Note: N74 Liber 25 page 269 and 270 Ontario County New York This Indenture made the fourth day of April in the year of our lord one thousand eight hundred and sixteen Ithamer Sanders of the Town of Gorham County of Ontario and State of New York of the first part and James McPherson of the town County and State aforesaid of the second part witnesseth that the said party of the first part for and in consideration of the sum of one hundred dollars to him in hand paid by the said party of the second part the receipt whereof hereby confessed and acknowledged hath granted bargained sold remised released aliened and confirmed and by these presents doth grant bargain sell remise lease alien and confirm unto the said party of the second part and to his heirs and assigns forever all that certain tract or parcel of land being part of lot number thirty eight in township number nine in the second range of township in the County aforesaid and bounded as follows that is to say beginning in the center of the highway leading from Swarts Tavern east to Griffins mill and at the southeast corner of lands belonging to the heirs at law of Stephen Albro deceased thence running North fifteen chains and eighty links to a stake and stone thence east five chains and six links to a stake and stones thence south fifteen chains eighty links thence west along the center of the aforesaid highway five chains and six links to the place of beginning containing seven acres three rods and thirty nine perches be the same more or less together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate right title interest claim and demand what ever of the said party of the first part either in law or equity as in and to the above bargained premises with the said hereditaments and appurtenance to have and hold the said premises above described to the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second part his heirs and assigns forever. And the said party of the first part for himself his heirs executors and administrators doth covenant grant bargain and agree to and with the said party of the second part his heirs and assigns that at the time of the ensealing and delivery of these presents he is well seized of the premises above conveyed as of a good sure perfect absolute and indefeasible estate of inheritance in the law in fee simple and that the above bargained premises in the quiet and peaceable possession of the said party of the second part his heirs and assigns against all and every person or persons lawfully claiming or to claim the whole or any part thereof he will forever warrant and defend in witness whereof the party of the first part hath hereunto set his hand and seal the day and year first above written Ithamer Sanders *** seal Sealed once and delivered in the presence of the word "thirty" in the eighth line. On the fourth day of April in the year eighteen hundred and sixteen before me Moses Atwater a judge of the court of Common pleas in said County came Ithamer Sanders who is personally known to me to be the person described in this indenture and acknowledged that he executed the same as his free act and deed. To the County Judge of the County of Ontario The petition of Cynthia McPherson Respectfully represents That she resides in the town of Gorham in the said County, that she is the widow of James McPherson late of the same town who died at his residence therein on the 11th of January 1849, that he was at the time of his death a citizen of the United States an inhabitant of the said County and of full age; that he died intestate and left personal property within the said County not exceeding in value the sum of eight hundred dollars which he did not dispose of by will or in any other manner that which remains to be administered. That the following are the names and place of residence of all the heirs and next of kin of the said deceased viz. besides yours petitioner. Minerva McPherson of Gorham aforesaid John E. McPherson of same place James H. McPherson of same place William S. McPherson of same place Harriet T. McPherson of same place That all of the said heirs and next of kin are of full age except the said William S. and Harriet T. the former of whom is aged about 18 years and the latter of whom is aged eight years and for whom no general guardians have been appointed with the said James H. McPherson as son of the said intestate, prays that letters of administration of the personal estate of the said deceased may be duly granted to her and him on their giving the exquisite bonds with surety for the faithful execution of the said trust.
