The State of Alabama Morgan County To the Honorable E. M. Russell, Judge Probate Court, Morgan County: The petition of the undersigned W. R. Horton respectfully represents that james Baker departed this life at _______ on or about the ____ day of October 1899 leaving no last will and testament, so far ar your petitioner knows or believes, and that his death was known more than ___ days before this day; and this petition further shows that the said James Baker was, at the time of his death, an inhabitant of ___________ and ded seized and possessed of (real - Marked thru)and personal estate in this State consisting chiefly of an interest in a crop after rent was paid, 1 old horse, 2 cows, 1 calf, 1 old wagon, 1 old yoke of oxen, 1 sow & 6 pigs & 2 plow stocks on which there was a mortgage for supplies a ????? $149 now known, all of said real and personal property being estimated to be worth about two or three hundred dollars, and probably not more; that the names, residences, ages and condition of the heirs and distributees of the estate of the siad decedent, so far as your petitioner knows and believes, are as follows, to wit: woman the widow, and five children by the first wife and 2 by the last woman, names and ages of children, Henson, about 20, Mollie, about 18, Maggie about 15, Jerry about 12, & Jacky about 10. The children by the last woman names not known ages about 1 and 3 years old. Suppose these two youngest are with their mother in Etowah County, Alabama and the other five children are supposed to be living in this county. That the said _______ has declined to administer the said estate as appears from her non residence in the county that your petitioner being a friend of said deceased an inhabitant of the state above the age of twenty-one years. DEATH: DEATH: James Baker was involved in an accident in October of 1879. His arm was mangled in a cotton gin in Eva, Morgan County, Alabama. He was taken to the home of his sister, Lou Bates, for treatment. An attempt to amputate his arm on the kitchen table but the attempt failed. James Baker died and was buried in Lawrence Cove Cemetery. Census for Limestone County, Alabama has birth place Georgia.
