Notes
a. Note:   In the book Diehl Descendants 1689-1998 by Peggy Dale Chapman (2000), on pages 59 and 60, she lists a deed of sale in 1789 from George Deal to William Frizzell in what appears to be Lincoln County. It is proved by a Peter Justice. This Peter Justice must be Peter Justice, Sr. William Frizzell was most likely Capt. Frizzell who served in the Revolutionary War and had came from Rowan County, NC. His daughter Elizabeth married James Maloney Sr. sometime around 1793. It should be noted that Abraham Justice`s sister Mary Polly Justice married James Maloney, Jr. in October 1823.
In Diehl Descendants 1689-1998 by Peggy Dale Chapman (2000), we see where Abraham Justice, Peter Justice, Jr., Stephen Justice, James Maloney (probably Jr.), Stephen Ross (cousin of James Maloney) were some of the purchasers in the estate sale of William McGimsey in November 1831, Burke County, NC. Peter Justice, Jr. and Stephen Justice may have been his other sons. There is a Stephen Justice buried at Pleasant Hill Baptist Church Cemetery in Enola. The writing on his stone is almost gone. However, it reflects 1805-1888. This would conflict the census records. Moses Justice is another possibly for a son, as he was married in Lincoln County in 1814.
Issac Robinson. 31 January 1808, April 1808. Wife Catherine. WIT. Peter Justice, Thos. Watherspoon, Abraham Justice.
(See "Lincoln County North Carolina Will Abstracts 1779-1910", Compiled by Miles S. Philbeck, Jr. and Grace Turner, 1986. This Peter Justice is most likely Peter Justice, Sr.
Peter migrates to Burke County from Lincoln County sometime between 1810 and 1820. Is living in the same area as Isaac Justice and some of the Joseph Morgan, Jr. descendants. Perhaps this Isaac was a brother.
On the 1820 Burke Census, Peter is living 19 households from William McEntire. Abraham Justice's son A. P. was Overseer there in 1850. Benjamin Ross was nearby. Ross had married one of Capt. Frizzell's daughters.
