Note: Edward Bass, the second of the two sons of Richard Bass, is supposed to have been born in 1762. However, this requires him to have his first child at age 13, which is hardly likely. Probably 1754 isa better estimate of his birth date. He married Sarah Stevens and had seven children, five sons and two daughters. After his early death, in 1802, a will was filed in which everything went to the sons. The daughters and their husbands sued, but I don't know the outcome. He advanced Richard also by deed, 94 (56 written above) acres - Richard died in 1807 leaving three children viz Elizabeth wife of Tho Boyt of Tenn, Sarah wife of Wm Jacobs of Tenn and Edward of Tenn. Edward was under age and Elisha Boyt who married the widow of his father --- not readable, maybe the executor ? John sold his share to Sarah Bass his mother and died in Alabama 6 or 7 years ago having Uriah Bass - Polly - Betsy, Sally - Ann - Keziah and Richard (sic) all minors - in Alabama Andrew Bass lives in Johnston and sold his shares to W. Hall Wm. Bass lives in Wayne and has not disposed of his share Mary wife of Britton Hood of Wayne Keziah wife of John Cox of Wayne Sarah Bass widow of Edward died Jany 1826 having the same heirs In her lifetime, besides the tract bought of John, the title which has failed - she bought a tract of John McKinnie, one of Richard Bass her son - and two other tracts for which she paid the money and the deed was taken to her son William - which is taken ??? by other heirs to be an advancement The lands of Edw. Stanton and conveyed to her son William The entitle Britton Hood & Al petition for partition of lands of Edward Bass and Sarah Bass END OF DOCUMENT _______________ State of N. Carolina Wayne County To the Worshipful the Justices of the court Pleas and Quarter Sessions of Wayne County The partition of Britton Hood and Mary his wife and John Cox and Keziah his wife all of Wayne County humbly showeth that Edward Bass late of Wayne County died in the month of ....... in the year one thousand eight hundred and two. Soon after his decease (to wit) at November sessions of Wayne County Court 1802, a paper writing purporting to be the last Will of said Edward Bass was produced and submitted to probate on the oaths of John Brogdon and John Bass who were the subscribing witnesses thereto and Richard Bass one of the executors namded therein qualified as executor thereto. By the said Will the said Edward Bass left devised all his lands to his sons , John Bass, Andrew Bass, William Bass, Uriah Bass. Besides the said devisees the said Edward Bass left surviving him other children Viz. Richard Bassand Petitioners Mary and Keziah who with the said devisees were his heirs at law. To Sarah Bass the wife of the said Edward, the said Will gave an estate for life in certain lands. Your petitioners Mary, was the wife of Britain Hood at the decease of her father the said Edward Bass and your petitioners Kezziah Bass has since intermarried with John Cox. Both of your Petitioners , Mary and Kiziah were infants under the age of twenty one at the death of their father and at their intermarriages. Your Petitioners charge that they had no notice of the probate of the said will, nor were they particularly informed of its contents until long after it's probate. The said widow Sarah Bass, having recently died and inquiry arising on that event as to the disposition of the land occupied by her duringher life, your Petitioners have with- in six months past discovered that the will of the said Edward Bass was not executed with the solementies required by law to pass an interest in lands in as muchas John Bass one of the subscribing witnesses and by whose oath the said will was proved, was one of the devisees in the said Will and not a competent witness to prove the same, and the said Will wasnot in the hand writing of the said Edward Bass, nor was it alleged or proved to be in his handwriting. So that the said Will was insufficient to pass the title to the lands of the said Edward Bass and should have been proved as a Will of Personal Property only. Your petitioners charge that your partitioners Mary and Keziah being infants and under coverture at the probate of the said Will, ignorant of their rights and unable to assent and protect them, and do continue to the present time, one not bound by the said Probate.That they cannot be disinherited by a proceeding to which they were notparties and of which they had no written notice. To the end therefore that opportunity may be afforded them of defending their rights and contesting the inefficiency of said Will to pass the lands ofthe said Edward Bass . Your petitioners pray that the Probate of the said Will of Edward Bass as a Will of Lands may be revoked and set aside, that those claiming land under the said Will may if theythink proper, exhibit it again for Probate as a Will of Lands. Your petitioners further shew unto your Worship that Richard Bass has died leaving issue--Elizabeth the wife of Thomas Boyte and Sally the wife of William Jacobs and Edward Bass all of whom reside inTennessee and do not join in this petition. The said John Bass has also died leaving issue Uriah, Mary, Betsy, Anna, Keziah and Richard Bass all of whom are infants and reside in Alabama. Andrew Bass resides in Johnson County, William Bass resides in Wayne County, Uriah Bass and Richard Bass the executor in the Will has also died. Your petitioners pray that the said Thomas Boyte and Elizabeth his wife, William Jacobs and Sally his wife and Edward Bass heirs at law of Richard Bass , and Uriah Bass, Mary Bass and Betsy Bass, AnnaBass and Keziah Bass and Richard Bass heirs at law of John Bass and also the said Andrew Bass and William Bass may be made defendants to this Petition and may be cited to appear and before your worship and show cause if any they have, wherefore the probate of the said Will of Edward Bass should not be revived and set aside so far as it may affect the title to the real estate of said Edward Bass be annulled.
