Mott. Upon information and belief that Ann L. Mott, a daughter of said testator, Thomas Leggett, deceased, died on or about the 25th day of September, 1854, intestate and was survived by her husband, Samuel F. Mott, who died June 7th, 1859, and by the following children, who were her only next of kin and heirs at law: Margaret L. Hoffman, a daughter, who died March 11th, 1888, and Louisa M. Graham, a daughter, who died May 1st, 1888. That said Margaret L. Hoffman left a last will and testament dated November 20th, 1875, where she devised all her residuary estate to her husband, Lindley M. Hoffman, by the following provision contained in said will: "Secondly: I do give and devise all the rest and residue of my estate and property real and personal of every kind and description with sole exception of my jewelry and silverware as hereinafter provided and mentioned to my beloved husband, Lindley M. Hoffman, his heirs and assigns, to have and hold the same forever." That said will was duly admitted to probate in the Surrogate's Court of the County of New York on September 29th, 1891. That said Louisa M. Graham left a last will and testament dated October 5th, 1870, wherein she devised all her residuary estate to her husband Clinton Graham by the following provision of said will: "Third: Whereas my children are amply provided for and to testify my love and affection for my husband Clinton Graham, I give devise and bequeath to my said husband all the rest and residue of my property both real and personal which I now have or may hereafter become possessed of, with the power to sell and dispose of the same both real and personal for his sole use and benefit, and I hereby constitute and appoint my said husband my sole executor of this my last will and testament." That said will was duly admitted to probate by the Surrogate of Queens County on October 12th, 1888. That Margaret L. Hoffman was survived by her husband, Lindley M. Hoffman, who thereafter died April 19th, 1897, intestate, and was survived by three children, to wit: Martin Hoffman, who is unmarried, and who resides at Whitestone, Long Island, New York; Emily Hoffman Leakin, who resides at Number 15 Prospect Street, Hartford, Connecticut; and Virginia H. Garrard, who resides at Frontenac, Goodhue County, Minnesota. That the said Louisa M. Graham was survived by her husband Clinton Graham, and by her four children, as follows: Franklin Mott Ring, unmarried, who resides at Number 46 Arlington Avenue, East Orange, New Jersey; Henry Ring; Maria Louisa MacDougall, and John J. Ring; and the said Clinton Graham died January 11th, 1893, a widower, leaving a last will and testament which was duly admitted to probate in the Surrogate's Court, Queens County, New York on the 28th day of April, 1893 and is recorded in Liber 49 of Wills, page 352, and contained the following provision affecting the said property: "Third: I give all the residue of my property real and personal whatsoever and wheresoever to my Executors hereinafter named to hold and invest the same and to pay over the income thereof semi-annually or oftener in their discretion to my daughter Maria Louisa Macdougall wife of Geo. D. Macdougall during her life and upon her death to pay over the same to my stepson Franklin Mott Ring or in the event of his death before hers to his children him surviving and to the issue of any who may have predeceased him and her, such issue to take their parent's share, and in case he shall have no issue him and her so surviving, then and in such event to Donald Graham and Mabel Graham, children of my brother, Augustus C. Graham, in equal shares, or in case of the death of both or either before my said daughter to their issue per stirpes. That said Clinton Graham was survived by his daughter Maria Louisa Macdougall and by said Franklin Mott Ring, his stepson. That said Maria Louisa Macdougall has since departed this life.
