Hillhouse ACADEMIES AND EDUCATIONP. 166-167 Other Academies Before the Civil War The Burke County, Pleasant Grove, Bark Camp and Alexander academies were the four oldest in the county, all having been established prior to 1845. All of these had pupils in the lower levels and extended the work to what we now speak of as the high school level. All charged tuition and received some state aid. Two other academies, Poythresville and Grove Mount, were added between 1845 and 1861. Pleasant Grove Academy was chartered by the State Legislature in 1833, the second in Burke after the Burke Academy. Pleasant Grove was a settlement near Hancock's Landing on the Savannah River." A report to the Governor dated October 17, 1835, was signed by five trustees: John Gordon, L. F. Powell, Wade Brown, Hardy Perry, and E. J. Hatcher. Enrollment totaled 32 boys and 15 girls. The boys ranged in age from five to twenty-two; the girls from seven to twelve. MackyWalton, John Bark Camp Academy received its charter from the State in 1834. Its location was in a settlement which took its name from old Bark Camp Church, north of what is now Midville. A report to the Governor dated October 28, 1835, was signed by seven trustees: A. E. Harris, Matthew Jones, F. J. Brown, Jesse Coch, Allen Inman, William Murphree and James Grubbs. The principal was Samuel Field. Students ranged in age from seven to twenty-one years. In the curriculum included spelling, reading, writing, arithmetic, geography, Latin, bookkeeping, and English grammar. The report ended with a petition: We the Committee and Trustees of the Bark Camp Academy do hereby certify that the above statement is correct, and we would beg leave further to state that the Bark Camp Academy was established entirely destitute of funds by the exertions of a few individuals who feeling a deep interest in the cause of education were convicted of the want of institutions of this kind in our own county and the State of Georgia generally. We would also further state, that our Academy has never received any assistance from the State; and while we would submit this statement to your consideration, we would at the same time pray for a portion of the funds assigned to our county for the support and advancement of education. In Equity in Burke Superior Court. E. Starnes trustee et al vs William Murphree et al The amended answer of Thomas A Ward and Thomas A Ward the administrator de bonis non of Thomas Ward deceased. This defendant answering says that he insists that the said Elizabeth Antony wife of Lavorsier Antony and formerly the wife of Fielding J Brown was advanced in the life time of said Thomas Ward to a much larger amount than the other distributees and heirs of said Thomas. That the said Fielding J. and Elizabeth received two negro slaves to wit Charles and Amy and certain lots in the town of Waynesboro to the value of three thousand dollars or other large sum. That this defendant the said Thomas A Ward received one negro slave named Abram of the value of seven hundred dollars. That he is ready and willing to bring said negro slave named Abram into hotchpot to be considered as an advancement to said Thomas A. Ward. That this defendant claims the sum of Eight Hundred dollars to be first paid out of said estate of Fielding J Brown it being the amount besides interest retained by said Fielding J. as the administrator of Thomas Ward to meet a demand against the estate of said Thomas Ward deceased. This defendant prays your Honor that all the Equities arising from the above circumstances may be taken into consideration in the decree and he will ever pray &c. Humbly complaining sheweth to your Honor your orator Ebenezer Starnes, Trustee of Elizabeth A Antony under a certain deed of marriage settlement between Lavorsier L Antony and his present wife Elizabeth A. of date the fourth day of October in the year of our Lord Eighteen hundred and thirty eight, that sometime in the year of our Lord Eighteen hundred and thirty seven one Fielding J. Brown late of said County and State then the husband of the said Elizabeth A. departed this life intestate leaving a considerable estate both real and personal, and leaving as his heirs the said Elizabeth A. and several children viz. Sarah, Elizabeth and Augustus Brown; and your orator further showeth that on the day of ____ in the year of Christ Eighteen Hundred and thirty eight the said Elizabeth A. contracted marriage with and was united in marriage to one Lavorsier L Antony between whom and the said Elizabeth A. and one Edwin L Antony a marriage settlement was agreed upon in accordance with Law. And in consideration of the intended marriage of the said Elizabeth A. and Lavorsier L. and accordingly on the fourth day of Octber in the year of Our Lord One Thousand eight Hundred and thirty eight a deed of marriage Settlement was duly executed by the parties, a copy of which is hereto annexed and marked Exhibit A, which your orator prays may be taken as a part of this your orator's Bill of complaint with leave to refer to the same as often as may be necessary by virtue of what the said Edwin L Antony was appointed Trustee under said deed, and your orator further showeth that the said Edwin L. afterwards by his formal deed of relinquishment resigned and abandoned his trust under and by virtue of said deed, and the said Elizabeth A. and Lavorsier L. being authorized by the provisions of said deed of marriage contract do to do, proceeded by their joint deed of appointment to fill the vacancy so created; to wit; on the seventeenth day of May Eighteen Hundred and forty one by substituting one Walter J Hamilton in the place and stead of the said Edwin L. as such Trustee, and the said Walter J. afterwards departing this life, your orator was by joint deed of the said Elizabeth A. and Lavorsier L. of date the twenty second day of July Eighteen Hundred and forty three hereto annexed and marked Exhibit B. appointed under and by virtue of the terms and provisions of said deed of marriage settlement a Trustee posessing all the power, capacity and authority of the said Edwin