  LAST WILL AND TESTAMENT of Ruth Ettlean Culver The State of Texas, County of Harris Know all men by these presents: That , I, Ruth Ettlean Culver, of Harris Co., Texas, being of sound mind and mindful of the uncertainty of life and desirous of making disposition of my estate while I have the physical and mental powers to do so, do hereby make, declare and publish this my Last Will and Testament, hereby revoking all former wills, if any, by me heretofore made, and for the terms and previsions hereof, Witness the following: 1. It is my desire and I so direct that upon my death, my just debts, if any, as well as the expenses of last illness and burial, all estate, inheritance and other succession taxed and charges that may be lawfully assessed against my estate or any devises hereunder, and the cost of probating this will, shall be paid out of my estate by the executor as soon as same can be done without undue sacrifice hereto. 2. I hereby give, bequeath and devise to my beloved husband, Edward Louis Culver, all of the estate of which I may die seized and possessed, in full fee simple title with full power and authority to hold, use, enjoy, dispose of and make conveyance thereof as he may see fit without remainder to anyone. 3. I hereby constitute and appoint my husband, Edward Louis Culver, sole and independent executor of this my Last Will and Testament, and direct that no bond or security be required of him and that no other action be had in the country court having jurisdiction of my estate in relation to the settlement thereof except to file and probate this will, to return and file therin the inventory and appraisement and list of claims owing to or owing by My estate as required by law and to make such returns for inheritance and estate tax purposes as are required by law, after which I direct that My estate be dropped from the docket of such court. 4. In the event of my death and the death of my husband, Edward Louis Culver, substantially at the same time, or in the event of the death of my husband before my death or before this will has been admitted to probate, then I hereby give, bequeath and devise unto my beloved daughter, Jeallean Fern Culver, now fourteen years of age, all of the estate of which I may die seized and possessed, whether real, personal or mixed, in full fee simple title with full power and authority to use, enjoy, dispose of and make conveyance thereof as she may desire. 5. In the event of the death of my husband, Edward Louis Culver, before my death or before this Will has been admitted to probate, then I hereby constitute and appoint Lemuel E. Newton, now residing at 1126 Jocylen, Houston, Texas, as Independent executor of this my last will and testament, and direct that no bond or security be required of my executer and that no other action be had in the county court having jurisdiction of my estate in relation to the settlement thereof except to file and probate this will, to return and file therein the inventory and appraisement and list of claims owing to, or owing by, my estate as required by law and to make such returns for inheritance and estate tax purposes as are required by law, after which I direct that my estate be dropped from the docket of such court. Culver of Genoa; daughters, Mrs. Fern Beal of La Porte, Mrs. Mildred Howard of Pasadena, Mrs. Ruth Jones of Tomball, Mrs. Merle Williams of Guntersville, Ala., Mrs. Joyce Garner & Mrs. Jeallean Jones both of South Houston; sisters, Mrs. Doris Milam of Houston, Mrs. Gladys McDaniel of Galena Park, Mrs. Vera Matthews of Waco; mother, Mrs. Maggie Newton of Houston; brothers, L.E. and Emmett C. Newton both of Houston; 13 grandchildren; one great-grandchild. Services 2 pm Monday, Genoa Assembly of God Church with Rev. Carroll and Rev. J.B. Linney officiating.
