Note:   Joseph and Amelia (Frizzell) Johnson had thirteen children and by 1900 nine children were still living. In 1900 the family is farming in Piney Township of Oregon County, Missouri, and in 1910 they have relocated to adjacent Ripley County in Pine Township. Joseph served in the Confederate Army in Company C, 8th Missouri Cavalry. Joseph and Amelia are both interred at Cave Spring Cemetery in Oregon County, Missouri.
  Amelia Frizzell is the daughter of Thomas Frizzell [Sr.] and Mary Jane Parker and thus Joseph married his mother's step-sister. Legal proceedings were brought against the couple with the filing of an Indictment on April 15, 1865, with Thomas Holladay acting as the prosecuting attorney for Madison County. The allegation charged that their marriage was within the degree of consanguinity prohibited by law and was incestuous and void. No further proceedings were held after March 27, 1871. It is believed that Thomas Holladay held a vendetta against the family of Uriah Johnson as the sons of Uriah and Clarissa served the Southern cause during the Civil War and Holladay had served as a surety on a bond for Uriah Johnson and later requested the Provost Marshal's office in St. Louis to relieve him from the obligation as it became apparent that Joseph Johnson had joined the Rebels.
  According to Missouri statutes concerning incest (568.020), a person commits incest if he marries his aunt of the whole blood. Amelia is his step-aunt and because she is a relative of the half-blood it is submitted that their marriage was not in violation of Missouri law. Justice prevailed as the couple were never served and prosecuted on a charge that should never have been lodged.
  Two of the sons born to Joseph and Amelia (Frizzell) Johnson, Marion Johnson and Andrew Johnson, married daughters of James Wiley Johnson who is a grandson of Solomon Johnson born 1750-1760 in Virginia.  J. W. Johnson was born in Tennessee, the son of Benjamin Johnson and Mary Robinson, and lived for many years in Oregon County, Missouri. He had a daughter Rebecca Johnson in 1881 during his first marriage with Mary Daniels, and a daughter Lillie Johnson in 1898 during his second marriage with Sarah Risenhoover. Rebecca Johnson married Marion Johnson about 1897 and her step-sister Lillie Johnson married Andrew Johnson about 1915.
