  In the name of God, Amen, I, Thomas Rogers of the County of Union and State of North Carolina calling to mind the certainty of death and the frailty of human life, and being now considerably advanced in years,yet of sufficient strength of body and mind to dispose of what Earthlygoods it has been pleased God to bless me with, do hereby make, publishand declare this my last Will and Testament hereby revoking & making null& void all other last Wills and Testaments made by me. Imprima(?) After my death & burial (which I want done in a Christian like manner suitable to the wishes of my family & friends) I desire myExecutors hereinafter appointed to pay off & discharge the expenses of myburial and such other necessary expenses and just debts (if any) out ofthe first money which may come into their hands by virtue of theiroffice.
  Item 1 I will & bequeath to my beloved wife, Winney, one Negro girl aged now about fourteen years named Cate to have & to hold during her naturallife. Also one horse (the grey), one horse cart & gear, two cows andcalves, if any have calves (her choice), two head of hogs (her choice),all my stock of sheep that may be on hand at my death, all the kitchenfurniture also all the household furniture, including beds, & othernecessary furniture & bedsteads, tables, chairs, earthen ware, clock andall such articles as usually belong to the house. Also, I give to my dearwife one years provisions out of the crop & provisions on hand if thereis enough of such to make for herself, her Negro, horse & stock a yearssupport, such allowance to be made by the disinterested persons chosen bymy Executors.

  Item 2 I will & bequeath to my dear wife Winney in addition to the above & forgoing property the land on which I now live, bounded as follows: beginning on the thru notched Road, a little west of a new field cleared in 1852 & 1853, & then run so as to leave her said field to a corner ofthe original hundred acre tract which corner is on a pine nearby west ofthe dwelling house, then down the flat branch so as to give her all theland east of said line & north of the thru notched Road supposed to contain two or three hundred acres to have during her natural life.
  Item 3 All the balance of my property of about one hundred acres of land joining the lands of Russel Rogers on which Rushing Rogers lives & Richard Rogers lands and the following Negro slaves viz Adam, Elijah,Bill, Hannah, Amanda, and Nancy together with increase (if any) and allmy cattle & hogs & horse and everything not otherwise disposed of; I wishand it is my will for it to be sold to the highest bidder on such creditas my Executors may think necessary in their discretion to give and the proceeds of said land and Negros and other property so sold to be equally divided between my sons viz Richard, Rushing, Russel, Shepard, Aaron, Calvin, James M., Jason and Comodore andthe children of Thomas P. Rogers, such children to be entitled to theshare which their father would have been entitled to were he alive.
  Item 4 To Robinson Rogers, I only will and bequeath one dollar, having paid debts for him as much or more than what I conceive would be hisequal share of my property.
  Item 5 I will and bequeath to my daughters, Rhoda intermarried with Arthur Sikes, and Winney intermarried with Isaac Eliott, each the sum of one dollar and no more having heretofore given to each of them a Negro, abed, cow & calf and other property.
  Item 6 All the property herein willed and given to my beloved wife Winney, land & Negro girl, horse, cattle, hogs, & sheep, household and kitchen furniture, horse cart and other articles is hereby given to herduring her natural life and at her death to be sold with the increase ofit (if any) by my Executors in the manner heretofore described for thesale of other property and the proceeds of it to be divided among the same persons heretofore mentioned who were to have the proceeds of my other property viz Richard, Rushing, Russel, Shepard, Aaron, Calvin, James M., Jason and Comodore Rogers and the children ofThomas P. Rogers, they receiving that portion which would have been theirfathers were he alive.
  Item 7 Lastly, I hereby nominate and appoint my son Russel Rogers and friend D. A. Covington Executors to this my last Will and Testament hereby revoking all former last wills and testaments by me made. It justoccurred to my mind before signing this will that I have omitted to giveto my son Comodore Rogers a tract of land in this county on the headwaters of Flag Branch adjoining the lands of Burton Laney, the heirs of Moses Eason & others containing about 200 acres which land I hereby give to my son Comodore Rogers his heirs and offspring forever.
  Signed, sealed, published and declared to be the last Will and Testament of Thomas Rogers in the presence of us who in the presence of each other & in the presence of the Testator have witnessed the same this 22nd day of April A D 1853.
