Note: John Zirkle's Estate: On 7 April 1863 Reuben Roof petitioned the Cass County Court for he and R. S. Walker to act as executors of John Zirkle's estate. He stated that John Zirkle died at his residence in Cass County, Illinois on or about 12 February 1863 and that he left a will naming Reuben Roof and R. S. Walker as executors. He also stated that John Zirkle's personal estate probably amounted to eight hundred dollars and that John Zirkle left seven children as heirs: 1. Charles T. Zirkle 2. George Zirkle 3. Zirkle listed her maiden name as Marie Jenkins.1 The death certificate of her daughter Susan Elliott listed her maiden name as Mary Jenkens.1,6,6 Marriage Record: The 1837 Botetourt County marriage bond of John Zirkle and Maria Whitesell stated: "Know all men by these presents THAT we John Zirkle and Saml. Jenkins are held and firmly bound unto D Cambell Governor of Virginia, in the sum of one hundred and fifty dollars, current money, and for the payment of which, well and truly to be made to the said Governor and his successors in office, we bind ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents. Sealed with our seals, and dated this 6th day of October 1837 The condition of the above obligation is such, That whereas a marriage is shortly to be had and solemnized, between the above bound John Zirkle and Mrs. Maria Whitesell of this County of the county of Botetourt If, therefore, there be no lawful cause of impediment to obstruct said marriage, then the above obligation to be void, otherwise to remain in full force and virtue. Bowyn Clk [signature] [signatures] John Zerkle Samuel Jenken_ [last letter in name covered by seal]."3 Research Note: Although the marriage bond of John Zerkel and "Mrs. Maria Whitesell" did not identify Maria Whitesell's maiden name, the death certificate of her son, James K. Zirkle, listed her maiden name as Maria Jenkins. The relationship of Mrs. Maria (Jenkins) Whitesell to Samuel Jenkins, who co-signed the marriage bond of John Zerkel and Mrs. Maria (Jenkins) Whitesell, is unknown.1 Census: The 1850 United States census listed John and Maria "Circle" [Zirkle] in Cass County, Illinois, next to the families of John Circle's daughter, Nancy Roof, and John Circle's son, William Circle. Elmira Circle, age 1, birthplace Illinois.2 Death Record*: Maria's exact death date is unknown, but she died sometime after 30 January 1855, when her daughter Susan was born in Cass County, Illinois,6, and probably before 25 December 1855, when her husband John sold land. On 25 December 1855, for the sum of $800, John Zirkle of Cass County, Illinois sold a parcel of land in Ashland Township, Cass County to Richard S. Walker of Morgan County, Illinois. The deed described the land as the southwest quarter of the northeast quarter of section 25, township 17 north, range 9 west.5 This deed only listed John Zirkle as the seller and it did not list his wife Maria, and this suggests that Maria was deceased by this date. Although, Maria's death place is unknown, it was possibly Cass County. However, she could have died outside of Cass County. Event*: Maria's husband died about eight years after she died, because on 7 April 1863 Reuben Roof petitioned the Cass County Court for he and R. S. Walker to serve as executors of John Zirkle's estate. He stated that John Zirkle died at his residence in Cass County, Illinois on or about 12 February 1863, and he left a will naming Reuben Roof and R. S. Walker as executors. He also stated that John Zirkle's personal estate probably amounted to eight hundred dollars and that John Zirkle left seven children as heirs: 1. Charles T. Zirkle 2. George Zirkle 3. He also had five children alive from his first marriage, but Reuben Roof did not list them as heirs.].7 Event: On 7 April 1863 John Zirkle's will, dated 5 February 1863, was proven in Cass County, Illinois: "I John Zirkle being in my right mind this the 5th day of February 1863 willith that my body and soul I return to the God who gave it; I desire that my property real and personal shall remain in the same situation as I leave it for the next eight years at the expiration of eight years It may either be sold or divided amongst my legal heirs each receiving and equal part with the exception of Nancy Roof & Ann Zirkle whom I desire shall have fifty dollars apiece more than the rest in consideration of their kindness to me whether it shall be divided or sold as above named I leave to Reuben Roof whom I do hereby appoint my administrator to do what he thinks best at the expiration of the eight years I further more desire that Ann & Marial Ellen & Susan Christy Zirkle each shall have one bed in addition to what has been named. I also desire that R S Walker shall be apociated with Reuben Roof as my adminitrator in the settlement of my estate as above sett forth In Testamony whereof I have hereunto sett my hand & seal this the fifth day of February eighteen hundred and sixty three John (his X mark) Zirkle Witness Asahel Douglass Elijah D(ul?)ing State of Illinois County of Cass I, Asahel Douglass, one of the attending witnesses to the above and foregoing will, do solemnly swear that I and Elijah Duling the other attennding witness were present when, the Testator John Zirkle signed said instrument; that he signed the same by making his mark; that he declared said instrument to be his last will and testament; that we signed the same in his presence, in the presence of each other, and at the request of said Testater, as attesting witnesses thereto; and I firmly believe said Zirkle to have been of sound and disposing mind and memory at the time of making and signing said will so help me God Asahel Douglas Sworn and Subscribed before me March 13 1863 Allen Hill, Clerk."8 Event: On 12 June 1918 James K. Zirkle died in Chenoa City, McLean County, Illinois. His death certificate indicated that he was born on 23 March 1846 in Virginia. Also, it listed his father's name as John K. Zirkle, birthplace unknown, and his mother's maiden name as Marie Jenkins, birthplace unknown. The informant was Mrs. Walter (Zirkle) Young of Chenoa, Illinois.1 Event: On 18 December 1927 Susan C. Elliott, widow of Thomas M. Elliott, died in Pontiac, Livingston County, Illinois. Her death certificate listed her father's name as John Zirkle, birthplace Virginia, and her mother's maiden name as Mary Jenkens, birthplace Virginia. The informant was Aldine B. Elliott of Chenoa, Illinois.6
