His property was sold at auction and a final settlement was filed on 4 November 1874. (Estate file #8897, Northampton County Government Center, Easton, PA) On 25 October 1873 Jacob's widow, Catharine Morey, and her children "heirs of Jacob Morey late of Upper Mount Bethel Twp. deceased" filed a petition in Northampton orphans court requesting court approval of the appointment of seven men to partition Jacob's real estate. The petition stated that Jacob died intestate leaving a widow and seven children; Charles Morey, Peter Morey, Jonas Kintner and Eliza his wife, Henry Kressler and Caroline his wife, John Datesman and Sally Ann his wife, Philip Datesman and Elizabeth his wife, and William Morey, all residing in Upper Mount Bethel except Jonas Kintner and Eliza his wife, who reside at Spring Grove, Surrey Co., VA. Frutchey, Samuel Shaw, Charles Morey, Judy Nelson, Catharine Morey, Jacob Kunsman, and Jeremiah Pipher. The land was also adjacent to Jacobs Creek and the public road from Portland to Roxburg. It was the same premises which Jacob Morey Sr. and his wife Elizabeth sold to Jacob Jr. by indenture dated 14 July 1840 and recorded in Deed book G., vol. 8, p. 580. Widow Catharine was entitled to 1/3 of the land under current law and each surviving child was entitled to 1/7 of the remaining 2/3. The court approved the appointment of seven men to partition or evaluate the land. (Orphans court book 26, p. 90, Northampton County Government Center, Easton, PA) On 21 November 1873 the seven men reported to the court that the land could not be partitioned and they valued the tract at $61 per acre. The heirs declined to buy the tract at the value set and requested court approval to advertise and sell the land. The court approved the sale. (Orphans court book 26, pg. 104 with detailed plot map on pg. 105, Northampton County Government Center, Easton, PA) On 23 January 1874 the court was advised that the tract was advertised for sale in the "Easton Argus" and "Correspondent & Democrat" English and German newspapers and that the land was sold to John A. Oyer of Upper Mount Bethel Twp. for $50.35 per acre. The court confirmed the sale. (Orphans court book 26, pg. 171, Northampton County Government Center, Easton, PA) (Other sources: 1.
