Dillehay, September 26, 1827, Smith Co., TN Transcribed By Terri and Caleb Dillehay and posted on web at http://www.rootsweb.com/~tnsmith/wills/dillehay_edmond_will.htm In the name of God, Amen, I Edmond Dillehay of the county of Smith and state of Tennessee being weak in body but of sound and perfect mind and memory, blessed be almighty God for the same, Do make and publish this my last will and testament in mannor and form following (that is to say) in the first place I will and order that all my just debts be paid. Secondly I give and bequeath unto my dear beloved wife Joanah Dillehay all my lands and possession of land in the county of Smith and on the waters of Defeated Creek. Where on I now live and hold possession of and I also give unto her one black girl named Milly, and her increases, also one black boy named Peter. I give unto her two bay mares and one gray colt also three cows and their calves and two choys (choice) heifers also the ten first choys of (choice) hoggs, one white sow and five piggs and also the crop on hand concisting of cotton, corn and potatoes and flax and oats and also all the house hold and kitchen furniture also one (doqerin?) plow one (borshin?) hoe three pare of geers , four pole axes and one small broad ax and also all the shovel plow hoes and all the weeding and hilling hoes and also all the iron on hand. Also two hand saws all the augurs, one gouge and three chisels also one loom harnis all the slays and one flax hackle and also all the teethers on hand and also all the shoemaker tools and also all the fowls and also all the saddles and bridles also one pare of Stealyons (stallions) and also all the bee stands and reaphooks all to be and remain hers during her natural life (or remaining my widow on marrying). And at her death I will and order that the above named property be equally divided between my sons and daughters (to wit) Levy G. Dillehay, Johnson Dillehay, Thomas R. Dillehay, Barnet T. Dillehay, Edmon J. Dillehay, Charles A. Dillehay, Elexander Dillehay, Betsey* J. Dillehay Gregory, Agnes A. Carter, Sally Hill Knight, Patsey* P. Smith, Joanah E. McKnight, Mary R. Dillehay and that my will purpose and intention of willing and giving the above named property to my beloved wife Joanah Dillehay is for her comfortable maintaince and the maintaince of my children who is now under age and not to be disposed of in any other way whatever .The horse and seven dollars in cash that I have heartofore given unto my oldest son Levy Dillehay I now give to him as his full share and portion of my estate until the marriage or death of my wife Joanah Dillehay also the bed and furniture that I have heartofore given unto my oldest daughter Betsey* J. Gregory I now give unto her as her full share and portion of my estate until the marriage or death of my wife Joanah Dillehay and I also will and wish that the bed and furniture that I have heretofore given unto my daughter Agnes A. Carter shall be her full share and portion of my estate until the marriage or death of my wife Joanah Dillehay. I also will and wish that the bed and furniture that I have given unto my daughter Sally H. Knight shall be her full portion and share of my estate until the marriage or death of my wife Joanah Dillehay. I also will and wish that the bed and furniture that I have heretofore given unto my daughter Patsey* R. Dillehay Smith shall be her full share and portion of my estate until the death or marriage of my wife Joanah Dillehay. I also will and wish that the bed and furniture that I have heretofore given unto my daughter Joanah E. McKnight shall be her full share and portion of my estate until the death or marriage of my wife Joanah Dillehay. It is also my will and wish that my six youngest sons Johnson Dillehay, Thomas R. Dillehay, Barnet T. Dillehay, Edmond J. Dillehay, Charles A. Dillehay, Elexander Dillehay have twenty dollars each of them and that each ones twenty dollars be paid to him at the day of his marriage or at the time he arrives of age of twenty one years and I also give and bequeath unto my youngest daughter Mary R. Dillehay the sum of twenty dollars to be paid to her at the time she marrys or arrives to the age of twenty one years and I also will and wish that the several sums of money which I will and give to my six youngest sons and youngest daughter to be paid out of the money on hand and that is now due me and out of what may become due and from misc sales of the property which I have not named in my will but that I have left out and intend for that purpose and that the afforsaid sums of twenty dollars shall be there full portion and shares of my estate until the death or marriage of my wife Joanah Dillehay. I will and order that after the several sums of twenty dollars in money is paid to my seven youngest sons and daughter to wit Johnson Dillehay, Thomas R. Dillehay, Barnet T. Dillehay, Edmond J. Dillehay, Charles A. Dillehay, Elexander Dillehay, and that and Mary R. Dillehay the full balance of the money arrising from the sails of property notes and other accounts be and remain in the hands of my wife Joanah Dillehay as other property until her marriage or death.
