves to be marked in her own Mark, one Year after my Decease, together with their Increase, & to be taken Care of by the Exec also Six Sows & Pigs & six good beacon Hoggs, when she arrives at the Age of Eighteen, also one good Feather Bed & Furniture, Also one likely Negroe Wench to be bought & given to Mary over and above what is already given when She Arrives of Age. And if any of these my Children should die having no lawful Heirs of their own Bodies, their part of my Estate to be returned to the remainder of my Children, I likewise Desire and order my Executors if the Mills & Lands thereunto belonging is not Sold in my Life Time, That they shall Sell them & grant Rights & Titles to the Purchasers, & also to Sell a Plantation know by the Name of Foreman, & purchased from John Millidge, also one hundred Acres joining the upper Side purchased from John Bush Sen. Also a Body of Land lying on Town & Hollow Creek it being part, purchased and part Run by Pierce Butler of Charleston & Robert Hankinson, Also one hundred acres in the State of Georgia known by the name of Patridge Pon, near Beaver Dams, also all the Lumber that may be found upon my hand after my Decease. Also all the rising profits that may arrise from the Mills that are Sold. & if any of the above mentioned Lands that remains unsold after my Decease, my Executors to Sell and NB Page 3. Also I desire to be Sold all the Waggons, gares and Horses except Six of the best Work Horses, four breeding Mares & two of the best Waggons & gares. to be kept for use on the Plantation & two good riding Horses also one Stage Waggon for the use of the Family & to be kept on the Plantation. I also desire that the Mills between my Self & Tho. Filput Sen. should be rented out if not Sold during or during the Time that the lease is given from the said Thomas Filput Sen to Robert Hankinson, & also I desire that my Stoned Horse & two Sorrell Horses all be put in good order & Sold. I likewise desire that my Executors shall collect all my Book accounts, Notes on Hand, Bonds & Obligations that is due to me immediatley after my Decease. & all my lawful debts to be paid out of the Mony or Monies so arriving and the remainder to purchase likely young Negroes & to be kept on the Plantation and to be equall divided amongst my Children when they come to Age, that is they are to have Share & Share alike when the Youngest Child come of Age of Eighteen, and also all the other things not heretofore mentioned to be equally divided when the Youngest Child comes of the Age above mentioned. I likewise give & bequeath to Richard Hankinson Sen. my Brother the Plantation whereon he now lives containing one hundred Acres of Land, and also Six Cows & Calves, and two work Horses & planting Tools that he has now in possession, also I give to my said Brother Richard Hankinson Six young Sows & Pigs after my Decease. I desire that one Cow & Calf be given him,as he has got only Five Cows & Calves in his possession--likewise I desire that all & singular the above given, and Land Articles and bequeathed shall by freely & peacable be Possessed and enjoyed by each of the abovementioned.
