Note: Some people's genealogies has that John Mayes who died in Mecklenburg county Virginia was born 1719 but I think that it is most likely that our John Mayes was his son and born about 1740. With the births of John's kids in the 1760s and 1770s he being born in 1740 is more likely. There is no connetion between John Mayes and any parents. I have connected him to John Mayes to keep track of the Mayes family. I John Mayes of the County of Mecklenburg and Parish of saint James's and State of Virginia being sick and weak in body but of a sound disposing mind and Memory thanks be to God for the same and knowing the uncertainty of this life do make and declare this to be my last Will and Testament in the form and manner following to wit: I commit my Body to the Earth and my Soul to the hands of my Creator to be Intered as my Executors hereafter mentioned shall think Proper. First my desire is that all my Just debts be paid as my Executors shall think best to Raise The money Itim I lend my beloved wife Elizabeth Mayes the land and Plantation whereon I now live during her natural life or widowhood and after that I leave it to be sold and the money to be Equally divided between John G. Mayes, Thomas H. Mayes and Charles Mays to them and their heirs forever. I lend to my beloved wife one negroe man named French for the term of six years and at the expiration of that time I give him the said Negroe to John G. Mayes and his heirs forever. Itim I lend to my beloved wife one Negroe girl named Rose untill my daughter Dolley comes of age or marries and then I give the said Rose and her Increase to my daughter but if the said Dolley dies before the Expiration of that time my desire is that the said negroe and her Increase if any be equally divided between Thomas H. Mayes, Salley Mayes and Charles Mayes or their Heirs. Itim I lend to my beloved wife Elizabeth Mayes three Negroes Esbel, young Rachel and Gilbert untill Thomas H. Mayes arrives to the age of twenty-one years and then my Desire is that the above mentioned be Equally divided between Thomas H. Mayes, Salley Mayes and Charles Mayes to them and their heirs forever. Itim I give to my Son Bozeman Mayes one negro man named Tom who has been in the possession of the said Bozeman for a term of years and one desk I give them to him and his heirs forever. Itim I give and bequeth to my Son Stith Mayes one negroe boy named Emanuel and one cow and calf to him and his Heirs forever. Itim I give and bequath to my daughter Nancy Taney two Negroes namely old Rachel and Oney to her and her heirs forever. Itim I give and bequath to my Daughter Mary Carter two negroes namely Sarah and Rhoda to her and her heirs forever. Itim I lend to my daughter Elizabeth Hall two negroes namely Edie and Vacney during her natural life and after her death I give the said negroes and their Increase to her Children Lawfully begotten of her body and to their Heirs forever. Itim I lend to my beloved wife Elizabeth Mayes two Negroes namely Judie and Dinah and their Increase with all the remaining Part of my Estate as it not yet disposed of whither real or Personal during her natural life and after her death I leave it to be sold and the Money to be Equally divided between John G. Itim I constitute and appoint Zachariah Yancey and Charles Hamblin Executors to this my last will and Testament hereby revoking and disannulling all and every other Will or Wills heretofore by me made and Confirm this to be my last Will and Testament. Witnesseth that the said Rachel Carter for an in consideration ofthe sum of three hundred and seventy pounds current money of Virginia to herin hand paid the receipt whereof she doth hereby acknowledge and thereofdoth acquit and discharge the said John Mayes his executors and administratorshath bargained sold and confirmed and by these presents do bargain sell andconfirm to the said John Mayes his heirs and assigns forever all that tract orparcel of land containing three hundred and seventy acres more or less lying and being in the County of Mecklenburg and which she the said Rachelpurchased of Robert Hutchins as will appear by deed from him bearing date thetwentieth of February one thousand seven hundred and seventy three and bounded asfolloweth (Viz.) Beginning at Stiths corner pointers on the river thence on hisline south thirty degrees west twenty poles to pointers thence north eightydegrees west one hundred and sixty poles crossing a branch to a white oak newlines south thirty degrees west two hundred poles crossing a branch to a pinethence south eighty degrees east four hundred poles crossing a small branch onAron's creek to pointers in Aaron Pinson's line thence on his line north twenty degrees west one hundred and twenty four poles crossing the said creek toa red oak thence north twenty five degrees east eighteen poles to a hickoryon the river thence up the same as it meanders to the beginning with allhouses woods ways waters and water courses profitable commodities(?)hereditaments and appurtenances to the same belonging on the reversion and reversionsrents and issues thereof to have and to hold the said land with all and(?)every the appurtenances unto him the said John Mayes his heirs and assigns to theonly proper use and behoof of him the said John Mayes his heirs and assignsforever and the said Rachel Carter for herself and her heirs doth covenant andagree to and with the said John Mayes and his heirs or assigns that she thesaid Rachel Carter hath right to sell and convey the said three hundred andseventy acres of land as above and that the same is free of all encumbranceswhatever also that the said John Mayes his heirs and assigns shall and may havehold and enjoy the said land with the appurtenances without the lawful (?)sale molestation or hindrance of any person whatsoever and lastly that she thesaid Rachel Carter for herself and her heirs doth hereby covenant and agree to warrant and forever defend the title of the said land to h him the saidJohn Mayes his heirs and assigns forever against the title claim and demand ofall manner of persons whatsoever and will make and execute any furtherconveyance when required for the better securing the same to the said John Mayes his heirs or assigns.
