Note: N416 Never married. Indenture: 1798 Hurd-McPherson One thousand seven hundred and ninety eight between Elijah Hurd of Easton in the County of Ontario and state of New York of the one part and Robert McPherson of Easton in the County of Ontario and state of New York of the other part witnesseth that the said party of the first part for and in consideration of the sum of two hundred and fifty dollars lawful money of the state of New York to him in hand paid at or before the ensealing and delivery of these presents by the said party of the second part the receipt whereof is hereby confessed and acknowledged have granted bargained sold aliened remised released conveyed assured enfeoffed and confirmed and by these presents. Do grant bargain sell alien remise release convey assure enfeoff and confirm fully freely and absolutely unto the said party of the second part and to his heirs and assigns forever. All that certain tract or parcel of land situate in the County of Ontario and state of New York being fifty acres on the north east corner of lot No. fifty three in township No. nine in the second range beginning at the north east corner of the said lot thence running south eighty rods thence west one hundred rods thence north eighty rods thence east one hundred rods to the place of beginning. Together with all and singular the appurtenances privileges and advantages whatsoever unto the said above mentioned and described premises in any wise appertaining and belonging and the revision and revisions remainder and remainders rents issues and profits thereof and also all the estate right title interest property claim and demand whatsoever as well in law as in equity of the said above bargained premises as in hand to the same or an part or parcel thereof with the appurtenances to have and to hold the above granted bargained and described premises with the appurtenances unto the said party of the second parts heirs and assigns for their own proper use benefit and behoof forever and the said party of the first part for his heirs executors and administrators do convent promise grant and agree to and with the said party of the second part his heirs and assigns. That the said party of the first part doth at the time of ensealing and delivery of these presents lawfully seized in his own right as in and to the aforesaid described premises hereby granted and conveyed with the appurtenances as of a good sure perfect absolute and indefensible estate of inheritance in the law in fee simple without any manner of condition to other change determine or defeat the same and hath wise good right full power and lawful authority to grant bargain sell convey and release the above said described land and premises with the appurtenances to the said party of the second part his heirs and assigns in manner aforesaid and also that the said party of the second part his heirs and assigns shall and may from time to time and at all times and forever hereafter peaceably and quietly have sold occupy possess and enjoy the said hereby granted and bargained premises with appurtenances. And also that the said party of the first part and his heirs and all and every other person or persons whomsoever lawfully or equitably delivering any estate right title or interest as in or to the herein before granted premises from under or in trust for him and them shall and will at any time or times hereupon the reasonable request of the said party of the second part his heirs or assigns and at the proper costs and charges in the law of the said party of the first part his heirs and assigns make do and execute or cause to procure to be made done and executed all and every such other and other lawful and reasonable conveyances and assurances in the law for the seller and more effectually vesting and confirming the premises hereby intended to be granted in and to the said party of the second part his heirs and assigns forever as by said party of the second part his heirs or assigns or their council learned in the law shall be reasonably devised advised or required: and the said party of the first part his heirs executors and administrators engaged to warrant and by these presents forever to defend the above described and released premises and every part and parcel thereof. In witness whereof the said party of the first hath hereunto set his hand and seal the day and year first above written. Be it remembered that on the first day of December in the year of our Lord one thousand seven hundred ninety eight personally came before me Moses Atwater one of the judges of the court of common pleas in and for the said County. Elijah Hurd acknowledged he had signed sealed and delivered the within Indenture as his free voluntary act and deed to and for the uses and purposes therein expressed. I being personally acquainted with the said Elijah and satisfied that he is the same person who executed the within Indenture and on inspection thereof finding no material erasures obliterationĂs or interlineations do allow it recorded ----------- Moses Atwater I certify the foregoing to be a true copy of the original deed recorded examined and confirmed this first day of December AD 1798 P.B. Porter Clk. THE PEOPLE of the State of New York by the Grace of God Free and Independent. To William McPherson brother of Robert McPherson late of Easton in the County of Ontario Deceased Whereas the said Robert McPherson As is alleged died intestate; having whilst living, and at the time of his death, goods, chattels or credits within this State, by means whereof, the granting Administration, and also the auditing, allowing and final discharging the Account thereof doth, appertain unto us--- and we being desirous that the Goods, Chattels and Credits of the said deceased may be well and faithfully administered, applied and disposed of Do, grant unto the said William McPherson full power by these presents, to administer and faithfully dispose of all and singular the said Goods Chattels and Credits: to ask demand recover and receive the Debts which unto the said deceased whilst living, and at the time of his death did belong; and to pay the Debts which the said deceased did owe, so far as such Goods, Chattels and Credits will thereunto extend and the Law require. Hereby requiring you to make, or cause to be made a true and perfect Inventory, of all singular the Goods, Chattels and Credits of the said deceased, which have or shall come to your hands, possession or knowledge, and the same so made, to exhibit or cause to be exhibited, into the office of the Surrogate of the County of Ontario, at or before the expiration of six Calender Months from the date hereof: ----And also to render a just and true Account of Administration when thereunto required. And we do by these Presents, depute constitute and appoint you the said William McPherson Administrator of all and singular the Goods Chattels and Credits which were of the said Robert McPherson Deceased.
