a. Note:   Page 567 This Deed of Mortgage made the 26 day of Sept 1777 between John H. Haggard of the first part and W.E.Mallory of the second part Wittnesseth That the party of the first part in consideration of the matter herinafer stated do hereby Sell and Convey to the party of the second part his heirs and assigns the following described party viz my entire crop of Tobacco raised by the party of the first part during the present year on his farm in Todd County Ky and supposed to be about acres also a black mare about 7 years old with a bald face and about 10 hands high now in the possession of the Page 568 first party To have and to hold the said described proper ty unto said party of the second part his heirs and as signs forever Provided always and these present upon the condition that Whereas the party of the first Part stands justly indebted ti the second party by a promissory note dated 1st day of April 1873 and due twelve months from date for Eighty Dollars with per four Cent interest from date said note is credited by the interest up to April 1st 1877 and by Twenty Dollars paid May 26th 1877 Now should the said first party will truly pay off and discharge said note together with all interest and costs that may occur thereon and pay for recording this mortgage then this Mortgage shall be null and void otherwise to be and remain in full force and effect, In Testimony whereof we have hereto signed our names the day and year first above written his Att S.H.Wells John N x Haggard mark

  Todd County Mortgages Book 2 Page 157 Whereas, Charles Mann and Ruth Mann being indebted to Eli Mallory in the sum of seventy five dollars evidenced by this promissory note of even date herewith and due in twelve months from this date and bearing interest from date at the rate of ?4 per cent per annum. Now for te purpose of securing the payment of said sum of money, together with all interest and costs which may accrue thereon the undersigned mortgagor do hereby mortgage and convey unto the said Eli Mallory the following described property towit: A certain tract of land lying in Todd County on the waters of Whippowill (sic) and bounded as follows towit Beginning at post oak corner to Carneal now Hadden, thence with 40 acres sold to Chandler S7 3/4 W88 poles to three white oaks crossing a drain, thence S70 poles to an ash corner to Crogham now Brockman; thence with his line 110 poles crossing the creek to a large black oak; thence W?E 155 poles to a black oak on a hillside corner to Carneal now, Hadden; thence W88 1/2 W 1/2 poles to the beginning containing one hundred and thirteen acres; said property is warranted free of encumberances and against any adverse claims. To have and to hold the said property to the said Eli Mallory and his assigns forever provided never the less, that if the aforesaid Chas Mann or his personal representatives should pay to said Mallory the said sum of seventy five dollar when the same becomes due, together with all interests and costs which may accrue thereon, then this mortgage Page 158 and such other writing as may exist as evidence of said debt shall be null and void, otherwise to be and remain in full effect, and said grantors hereby especially waives and releases all right or claims which they have which arises out of, or is given by, the Exemption laws of Kentucky in and to the property hereby conveyed, and these covenants and conveyences as ezpecially made part of this mortgage.   Interview with Jettye Irene Mallory Shemwell 12 Oct 2003 Elkton KY Re: William Eliah Mallory Pa Paw was selfish, didn't want children to be loud. He had long whiskers. Mamaw was still alive when he died but she died soon after. She was kind to the children, sometimes feeding them chicken between meals In their house was a big table. Phil Templeman's house built on site It was 2 rooms with kitchen water bucket on top -- Irene remembered she got up in a chair to reach it.
  Citing the fact that Eli received a Civil War pension, I once asked her which side he fought on, Aunt Irene gave me stern look and replied, "OUR side, of course!"

  Acording to Clyo Estelle Mallory Violette, Eli could pinch with toes.
  On his death bed, he hit both Clyo and Noree on their heads with his knouckles, scaring them as they sat on the floor between him and the fireplace.
