We Malcom D Jones & Charles J Jenkins to whose arbitrument the above case has been refered by order of said Court with power to select a third person to act with us in said arbitration have associated with us John J Jones and the three having heard & considered evidence presented by the parties do award as Follows. We give and award remaining in the hands of William Murphree administrator as aforesaid the following property of his Intestate in kind to wit, the slaves Charles, Joe, Calvin, Bob, Sam & Jack male slaves & Frances, Betty, Mary, Patsey & child, Margaret, female slaves, four shares of the capital stock of the Mechanics Bank located in Augusta, one house & lot situate on Green street in Augusta & on the South side, being part of lot No 90, as described in the deed to said Intestate, also lot (No 197 - 3rd Dist) number one hundred and seventy(?) seven in the third District of Early County, one half interest (the other hald belonging to the estate of Thomas Ward Deceased) of Lot Eighty four (84) third (3rd) District third (3rd) section & of lot five hundred and thirty seven (537) third (3) District fourth (4th) section Cherokee (originally) which we award to Ebenezer Starnes Trustee of Elizabeth A Antony wife of L L Antony and Sarah Brown (recently married to James O Clarke) Elizabeth Brown and Augustus Brown (the said Elizabeth A, Sarah, Elizabeth & Augustus being the distributees & heirs at law of Fielding J Brown deceased) subject to future division among them share & share alike, but said division not to take place until the end of the present year. We find further William Murphree Administrator as aforesaid has faithfully appropriated the income of the estate ____(?) as is not above set forth, as was necessary to the payment of the debts and support of the distributees from year to year, except for the sum of twenty seven hundred and seventy eight 93/100 dollars which we find to be cash in his hands at this time. We also find and award William U Sturges and wife Georgianna (formerly Ward) against William Murphree Administrator as aforesaid in satisfaction of the amount due said Georgianna by the said Fielding J Brown deceased as her guardian with interest to this date included ten hundred and thirty 63/100 Dollars. We also award to Thomas A. Ward Administrator of Thomas Ward decsd. against William Murphree Admr. as aforesaid the sum of eighteen hundred & twenty four Dollars, being the ballance due said estate by Fielding J Brown decsd. former Administrator including interest to this date & the amount of the two last awards, to wit, to Sturges & wife & to Thomas A Ward Administrator we award to be paid out of the aforesaid sum now in the hands of the said William Murphree Administrator and seventy-five 71/100 Dollars from the income of the estate in the hands of the Administrator in the year eighteen hundred & fifty three. We award to William Murphree against William U Sturges & wife Georgianna four hundred & sixteen Dollars which he may retain out of the part awarded to them above against him as Administrator. We also award to Ebenezer Starnes Trustee of Lavorsier L Antony & wife against William U Sturges & wife three hundred and seventy Dollars. We award that the costs of this suit and of letters dismissory be paid out of the income of the property of the estate of Fielding J Brown deceased for the present year & that said income after deducting from it the amounts herein before specified be divided equally among the said Distributees. The Administrator William Murphree being aged & infirm we award that a receiver be appointed by the Judge of the Superior Court who shall receive & keep said estate until divided among the Distributees. We further award that partitioners by appointed by the Judge of the Superior Court aforesaid to divide the estate of Fielding J Brown above specified among the said Distributees - the share of the said Elizabeth A Antony to be represented & received by the said Ebenezer Starnes Trustee as aforesaid.
