  DEED - Luther Holley to Samuel Hanna of Livonia - 75 acres
  ARTICLES OF AGREEMENT, Made and concluded this twenty third day of April in the year of our Lord one thousand eight hundred and twelve between Luther Holley of Salisbury, in the State of Connecticut of the first part, and Samuel Hanna of Livonia and State of New York of the second part. The said party of the first part, for himself his heirs, executors and administrators, doth hereby covenant and agree, to and with the party of the second part, that he the said party of the first part will, on or before the twenty third day of April one thousand eight hundred and thirteen execute and deliver , or cause to be executed and delivered, unto the party of the second part, his heirs or assigns, or to whom he shall appoint, a good and sufficient Deed in law, in fee simple, of all the following tract of Land, situate between townships number nine in the 5th and 6th ranges of townships in the County of Ontario and the State of New York, viz. In the gore in Livonia being seventy five acres off from the west end of lot No. nineteen in the said gore after deducting 2 acres lying in a square form to be taken from the north west corner of said lot, including all highways if any there be, that is there to be the above quanty(sic) of seventy five acres after leaving out the two acres above mentioned and besides the said two acres
  IN CONSIDERATION WHEREOF, the said party of the second part, for himself his heirs, executors and administrators, covenants and agrees with the said party of the first part , his heirs, executors, administrators and assigns, by these presents First,, That he the said party of the second part, will pay, or cause to be paid, to the said party of the first part, his heirs, executors, administrators or assigns, the sum of four hundred and fifty dollars in manner following, that is to say, two hundred and twenty dollars this day, and the residue in one year from this day.
  together with the lawful interest of New York on the whole principal sum, to be computed from the day of the date and paid according to the conditions of his certain bond to the said party of the first part, bearing even date with these presents. And Secondly, That the said party of the second part, his heirs and assigns, shall and will build a good and sufficient dwelling house on the premises aforesaid, and make a settlement thereon, and clear two acres, within fifty months of the date hereof: and that he will pay all taxes hereafter to be levied on said Land. And it is the express and understanding of the contracting parties to these presents, that if the said party of the second part shall fail in the performance of any or either of the covenants on his part to be performed by these articles, then, and in such case, the said party of the first part shall be, and he is discharged and acquitted from making, or causing to be made, the conveyance aforesaid.
  IN WINESS WHEREOF, the parties of these presents have hereunto interchangeably set their hands and seals, the day and year above written.
