Note: !MARRIAGE: Always assumed by this compiler that he was never married since the hand-written WEAVER histories in compi- ler's "Magenta - Personal Histories" file states that Simeon was a batchelor. However, there are two Simeon WEAVERs listed in the Champaign County marriage records; thus far these Simeons have not been identified . In Book Volume F #7788 26 Jul 1862 m. Lavinia WILSON by N Rhodes, JP. (this is year of Simeon's death.) Volume G. Page 321 m. Sally PILES. (do not have date, but it is obviously later than marriages in Volume F.) !DEATH: Sept. 18, 1862 - age 49 yr 11 mo 10 da !BURIAL: Lot 28 Sec 45 Oakdale Cemetery, Urbana, Ohio. Compi- ler's Grandfather and Grandmother, Albert Jason WEAVER-4 and Mary Ellen STAFFORD-5 are also buried in Simeon WEAVER's lot. !WILL: In the name of the Benevolent Father of All: I Simeon Weaver of Urbana do make and publish this my last Will and Testament: Item 1st. I give and devise and bequeth to my nephew Mathew Weaver when he shall have arrived at the age of majority the following real estate situate in the town of Urbana in the County of Champaign and State of Ohio, being part of fractional(?) lot numbered one of the recorded plat of said town of Urbana, beginning at a point on the south line of said lot, nineteen feet and eight hundredths of a foot, east of the southwest corner thereof; thence north parallel with the west line of said lot seventy nine feet and one fifth of a foot to a stake; thence east nineteen feet and eighty hundredths of a foot to a stake; thence south seventy nine feet and one fifth of a foot to a stake in the south line of said lot; thence west nineteen feet and eighty nine hundreths of a foot to the beginning; together with the sum of five thousand dollars in money to be paid to him when he shalll have arrived at the age of majority aforesaid, by my executor hereinafter anmed, in case he live so long and survive me, out of first moneys coming into his hands after my just debts are fully satisfied and paid. Item 2nd. I will and direct that the sum of one thou- sand dollars of my estate be appropriated to the erec- tion and construction of a monument upon lot No 28, Section No 45, in Oak Dale Cemetery to be in memory of my father and mother, Henry and Nancy Weaver, provided I shall not have so erected the same while I live. Item 3d. I will and direct that the residue of my estate after satisfying the devises and bequests herein before made be disposed of as the law directs. Item 4th. I hereby constitute and appoint William N.(?) Colwell Executor of this my last Will and Testament hereby revoking all others by me made and authorize and empower him to do and perform all things necessary for the due execution thereof. Ichd CORWIN, Judge of the Court of Common Pleas of the County of Champaign & State of Ohio of the March Term of said Court A.D. 1870 to wit on Saturday, March 19. Lemuel WEAVER, Pltf vs Henry WEAVER et al, Defts. } In Partition (photocopy of the original document will be found in this compiler's #13.1 LITIGATION file folder). The following was copied from the Final Entry: "...it is further ordered that the said Sheriff out of moneys in his hands pay first the costs of this case including a Counsel Fee of One hundred dollars to Geo. A. WEAVER taxed to him and that part of the residue he pay to the said Lemuel WEAVER one equal third part; to Louisa M. WEAVER the 2/9's part - To said William WEAVER & Henry WEAVER, Jr. and Albert WEAVER, minors, each one twenty seventh part. To the said Henry WEAVER, the 1/3 part. !LITIGATION(2): Henry WEAVER, Administrator - To Estate of Simeon WEAVER, dec'd - settled Jan 3, 1870. (photocopy in said #13.1 LITIGATION file folder. !ANOMALY: On the north side of the Simeon WEAVER-98 monument, it reads: "Nancy - wife of Henry Weaver-1816 - d. Nov. 21, 1849 - age 63 yrs, 7 mo, 5 da". The "why" of this inscription is indicated by the above Will. However, Henry WEAVER-1816 had a Mausoleum built on Lot #28 - Sect. #45 which, among oth- ers, carries this inscription: "Nancy Chapman, wife of Henry - born in N.J & d. in Urbana, Ohio Nov. 21, 1849 in the 54th yr of her age." Apparently her remains were moved after the construction of the mausoleum.
