Note: N97 To Mark H. Sibley County Judge of the County of Ontario- performing the duties of the office of Surrogate therein- The petition of Charles Rice of the town of Seneca in the County aforesaid. Respectfully represents That William McPherson late of the said town died at his residence in the said town on the 21st day of February last- having made in his life time his Will bearing date the 4th day of March in the year 1844 and duly Executed the same whereby he disposed of his real and personal Estate situated in the said County and therein and thereby appointed your petitioner and his son John McPherson of the said town Executors of his said Will: that the said John McPherson declines to take upon himself the burden of such appointment but renounces the same. That your petitioner is willing and desirous to accept such appointment and now presents the said Will for probate and prays that a citation may be duly issued pursuent to law to all persons interested to appear in this court at a day to be fixed for such purpose and that such other legal measures may be taken as shall be necessary to the proving and recording after said Will and for the granting to your petitions of letters testamentary thereon. Your petitioner further presents that the said testator has at the time of his death a citizen of the State of New York au ui habitant of the county of Ontario. And of full age. That the heirs and devisees of of the said testator with their respective residences are as follows according to the best of your petitioners knowledge And belief Viz. Margaret McPherson the widow Of the said deceased, who resides at the said town of Seneca. Mary Gregory who is the wife of John Gregory of the same place Nancy Armstrong the wife of James Armstrong of the town Covington in the County of Wyoming in the State of New York James McPherson of the town of Seneca aforesaid Eliza Ainsley wife of John Ainsley of the town of Potter in the County of Yates in the State of New York Harriet Grieves Widow of James Grieves deceased of the town of Putnan in the County of Livingston and State of Michigan Jane Thomas wife of Ambrose S. Thomas of the town of Potter in the County of Yates N..Y Alexander McPherson of Seneca aforesaid John McPherson of Seneca aforesaid That each and every of the said heirs and devisees are of full age and that there are no other heirs or devisees of the said testator to the knowledge or belief of the petitioner Charles Rice Dated May 2nd 1848 Ontario County Ss on the 2nd day of May 1848 came before me the above named Charles Rice and made oath that the facts set forth in the foregoing petition are true according to the best of his knowledge and belief. John M Rice being duly sworn says that he was well acquainted with William McPherson named in the foregoing petition in his life time, that he was a subscribing witness to the Will of the said William bearing date the 4th day of March 1844 which Will is now presented to the County Judge of the said County for probate and is in the same condition as this deponent received the same from the said William at the time the said Will was executed by him, at which time the said William delivered the said Will to the deponent for safe keeping and he has kept it since until he this day delivers it to the said County Judge. Rice liber no# 8 page 474 lot #114 Twp#9 1st Range Ontario County New York This Indenture Made the thirteenth day of September in the year of our Lord one thousand and eight hundred and two between Thomas Morris of the County of Ontario and State of New York and Sally his wife of the first part and William McPherson of the same County and State of the second part witnesseth that the said parties of the first part for and in consideration of the sum of one hundred seventy five dollars to him in hand paid by the said party of the second part the receipt whereof is here by confessed and acknowledged have grants bargained sold remised released aliened and confirmed and by these present do grant bargain sell remise release alein and confirm unto the said party of the second part and to his heirs and assigns forever all that certain tract or parcel of land situate in the County of Ontario and State of New York being fifty acres off of the North part of lot number one hundred fourteen in township number Nine in the first range to be laid off by a line running parallel with the north and south boundary lines of said lot together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the revision and revisions remainder and remainders rents issues and profits thereof and all estate right title interest claim and demand whatsoever of the said party of the first part either in law or equity or in and to the above bargained premises with the said hereditaments and appurtenances to have and to hold the said described lands with the appurtenances to the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second part his heirs assigns forever . And the said party of the first part for them selves their heirs executors and administrators do covenant grant bargain and agree to and with the said party of the second part his heirs and assigns that at the time of the ensealing and delivery of these presents they are well seired of the premises above conveyed as of a good sign perfect absolute and indefeasible estate of inheritance in the law in fee simple and that the above bargained premises in the quiet and peaceable possession or of the said party of the second part his heirs and assigns against all and every person or persons lawfully claiming or to claim the whole or any part there of they will forever warrant and defend in witness whereof the party of the first part have hereunto set their