L. and Walter J. in the premises. And your orator further showeth that on the fourth day of September in the year of our Lord Eighteen Hundred and thirty seven the Defendant William Murphree applied for and obtained letters of administration on the estate both real and personal of the said Fielding J Brown and took the same into possession together with all the chores(?) in action of the said Fielding J Brown deceased; and the same still continues to possess and keep; And your orator further showeth that in consideration of the premises he had well hoped that the said William Murphree administrator as aforesaid would have paid and turned over to your orator the distributive share to which your orator was entitled as trustee as aforesaid in right of the said Elizabeth A. of the estate of said Fielding J Brown, the said William not having distributed the same to either of your orator's predecessors in said trust or to any other person authorized to receive the same. But now so it is, May it please your Honor, that the said William Murphree combining and cooperating himself with divers persons unknown to your orator, but whose names when discovered he prays he may be allowed to insert into his Bill with apt words to charge them as parties hereto and intending to wrong and injure your orator for the distributive share of said Elizabeth A. in the said estate of said Fielding J Brown, or turn the same over to your orator or account for the same , or his acts and doings in the premises as in justice and ___(?) he should do. In tender consideration whereof and for as much as your orator is remidiless by the strict rules of Common Law, and may only find adequate redress in a Court of Equity where matters of this sort are properly cognizable and relievable May it please your Honor to grant unto your orator the state and most gracious writ of subpoena requiring the said William Murphree at a certain time and under a certain penalty to appear before your Honor in said county at your said Superior Court to be held therein on the fourth Monday in May Eighteen Hundred and forty four, then and there to answer to the several matters and things charged and alleged against him in this your orator's Bill of Complaint that he may then and there give and account of his management of said estate and further to stand to and abide by such order and decree as may to your Honer seem agreeable to Equity and good considered. Starnes & Phinizy Complt's Solt. --------------------------------------------- Burke County, Georgia Equity Court Records 1849-1891 LDS Film 222857, Pages 164-199 Georgia - In Equity In the Superior Court for the County of Burke Ebenezer Starnes Trustee for Elizabeth A Antony vs William Murphree Admr Fielding J Brown decd.} Bill for Discovery &c The answer of the Defendant William Murphree to the Complainants Bill of Complaint. This Defendant now and at all times hereafter saving and reserving to himself all and all manner of benefit and advantage of exception that now or may be had to the many errors, uncertainties, insufficiencies, and other imperfections, or so much thereof, as this Defendant is advised is material for him to answer unto. Answering saith - That he admits the death of said Fielding J Brown intestate, as mentioned in Complainants Bill of Complaint, leaving the said Elizabeth A. his widow, and several children now in life, his heirs at Law. And this Defendant also admits that the said Elizabeth A. has intermarried with the said Lavorsier L. Antony mentioned in said Bill, and that the copy annexed to complainants Bill is a true copy of the original Marriage Settlement mentioned in said Bill and that the complainant is the Trustee under the same. This Defendant further answering says that he did obtain Letters of Administration on said Estate and caused an inventory of the same to be made out, and he returned the same to the Honorable the Court of Ordinary of Burke County. A copy of which is herewith filed as a part of this answer and is found on Exhibit A and also a sale of a portion of the personal estate a copy of which is found on said Exhibit A herewith filed. And this Defendant states that so the truth is that at the said sale of personal Estate the said Elizabeth A. then being sole purchased sundry articles amounting in the whole to the sum of Three Hundred and Seventy seven dollars and Sixty Two and a half cents, which said sum she has not paid to this Defendant, and he prays to be allowed the same out of her portion or share of said Estate as so much paid her thereon. This Defendant further answering says that he had made full returns to the Court of Ordinary of said County of Burke of all his actings and doings as said Administrator and files herewith copies of the same. Exhibit B contains his accounts for the year 1838. Exhibit C for 1839 and Exhibit D & E for 1840 and 1841, Exhibit F & G for 1842 and 1843 amd Exhibit H contains a full and complete return and account brining(?) forward all the Balances on the former returns to January Eighteen Hundred and forty five showing a Balance due to this Defendant of the sum of Eight Hundred and Thirty nine dollars and fifty one cents for moneys paid laid out and expended for the use of said Estate and which said sum and the interest thereon the Defendant prays may be allowed him and he may be repaid the same from said Estate. This Defendant further answering says that the following named Negroes viz Charles, a man, Calway, a man, Betty, Patsy, Joe, Sam, Calvin and Bob belong to said Estate and subject to a Division among the Heirs. This Defendant also had possession of the following Negroes viz - Mary and her children Amy, Jack and Morrison. But that said last mentioned negroes Mary and her children are claimed by one Josiah Hatcher who has filed a Bill on the Equity side of this Honorable Court to recover the same, and this Defendant prays the aid and full and ample protection of of [sic] this Honorable Court touching said Negroes Mary and her children. This Defendant further answering says that there is a House and Lot in the City of Augusta