  3/10/1897 Wednesday The case of Dale Munson, guardian of John Diver, an incompetent person, vs Richard and Isabel Diver, is now on trial. 6/18/1897 Friday MUCH INTEREST Manifested in a Suit in Circuit Court IT INVOLVES A FINE POINT As to the Insanity of John Diver, of Deerfield The suit befoire a jury in circuit court now on trial, known as the case of John Diver, an inompetent person, vs Richard Diver and Isabel Diver, is creating considerable interest from people in the eastern portion of Lenawee, and some interest among the people of this city. The case comes from Deerfield. It seems that John Diver was sent to the insane asylum in 1875 by Judge Beeman, now deceased, and was released, being sent three or four times after that. In October 1895, on an application to Judge Robbins, and after a trial he was adjudged to be insane and mentally incompetent to have charge of his person and property. Dale Munson, of Deerfield, was appointed his guardian, and as such guardian commenced a suit in chancery to set aside a deed that John Diver had given to his son, Richard Diver, in April, 1895. The suit was brought on the ground that at the time the deed purports to have been executed John Diver was incompetent to give a valid instrument. Richard Diver and his wife have been made defendants by the action. They claim that at the time said deed was made the said John Diver was not incompetent. The question of his competency or incompetentcy at the time the deed was made is the one on which the trial rests. There are a cloud of witnesses, some of which is expert medical testimony. A long time will be consumed, as the case has been on since Monday, and one side has not yet finished. Salsbury & O'Mealey appear for the complainant and John Riley and Watts, Bean & Smith for defendants. The property involved is the front 40 acre farm John Diver owned on section 35, township of Deerfield. The litigation is necessarily elongated, and in good hands, so that the case can hardly be expected to pan out as did Deputy Sheriff Joe Bragg, in E.J.'s ownwords runs as follows; Deputy Sheriff Joe Bragg, of Deerfield, traded horses a short time ago, and according to Joe's subsequent judgement, his hind-sight proved more acute than his fore-sight, and there followed seizure, replovin, a lawsuit and the usual accompaniment of witnesses, lawyers and fees. "Well Joe, how did it come out?" asked a friend, who caught sight of the officer returning from the scene of the trial looking somewhat horse de combat. "oh h--l answered Joe, "the lawyers got both horses". 6/25/1897 HE WAS INSANE Says the Jury in the John Diver Case In the circuit court the famous case of Diver vs Diver, from Deerfield, came to an end at midnight last night, by the jury bringing in a verdict that he parent John Diver, was insane at the time in question. The jury declared that the power of attorney given by him to his son, Richard Diver on Feb. 20, 1895, and the deed to the front 40 acres of his 80 acre farm in Deerfield, on April 30th of this same year, was not a sane act on his part, and that the power of attorney and deed are void and without effect. The case now goes back to the chancery side of the court, for Judge Lane to act upon, setting aside the power of attorney and the deed, if he sees so proper. The jury was aked for by the Judge to determine the sanity or insanity of Mr Diver, at the time of executing these two instruments. The case same form Dale Munson, as guardian for Mr Diver, and is a victory for him. Salsbury & O'Mealey for complainant, and Watts, Bean & Smith for defense, The case occupied nine days in court before the jury. It was argued at length by the attorneys for four hours Thursday afternoon, and the jury was out from 4:30 pm until midnight. The trial was one of the most hotly contested the court has heard this term; 76 witnesses were examined.
  11/22/1897 Monday The heirs in the estate of John Diver, of Deerfield, which case caused such a sensation in court here some time ago, have reached an amicable settlement. The will held by Richard was laid aside and after some little difficulty the judge seleted an administrator in the person of J.W.Helme Jr. 2/8/1898 Dale Munson, of Deerfield, presented his account to Judge Robbins, in the probate court today, as guardian for John Diver, whose case, will be remembered by our readers, and it was allowed without opposition
