Note: N76 Deed number 4 Ontario County, NY Indenture/DEED Birdseye-McPherson 15 December 1819 Liber 34 page 417 Lot # 48 Twp # 10 , 2nd range Ontario County, New York This Indenture Made the fifteenth day of December in the year of our Lord one thousand eight hundred and nineteen between James Birdseye and Phebe Birdseye his wife of the town of Gorham County of Ontario of the first part and William McPherson of the town and County aforesaid of the second part witnesseth that the said parties of the first part for and in consideration of the sum of one hundred and fifty dollars to them in hand paid by the said party of the second part the receipt whereof is hereby confessed and acknowledged have granted bargained remised released aliened and confirmed and by these presents do grant bargain sell remise all alien and confirm unto the said party of the second part and to his heirs and assigns forever all that certain tract or parcel of land being and lying in the aforesaid town of Gorham and bounded as follows Viz. Beginning at the centre of the turnpike road thence running south on the division line between James Birdseye and the heirs of Joseph Birdseye deceased twenty rods thence east twelve rods thence north twenty rods to the centre of the turnpike road thence west twelve rods to the place of beginning being a part of lot number forty eight in township number ten in second range in the County aforesaid containing one acre and one half be the same more or less the clause as warranty hereinafter mentioned not being meant by the parties to extend to any land leagally laid out to highway included in the above mentioned bounds together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the revision and revisions remainder and remainders rent fees and profits thereof and all the estate right title interest claim unto demand whatsoever of the said parties of the first part either in law or equity as in and to the above bargained premises with the said hereditaments and appurtenances to have and hold the said premises above described to the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second part his heirs and assigns forever in witness the said parties of the first part for themselves their heirs executors and administrators do covenant grant bargain and agree to and with the said party of the second part his heirs and assigns that at the time of the ensealing and delivery of these presents they were well seized of the premises above conveyed as of a good sure perfect absolute and indefeasible estate of inheritance in the law in fee simple and that the above bargained the premises in the quiet and peaceable possession of the said party of the second part his heirs and assigns against all and every person or persons lawfully claiming or to claim the whole or any part thereof they will forever warrant and defend in witness whereof the parties of the first part have hereunto set their hands and seals the day and year first above written. Mc Pherson an Freelove his wife of the town of Lime County of Huron State of Ohio of the first part and Joseph P. McPherson of the town of Gorham County of Ontario State of New York of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of one hundred and sixty dollars to them in hand paid by the said party of the second part the receipt whereof is hereby confessed and acknowledged hath granted bargained sold remised released and forever quit claimed and by these presents doth grant bargain sell remise release and forever quit claim unto the said party of the second part and to his heirs and assigns forever. All that certain track or parcel of land situated in the County of Ontario and State of New York being fifty one acres of the northwest half of lot number thirty eight in township number nine in the second range exclusive of five acres on the West line beginning at the southwest corner running north one hundred and nineteen rods and eighteen links to a stake and stone thence East sixty six rods and twenty links thence South one hundred and nineteen rods and eighteen links thence West sixty nine rods and four links to the place of beginning. Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the revision and revisions remainder and remainders rents issues and profits thereof and all the estate right title interest claim and demand whatsoever of the said parties of the first part either in law or equity of in or to the above bargained premises with the said hereditaments and appurtenances. To have and to hold the said premises above described to the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second part his heirs and assigns forever. McPherson and Freelove his wife known to me to be the Persons whom they themselves to be and severally acknowledge the signing and sealing Their of to their free act and deed for the purpose therein enforced the said Cynthia McPherson and the said Freelove S. McPherson being by me examined separate and apart from their said husband and the contents to them fully made known they acknowledged that they executed the same of their own free will and without fear or coercion of their said husbands given under my hand officially this 11th day October 1832. McPherson and severely acknowledged the signing and sealing of the within deed as their free act and deed and also personally appeared Cynthia McPherson wife of the above named William and Freelove S. McPherson wife of the above Robert L. McPherson and being examined separate and apart from their said husbands did severally acknowledge the signing and sealing of the writhen deed for the use and purpose therein expressed without fear of or compulsion of their said husbands and they being made known to me as being the persons they represent themselves to be by the oath of Wm.