in said State belonging to said Estate, and he is informed some Lands lying in the Original County of Cherokee of which said Lands this Defendant knows nothing but from report and has never had possession of them. This Defendant further answering says that since his last return as per Exhibit H he has paid out for the use of said Estate and received money leaving a Balance on that account in favor of the Estate of $210.67/100 as per his account herewith filed marked Exhibit I which deducted form $839.51 due this Defendant on his last account leaves a Balance due him of five hundred and twenty nine dollars and four cents, which he prays may be allowed him. Further answering this Defendent says that this Estate has four shares of the Capital Stock of the Mechanics Bank City of Augusta. Without that there is any other or further matter or thing contained in said Bill now well and sufficiently answered &c and he prays to be dismissed hereof. Humbly complaining showeth to your Honor, your orator Ebenezer Starnes Trustee under a certain marriage Settlement between Lavorsior L. Antony and his wife Elizabeth A. formerly Elizabeth A. Brown as and amendment to a certain Bill of complaint filed by your orator Trustee as aforesaid against William Murphree administrator of Fielding J Brown deceased at the May Term Eighteen hundred and forty four of said Court, that the said Fielding J Brown departed this life as charged in said Bill of Complaint, he left as his heirs and distributees the said Elizabeth A and her three children Sarah Elizabeth and Augustus Brown, that the said Sarah Elizabeth and Augustus are minors, that the said William Murphree Administrator as aforesaid should fully and fairly account with them (as with your Orator) for the distributive share to which they are entitled in the estate of the said Fielding J Brown, that the accounts of the said minors with said Administrator, and of the said Lavorsior L. and Elizabeth A. with said Administrator on account of said minors, or with the said minors should be considered and provided for by the decree of your Honor and that the said Sarah Elizabeth and Augustus should be by a guardian ad litem to be appointed by your Honor be made parties to said Bill of complaint as your orator further showeth that since the filing of said Bill of compliant and that answer of the Defendant thereto other accounts have been made by said administrator with the distributees of the said Estate of Fielding J Brown, other dispositions of the property thereof have been made by him, and other and further sums of money have been received and expended, and your orator further showeth that the said William as Administrator aforesaid is indebted to your orator for the board of the said minors of the said Fielding J Brown, by the said Lavorsier L. and Elizabeth A. furnished to said minors and paid laid out and expended for the benefit of the property of said estate, all of which will more fully appear by Exhibits hereto annexed __________________(?) And your orator further showeth that in consideration of the premises he had well hoped that the said William Murphree would had accounted with your orator and with the said minors for their distributive shares of said Estate, and that he would have paid to your orator the sum due to the said Lavorsier L. and Elizabeth as aforesaid. But now so it is, may it please your Honor that the said William Murphree combining and confederating himself &c and intending to wrong and injure your orator in the premises refuses to account for said distributive share or to settle and pay said sums of money as in equity and justice he should do. In tender Consideration whereof, and for as much as your orator is remidiless by the strict rules of Common Law, and can only find redress in equity where matters of this sort are Cognizable and relievable may it please your Honor to grant unto your orator the States most gracious writ of subpoena requiring the said William Murphree at a certain time and under a certain penalty to appear before your Honor at the next Superior Court to be held in and for said County on the third Monday in May Eighteen hundred and forty seven, then and there to make additional answer to the matters and things set forth in said Bill of complaint and also to answer the things herein set forth, that he may then and there make just and true answer and return of said estate and his management thereof and further to stand to and abide such order and decree as may to your Honor seem agreeable to Equity and good Conscience. This Defendant says that for the year Eighteen Hundred and forty six the said Elizabeth Antony hired of this defendant as administrator of said Fielding J Brown the following negroes namely Isaac for $60 Joe for $40 and Bob Patsy Calvin &c for $75; and rented the House and Lot in Augusta for $150 and for said sum she gave her promissory note dated February 20th 1846 and payable on or before the first day of January then next and for the year 1847 the said Elizabeth Rented the said House and Negroes of said Estate and on the first day of January 1847 she gave her two promissory notes to this defendant for said Rent and hire dated on that day one note $72 and the other $225 and payable the first day of January then next, all of which said noted this defendant now holds as part of the assets of said Estate and he prays that the same may be so considered and paid out of her portion of said Estate. A copy of said notes are hereunto annexed. This defendant since his last amended answer has paid out money and Rented and hired out the property of the Estate &c all of which appears by his returns of which is hereto annexed as Exhibit No 3. The Balance of that year in favor of the Estate is Three Hundred and fifty dollard and fifty 1/4 cents. This defendant paid for said Estate on the 5th day of April 1838 to John G Dunlap a sum of one Hundred and twenty five dollars and twenty five cents for which he took a Receipt a copy of which is hereto annexed which has not yet been allowed him, and he prays that he may be allowed the same.
