  Land sold except tract where David Gordon lives called the Jarrett tract and other tract where James Jarret lives called the Old McDaniel tract that I bought from Wm. M. McKee. The Jarret tract I will to heirs that now is and that will come from the body of my daughter Jane M. Gordon, contains 230 acres. Jane M. is to live on the land her lifetime. McDaniel tract to son-in-law James Martin. To my wife Olive 1/3 of estate. Balance of equal share coming to James Martin beside the land be given to his heirs, all heirs that come from my daughter Mary Ann Martin's body, and that money be put in interest and paid to heirs as they become 21. Andrew Todd's son, my grandson, Robert Todd, is not 21. Grandson Robert C. Presley, the son of David and Elizabeth Presley, is under 21. Grandson Robert Gordon, son of David and Jane M. Gordon, is under 21. Grandson Robert Todd Branyan, son of Henry and Margaret Branyan, is under 21. Brother John Todd that is in Ireland or on his way from there to the United States I give $400.00 when he arrives. Sons Andrew and John Todd and son-in-law Henry Branyan and David Presley. Executor: Son Andrew Todd. Dated 13 June 1844. Wit.:James Herron Geo. W. Long John McPhail Nathan McAlister Proven 26 July, 1844 ----------------------------------------------- His will dated July 26, 1844 is also in the last referenced book and lists his wife and children and reads:
  TODD, ROBERT No Ref. Probate Judge Office. Anderson, S. C. Anderson Dist. I Robert Todd Senr. being feeble health but of sound and disposing mind. First after my decease, my will is that my funeral expenses and just debts be paid. I will that the whole of my estate both real and personal be sold except two tracts of land, viz, one tract that David Gordon lives on, called the Jarrett tract. The other where James Jarrett now lives, called the old McDaniel tract that I bought from John M. McKee, a feather bed and furniture. The personal property be sold on credit of one year. The real estate. and negroes be sold on one half twelve months credit and the other two years [sic]. I will the tract of land called the Jarrett tract. to the heirs of the body of Jane M. Gordon, containing 230 acres, and that Jane M. Gordon live on said during her natural life. I will to my son in law James Martin the tract called the old McDaniel tract, containing 128 acres. It shall be his part of my estate. I will to my wife one feather bed and furniture arid the third of my estate. I will besides the land to the heirs of my dtr. Mary Ann Martin body, that the money be put on interest, until said heirs become the age of twenty one. I will that Andrew Todd son my grandson Robert Todd $100 after my wife gets her share put on interest until he is twenty one yrs. I will to my grandson Robert Gordon son of David and Jane M. Gordon $100 to be put on interest until he is twenty one yrs. I will to my grandson Robert (Todd) Branyan son of Henry and Margaret Branyan $100 to be put on interest until he is twenty one yrs. I will to my brother John Todd that is in Ireland or on his way from there $400 when he arrives. If he never arrives, said money to be divided among my heirs and legatees. The balance after the four hundred dollars to my grandsons and the third to my wife, to be divided equally among my son Andrew Todd, John Todd and Henry Branyan my son in law and David A. Pressly my son in law. I appoint my son Andrew Todd my executor. Dated this 13 June 1844. Wit: James Herron, Nathan McAlister, George W. Long, John McPhail. Signed: Robert Todd. Proved on oath of John McPhail, before W. Magee O.A.D. this 26 July 1844. By the year 1856 the legacy given to John Todd of Ireland was divided among the heirs. The petition of Robert Todd, lately called and known by the name of 'Irish Robert." A native of the County Antrim in Kingdom of Ireland. Your petitioner has resided within the jurisdiction of the U.S. since 23 April 1802 and has resided for the last ten years and upward in this State, and has behaved himself as a man of good moral character, etc. and is desirous of becoming a citizen of the U.S. Your petitioner is about 29 yrs. old. Dated 26 Oct. 1813. We the subscribed citizens and freeholders do hereby certify that we have been personally acquainted with Robert Todd from early in the year 1802 etc. Signed: Nathan McAlister, Capt. T.
