 Devers Man is Fatally Shot Sunday. 20 Gallon Keg of Liquor is Found in Slayer's Home.
 B.M. Ferguson was lodged in jail Sunday evening and charges with the murder of M.C. Holder who was shot at his home near Devers about two o'clock Sunday evening. Ferguson surrendered to Virgil Holt after much persuasion, Chief Deputy Sheriff Bob Martin said. According to statements Ferguson had quarreled with Holder regarding a five dollar debt and liquor bill, and after a quarrel at the Ferguson home Ferguson ran in the house and got his gun and shot Holder who lived near him at a sawmill about one fourth mile north of Devers. Both of the men were working with timbers. C.B. Cain, county attorney, who questioned the prisoner at length Sunday night related the following story that Ferguson told of having been convicted of murder in 1913 when he "cut a man to death" in Polk county. He served only a few years of his sentence and was pardoned by Jim Ferguson. County attorney Cain said that Ferguson told him and other officials that he was drunk at the times he shot Mr. Holder, and Bob Martin, said that he showed signs of having been drinking when he was brought to jail by Mr. Holt. The gun was recovered Monday and had been re-loaded. Mr. Martin said that Ferguson told them he had emptied his gun during the brawl and had gone back in the house and re-loaded the gun and that when Mr. Holt asked him to give himself up to the officers he refused and threatened to shoot again but later decided to go with them. When asked about the gun Ferguson said that he carried a gun on himself all the time. After he told officers he sold liquor his home was raided Monday afternoon and a 20-gallon keg of liquor and 212 empty pint and quart bottles were found. Mr. Martin said that they found the liquor and bottles under the floor when they lifted up the linoleum and found a loose board in the floor. The home is located near a negro dance hall and Mr. Cain said that Ferguson told them that he sold about 20 gallons a week. The wives of the two men looked on and tried to intervene, witnesses said, while Ferguson fired sot after shot at Holder. It was first thought , Mr. Cain said, that Ferguson shot his neighbor because he had been hit in the head with a hammer, but Mr. Cain said that Ferguson told them that Holder tried time after time to run from him and did not throw the hammer until he, Ferguson, had fired two shots. The examining trial was being held in Devers Tuesday afternoon as this paper was going to press. Funeral services were held for the deceased at five o'clock at Saratoga under the direction of the Dismukes Funeral Home. Besides his widow, one daughter and four grandchildren survive him. Witnesses to the tragedy said that six shots were fired, but only two of them took effect. One entered the left arm and lodged in his right side. The other entered his side and traveled downward through is body. He died almost instantly. Conflicting statements have been giving regarding the throwing of the hammer, and this will undoubtedly be a deciding factor in the coming trial. Price Daniel (later to become Governor of Texas) and T. J. Hightower two outstanding criminal attorneys who will represent Ferguson, said that a plea of self defense would be given and that two eye witnesses to the quarrel had stated that Holder threw the hammer before Ferguson started shooting.
  Note: There is a problem regarding the listed 1879 year of birth. Marion is not included in the Jackson Holder family census record of 1880. So, either he wasn't born in 1879, or somehow he didn't get included on the census. His sister, Carrie, was born in Sept 1880, so that would prevent sliding his birthdate back to Aug 10, 1880, unless her birthdate is also incorrect. The day and month of birth are also different, so they weren't twins. Either both of their birth dates are wrong, or Marion was a baby during the census and just didn't get listed. MWL
