Note: 1859 INDENTURED DEED: An 1859 indenture deed found in book I, p. 334 Muscogee Co., GA., noted that Thomas and Mary Summersgill, William R. and Jane Martin, John B. and Nancy Thomas, Thomas and William McCollister, Charles W. Hewson, J. J. Davis and Andrew McCollister agreed to sell their mother's, Sarah Bailey McCollister, portion of her father's, Robert S. Bailey, estate located in Carroll Co., GA. Note, this land was sold to a John Dale of Carroll Co., GA in 1859. John Dale married one of Robert S. and Elizabeth (Betsy) Copeland Bailey's daughters, Jane Bailey. (See full transcript below) NOTE: Each of Sarah and Robert's children or their spouse signed the Indentured Deed with the exception of daughters Syrena Emaline and Catherine. The fact that Catherine was a minor in 1859 probably explains why she did not sigh. No information has come to light why Syrena or her husband ,Edley Davis, did not sign or receive their money share. NOTE: Information in this document confirms that Robert McAlister (McCollister) wife's surname was Bailey and her father's name was Robert S. Bailey. _______________________________________________________________ The following is a full transcription of an indentured deed the children of Sarah Bailey McCollister executed in 1859 in Muscogee Co. Ga. The transcription was made from a copy of the original document by Lanny Gamble, a gg-grandson of Sarah Bailey McCollister. The original document is in Indentured Deed Book I, Page 334, Muscogee Co. Ga. Also, a copy is on file in Carroll County Georgia Courthouse Records. Georgia(This Indenture made the seventh of March 1859. Muskogee County(Between Thomas and Mary Summersgill, William R. and Jane Martin, John B. and Nancy Thomas, Thomas and William McCollister, Charles W. Hewson, J. J. Davis, Andrew McCollister of the first part and John Dale of Carroll County of the Second part witnesseth that the said parties of the first part for and in consideration of the sum of thirty dollars each to them in hand paid hath bargained and sells and by these present doth grant and convey to the said party of the Second part his heirs and assigns for ever their interest in their mother Sarah McCollisters (sic) portion of her fathers (sic) estate which was willed to her by her father Robert S. John Long, Clk (L.S.) ____________________________________________________________________ NOTES ON DEATH DATE OF SARAH BAILEY: Sarah Bailey's death date is based on two pieces of information. First, the information found in Guardianship papers executed prior to 1860 in Carroll County, GA. (Inferior Court Minutes, Book AA, P. 202). In those papers Andrew J. McCollister of Carroll County, Ga is awarded guardianship of his sister, Catherine McCollister. Catherine is the youngest child of Robert and Sarah McCollister, Andrew J.'s parents. The guardianship papers notes that "Catherine, a minor child of Robert McCollister, deceased." Second, the Indentured Deed executed November, 1859 in Columbus by Sarah's children and/or spouses would indicate that Sarah had died prior to that 1859 date. COMMENTARY ON THE DEATH DATES OF SARAH AND ROBERT MCCOLLISTER: The assumption is that Sarah probably died before Robert and Catherine became an orphan when Robert presumably drowned in December of 1857. Also, the Indentured Deed executed in 1859 by the children of Sarah and Robert McCollister was signed by their children or their spouses and not by Sarah or Robert, indicating that both were dead prior to November of 1859.