hands and seals the day and year first above written. Signed sealed and delivered in the presence of Thomas Morris ***seal Sally Morris ***seal John Greig John McPherson Ontario County Let it beremembered that on the thirteenth day of September in the year of our Lord one thousand eight hundred and two before me Augustus Porter one of the judges of the court of common pleas for said County in the within in named Thomas Morris and Sally Morris wife of said Thomas to me known to be the same person described in and who executed the said indenture who acknowledged that they executed the same as their free act and deed the said Sally being by me first examined separate and apart from said husband acknowledged that she executed it without fear threat persuasion or compulsion of her said husband there being there in no erasure or inter lineation I do allow the same to be recorded . Augs Porter I certify the forgoing to be a true copy of the original record examined and compared September 13, 1802 at 4 O clock P.M. P.B. Porter Clk. Liber 49 page 595 and 596 Ontario County New York This Indenture made the eighth day of July in the year of our Lord one thousand eight hundred and twenty nine between James McPherson of the town of Gorham in the County of Ontario and state of New York of the first part and William McPherson of the town of Seneca County and state aforesaid of the second part witnesseth that the said party of the first part for and in consideration of the sum of two hundred dollars to him in hand paid by the said party of the second part the receipt whereof is hereby confessed and acknowledged hath granted bargained sold remised released aliened and confirmed and by these presents doth grant bargain sell remise release alien and confirm unto the said party of the second part and to his heirs and assigns forever. All that certain tract or parcel of land situate in the town of Gorham County of Ontario and state of New York it being part of lot number nine in the second range of township in the said County of Ontario bounded as follows Viz. Beginning at the southwest corner of land on the four corners of the roads west of William Pardes dwelling house and the corners that James McPherson Blacksmith shop now stands on running thence west on the road sixteen rods thence south parallel with the road running from the said four corners to Bethel ten thence east parallel with the road running from the said four corners to Canandaigua sixteen rods thence north along the said road running from the said four corners to Bethel ten rods to the place of beginning containing one acre of land no more clear of all roads together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate right title interest claim or demand whatsoever of the said party of the first part either at law or in equity of in and to the above bargained premises with the said hereditaments and appurtenances to have and to hold the said above granted bargained and described premises unto the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second part his heirs and assigns forever and the said party of the first part for him and his heirs executors and administrators doth covenant grant bargain promise and agree to and with the said party of the second part his heirs and assigns that the above bargained premises in the quiet and peaceable possession of the said party of the second part his heirs and assigns against all and every person or persons lawfully claiming or to claim the whole or any part of the above mentioned and described premises the said party of the first part will forever warrant and defend in witness whereof the said party of the first part hath hereunto set his hand and seal on the day and in the year first above written. Came before me this eight day of July 1829 James McPherson to Ontario County me known to be the person described in and who executed the within deed and acknowledged that he signed sealed and delivered the within deed for the use and purpose therein mentioned set it to be recorded.. To William McPherson brother of Robert McPherson late of Easton in the County of Ontario Deceased Whereas the said Robert McPherson As is alleged died intestate; having whilst living, and at the time of his death, goods, chattels or credits within this State, by means whereof, the granting Administration, and also the auditing, allowing and final discharging the Account thereof doth, appertain unto us--- and we being desirous that the Goods, Chattels and Credits of the said deceased may be well and faithfully administered, applied and disposed of Do, grant unto the said William McPherson full power by these presents, to administer and faithfully dispose of all and singular the said Goods Chattels and Credits: to ask demand recover and receive the Debts which unto the said deceased whilst living, and at the time of his death did belong; and to pay the Debts which the said deceased did owe, so far as such Goods, Chattels and Credits will thereunto extend and the Law require. Hereby requiring you to make, or cause to be made a true and perfect Inventory, of all singular the Goods, Chattels and Credits of the said deceased, which have or shall come to your hands, possession or knowledge, and the same so made, to exhibit or cause to be exhibited, into the office of the Surrogate of the County of Ontario, at or before the expiration of six Calender Months from the date hereof: ----And also to render a just and true Account of Administration when thereunto required. And we do by these Presents, depute constitute and appoint you the said William McPherson Administrator of all and singular the Goods Chattels and Credits which were of the said Robert McPherson Deceased.
