  Absalom Waymire Last Will and Testament
  Be it remembered that on this 7th day of November A.D. 1865 The last Will and Testament of Absalom Waymire Decd. was filed in the Office of the Clerk of the Common Pleas Court of Fountain County which reads in Words following to wit: In the name of God amen. I Absalom Waymire of the County of Fountain and State of Indiana, being weak in body but of sound mind and memory do make and publish this my Last Will and Testament To wit: I give and bequeath to my beloved Daughter Elizabeth Chisum all my personal property which I may own at the time of my death. Also it is my Will and wish that all debts due me to be collected and after all my just debts and personal expenses and administration expenses are paid the residue be divided as follows to wit: To my son Isaac Waymire, one third, to my daughter Elizabeth Chisum one third, and to the heirs of my daughter Jane who was first married to George Mouehon and was afterward married to James Silvers. It is further my Will and wish that my Real Estate to wit: The south-west portion of Section No. Nineteen {19} in Township number Twenty-two North of Range Number Six west in the District of land sold at Crawfordville, In- diana be sold and the proceeds to be divided equally between my children aforesaid to wit One third to my decd. Daughter Jane Silvers (Late Jane Mouihan) And I do hereby nominate and appoint my brother Alexander Waymire to be Executor of this my last Will and Testament hereby revoking all prior Wills made by me. And I do hereby authorize and empower my said Executor to sell and convey my said Real Estate, to receive the proceeds thereof and also to collect all debts due me and pay all my debts funeral and administration expenses and to pay all the residue to my said children as aforesaid. One third to my son Isaac, One third to my Daughter Elizabeth, and one third to the heirs of my Daughter Jane as aforesaid My said Executor will sell my real Estate when he thinks it to the best advantage of my said heirs. October 11th, 1865 Absalom Waymire Signed Seal and delivered and pub- lished by the said Absalom Waymire as and for his last Will and Testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses hereto October 11th, 1865. Horatro Gates Benjah Stout Hatt William Horthington State of Indiana Fountain County ss. Be it remembered that on the 7th day of November 1865, B.S. Hatt and Wm. Worthington two of the subscribing witnesses to the within and foregoing last Will and Tes- tament of Absalom Waymire late of said county deceased personally appeared before the undersigned clerk of the Court of Common Pleas of Fountain in the State of Indiana and being duly sworn by the Clerk of said Court upon their oath declared and testified as follows to wit: That on the 11th day of October 1865, they said the said Absalom Waymire sign his name to said instruct in wri= ting as and for his last Will and Testament and that these deponents at the same time heard the said Absalom Waymire declare the said instruct to be his last Will and testament and that the said instruct was at the same time. At the request of the said Absalom Waymire And with consent attested and subscribed by the said Benijah S. Hatt & Wm. Worthington & Horatro Gates in the presence of said testator and in the presence of each other as subscribing witnesses thereto. And that the said Absalom Waymire was at the time of the signing and subscribing of the said instruct as aforesaid More than twenty one years of age, And of sound and disposing mind and memory and not under and coercion or restraint as the said deponent verily believes; and further deponent says not. Benijah Stout Hatt Wm. Worthington Sworn to and subscribed by the said B. Hatt, William Worthington before me W.D. Kerr clerk of said court -- ington this 7th day of November 1865. Kerr Clerk of the Court of Common Pleas of Fountain County in the State of Indiana, do hereby certify that the within a named last Will and Testament of Absalom Waymire has been duly admitted to probate and duly proved be the testimony of B.S. Hatt & Wm. Worthington two of the subscribing witnesses thereto. And a complete Record of said Will and the testimony of the said B.S. Hatt & Wm. Worthington in proof thereof, has been by me duly made and recorded in Book 3 pages 200 & 201 of the Record of Wills od said County. In attestation whereof I have hereunto subscribed my Hand and affixed his seal on said Court at Covington this 7th Day of November 1865. W.
