That the said Mrs. Etta Anderson is a person of unsound mind, now ___ years of age, and whose legal residence is in Harris Co., Texas. II. That the said Mrs. Etta Anderson is a widow, her former husband M. A. Anderson now being deceased; that this Applicant, M. A. Anderson, Jr., is a son of the said Mrs. Etta Anderson and desires to be appointed as her Guardian; that this Applicant resides in Chambers Co., near Baytown, Texas, and that his address is Route #2, Baytown, Texas. III. Your Applicant would further show that the said Mrs. Etta Anderson was adjudged to be a person of unsound mind in Case No. 20462 in the County Court of Harris County, Texas, by a final judgment entered in said cause on the 15 day of June 1933, as shown by the Judgment of said Court of record in Volume__at Page___, of the minutes of said Court. That by said Judgement and pursuant thereto the said Mrs. Etta Anderson was confined to the Austin State Hospital, Austin, Texas, where she has been confined since said Judgment and where she is still at this time confined; She has never been declared to be a person of sound mind since the above mentioned Judgement. IV. Applicant would show that he is not disqualified to receive Letters of Guardianship and to act as the Guardian of the Estate of Mrs. Etta Anderson, for the reason that he is the natural son of said Mrs. Etta Anderson and that she is a widow and for the further reason that it would be for the best interest of said Mrs. Etta Anderson that a Guardian be appointed in that she has certain property hereinafter described, which property has been condemned by the State of Texas for highway purposes and it is necessary for a Guardian to be appointed in order to protect the interest of the said Mrs. Etta Anderson in and to said property and to further reason that a Guardianship is necessary in order to convey good title to said property to the State of Texas, the said property owned by her being: Lots 39, 40, and 41 in Block 7 in Busch Terrace, a subdivision out of the William Scott Upper League in Harris County, Texas, a plat of which is of record in Volume 9, pages 10 and 11 of the Map Records of Harris County, Texas; and being the same land described in the Deed from Humble Oil & Refining Company to M. A. Anderson dated October 13, 1948, and recorded in Volume 2001, page 319 of the Deed Records of Harris County, Texas. V. Applicant would further show that the said Mrs. Etta Anderson is now without a Guardian of her estate; that a Guardian should be appointed for her in order to control, preserve and take care of the property owned by the said Mrs. Etta Anderson, and that a Guardian should be appointed in order to protect her interest in said property. VI. Applicant would further show that this Court has venue over this proceedings for the reason that at the time the said Mrs. Etta Anderson was adjudged to be a person of unsound mind as herein above set out she was a legal resident and domiciled in Harris County, Texas, and that all of her property as above described is located in Harris County, Texas. D. 1963, came on to be considered the application of M. A. Anderson, Jr. to be appointed Guardian of the Estate of Mrs. Etta Anderson, and came the Applicant in person and by his attorney, and it appearing to the Court and the Court being satisfied after due hearing that Mrs. Etta Anderson was duly served with citation in accordance with law; that more than ten days have elapsed since the date of service and this date, and the Court being fully satisfied that all prerequisites of law have been duly Compiled with, and the Court having further determined and here now determining that the said Mrs. Etta Anderson is a person of unsound mind and is now without a Guardian of her Estate, and having determined that the said Mrs. Etta Anderson was duly declared to be a person of unsound mind in Cause No. 20462 by a final judgment duly entered in said cause on June 15, 1933, as shown by Judgement of said Court of record in volume___at page___of the Minutes of the County Court of Harris Co., Texas; and determining that said judgment has not been revoked, and in addition having determined that the said Mrs. Etta Anderson has never been judicially declared to be sane after the rendition of said judgment, but to the contrary having determined that the said Mrs. Etta Anderson is still a person of unsound mind and is still confined in the Austin State Hospital, Austin, Texas, where she has been confined since said Judgment and being of the further opinion and having so determined that this Court has venue and jurisdiction over these proceedings and of all persons whom the law requires that jurisdiction be had; and having further determined that it would be for the best interest of the said Mrs. Etta Anderson that a Guardian be appointed over her estate in order to manage, control, protect and preserve the same; it is therefore ordered that M. A. Anderson Jr., applicant, be and he is hereby appointed Guardian of the Estate of Mrs. Etta Anderson, a person of unsound mind, and that Letters of Guardianship issue to him on his giving bond in the sum of $10,000.00 dollars, which is the proper sum hereby ordered and fixed, in accordance with the requirements of law, and it is further ordered that said Guardian take the oath of office as required by law with twenty (20) days. Baytown Sun, Baytown, Texas, Aug. 25, 1987 Services for Etta Anderson, 90, of Austin are set for 10 a.m. Wednesday at Earthman Funeral Chapel with the Rev. Logan Garrett officiating. Mrs. Anderson died Monday at an Austin nursing home Survivors include a son, M. A. Anderson Jr. of Cove; a daughter Corine Duncan of Baytown; and a sister Violet Newberry of Baytown. Eleven grandchildren and 17 greatgrandchildren also survive. Burial will be at Memory Gardens. Pallbearers will be Lawson Anderson, Virgil Reynolds, Ernest Winfree Jr., Gene R. Fontaine, Curtis Newberry, and Norman Mascorro. Services are under the direction of Earthman Funeral Home.
