Note: According to information by Robert Roberts Burgess was married to Ellen Proffit in 1868. Family information is that his wife died when son Riley was about 5 and Burgess remarried. If this is correct Burgess, his parents were Richard and Mary Scoggin. Location: Rutherford Co., NC at birth Location: Catoosa Co., GA in 1852 Per 1870 Census of Texas County, MO, Cass Twshp, Burgess was 19, Mary was 16, David M. was 1, Mary A was 48 and Milly N. was 24. Started buying land in Independence Co., Ar on May 3, 1882 On April 13, 1889, Burgess and Mary E. Scoggins mortgaged personal property consisting of 2 steer, 1 cow and their corn and cotton crops raised in 1889, planted on land at or near Salado Creek. Per Letona Elms in Kevil, KY on 12-15-90, she found Burgess in the 1890 Personal Property tax assessment list of Independence Co, AR in Corner Stone School Dist $63.00. Said he and Riley should be on th 1900/1910 census of same county. Marriage records list marriage to Miss Leaner F. Haney on Sept 15, 1895 Per 1900 Census, Burgess lived in Fairview, Independence County, AR. Listed as a widower with 2 sons: Riley 12 yrs, Albert J. 9 yrs. Marriage to Mrs. Mary E. Fox on April 7, 1901 Marriage to Mrs. Florence May Ivey on Jan. 5, 1905. No record of divorces were found! Per 1910 Census, lists Burgess as James Burgess, Age 58 living in Relief Towhship in Indep Co., AR with Clyde J. at 4 yrs and Henry F. at 3 years of age. Per Betty Jo, He died in a poor house outside of Batesville and is buried there. Location: Fairview Township, AR in 1900 1910 was tried for murdering stepson (son of Florence May) was found not guilty. Per courthouse records, committed to poorhouse in Indep Co., AR on January 30, 1911 with wife May Scoggins and their two children, Henry Scoggins and James Scoggins for a period of 30 days or until the further orders of the judge.
