Deeds Bk 1 pg 250 BW 8 This Indenture made the ___ Day of December in the year of our Lord one thousand seven hundred and eighty six Between Benjamin Brown planter of the state of Georgia Burke County of the one part and Bartlett and James Brown brothers to the said Benjamin of the other part Witnesseth that the said Benjamin Brown for and in consideration of the sum of one hundred pounds lawful money of the aforesaid state to him in hand paid the receipt whereof the said Benjamin Brown doth hereby acknowledge have Granted Bargained Sold and aliened the premises released conveyed and confirmed & by these presents doth Grant Bargain Sell Alien Remiss Release Convey and Confirm unto the said Bartlett & James Brown in their actual possession now being by virtue of a Bargain and sale to him thereof and for one whole year and by force of the Statute for Transferring Uses into Possession and to themselves their Heirs and assigns forever all that plantation or tract of land containing two hundred and forty acres agreeable by plat lying and being in the county of Winton adjoining lands to the SoWt belonging to the said Bartlett and James Brown and on the NoWt lands belonging to James Moore and on the SoEt adjoining the District line that divides Beauford from Orangeburgh it being five hundred and forty acres of Land originally granted to Bartlett Brown now Deceased by his Excellency Benjamin Gerard Esquire then Governor and Commander in Chief in and over the aforesaid State on the Twenty first Day of January Anno Domini one thousand seven hundred and eighty five and duly recorded in Secretaries Office in Grant Book AAAA page 3AA and he the said Bartlett Brown Deceased dying Intestate without any Lawful will or testament fell to him the said Benjamin Brown being his oldest son and real Heir at law reference to the said plat and Grant being had may more fully appear Together with all and singular the houses out houses edifices Buildings yards gardens orchards woods underwoods timber and timber trees meadows pastures ponds lakes fishings ways waters water courses paths passages liberties privileges profits hereditaments rights members and appurtenances whatsoever thereunto belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders rents issues and profits thereof and every part and parcel thereof and all the Estate right title intrust use trust possession property profit claim and demand whatsoever of him the said Benjamin Brown for into or out of the same presents and every part and parcel thereof To have and to hold the said plantation or tract of Land containing five hundred and forty acres more or less with every the premises and appurtenances thereunto belonging or meant or intended to be thereby granted and conveyed to them the said Bartlett and James Brown themselves their Heirs Exe Adm & assigns forever to the only proper use and behoof of them the said Bartlett and James Brown their Heirs and assigns and he the said Benjamin Brown doth hereby warrant himself his heirs Exe Adm and assigns covenant grant and agree to and with the said Bartlett and James Brown their heirs and assigns in manner and form following that is to say that the Benjamin Brown shall and will warrant the aforesaid plantation or tract of five hundred acres of Land more or less and forever Defend the same by these presents.
