I APPOINT FREDERICK JAMES ALEXANDER of Forge End House, The Street, Compton, Guildford, Surrey and JOHN MICHAEL PATON WALSH of Lloyds Bank Chambers, Esher, Surrey, Solicitor to be the Executors and Trustees of this my Will and they or the survivors of them or others the Trustees for the time being hereof are hereinafter called "my Trustees" 2. MY TRUSTEES shall hold the net proceeds of such sale and conversion and my ready money upon the following trusts:- (a) Upon Trust to pay thereout all my funeral and testamentary expenses and debts (b) Upon Trust to stand possessed of such investments and all parts of my estate for the time being unsold (hereinafter called "my residuary estate") (c) Upon Trust as to both capital and income of my residuary estate for such of them my nephews and nieces as shall survive me and if more than one in equal shares between them absolutely PROVIDED THAT if any of my said nephews and nieces shall die in my lifetime leaving any child or children who shall survive me and attain the age of Eighteen years such child or children shall take and if more than one equally between them the share which such nephew or niece so dying as aforesaid would have taken in my residuary estate had he or she survived me 4. TRUST MONEYS may be invested in the purchase of or at interest upon the security of such stock funds shares securities or other investments of whatsoever nature and wheresoever and whether involving liability or not as my Trustees shall think fit to the intent that my Trustees shall have the same full and unrestricted powers of investing and transposing investments in all respects as they were absolutely entitled thereto beneficially 5. I HEREBY DECLARE that all payments of the nature of income made or received at any time after my death shall be treated as income notwithstanding that any such payments may be in respect of a period partly or wholly prior to my death and that no such payment shall be required to be apportioned as between capital and income my intention being that apportionment under the Apportionment Act 1870 shall be wholly excluded in the administration of my estate 6 ANY trustee being a solicitor or other person engaged in a profession or business may act and be paid for all acts done and time expended in or about the business of the trust by himself or his firm including acts or business which might be done or transacted by the trustee personally and not requiring the employment of a solicitor or person engaged in such profession or business for the doing or transaction thereof though not of a professiona lcharacter IN WITNESS whereof I have hereunto set my hand to this my Will the day and year first above written Signed by the above-named TESTRATRIX LUCY BAKER as her last Will in the presence of us both being present at L Baker the same time who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses:- R.M.
