Note: Will of Milisent [sic] Husted, widow of DAVID HUSTED. It is dated 2 Sept 1803 and probated 14 Jan 1805, Dutchess County. It is abstracted in THE DUTCHESS, Vol 5, Issue 3, Page 23; also said to be located in Book B on page 500; the summary is as follows: Sons _ Abraham, Lewis, Titus, Rueben, David, Annia? and Abram. Daughters _ Sarah Bouce, Ruth Mosher and Eunice Gold. Witnesses _ Benjamin White, Silas White, Silas Duel (of Town of Washington) Executors _ Titus and Annia?, her sons ______________________________________________________________________ Following is a transcription of the will of Milisent Husted, widow of David, as recorded in the Dutchess County Surrogate's Court. The transcription does not attempt to change any of the spelling or other language in the photocopy of the pages from the Wills Book, pp 500, 501. 500. The Last Will and Testament of Milisent Husted made this second day of September in the year of our Lord one thousand eight hundred and three. Is as followith (viz) I Milisent Husted of Dutchess County and State of New York, being at this time in my perfect mind and memory do make and ordain this my Last Will and Testament in manner and form following that after my dicease my body to be buried in a decent Christian like manner at the discretion of my Executors hereafter named and in some convenient time after my decease all the debts due unto me by bonds bills notes or any other wise be called in by my said Executors hereafter named and all my lawful debts paid. Item I give and Bequeath unto my son Abraham Husted Twenty Pounds Lawful Current money of the State of New York to be paid five pounds annually by my Executors hereafter named till said twenty pounds is all paid. Item I give and Bequeath unto two of my Daughters Sarah Boyce and Ruth Mosher, Two feather beds and two bed steds and cords four sheats four coverleds four pillers and four piller cases to be equally divided between them two. Item I give and Bequeath unto my three daughters Eunice Gold Sarah Boyce and Ruth Mosher all my house_hold furnature and wearing Apparrel of all kinds that I have not disposed of in this present Will and likewise Twenty one pounds Lawful Current money of said state to be equally divided between them three all this to be paid and handed out by my Executors hereafter named. Item I give and Bequeath to my sons (viz) David Husted Lewis Husted Titus Husted Annias Husted Abram Husted and Reuben Husted all my money and notes and all the remainder part of my Estate that I have not disposed of in this present Will. Item I likewise constitute make and ordain Executors of this my Last Will and Testament two of my sons Titas Husted and Annias Husted and I do hereby utterly disallow and now disannual all and every other former Testament Wills Legases and Executors and confirming this and no other to be my Last Will and Testament. In witness whereof I have hereunto set my, hand and seal the day and year of first above written. hir Milisent X Husted L. S. mark Signed, sealed published, pronounced and declared by the said Milicent Husted as her Last Will and Testament in the presents of us the subscribers, Benjamin White Silas White Silas Deuel. Dutchess County SS Be it remembered that on the fourteenth day of January one thousand eight hundred and five personally appeared before me James Talmadge Junr. Surrogate of the said county Silas Deuel of the town of Washington, who on his affirmation declared that he did see Milisent Husted sign and seal the annexed written instrument, purporting to be the Will of the said Milisent Husted bearing date the second day of September one thousand eight hundred and three and heard her publish and declare the same as and for her Last Will and Testament, that at the time thereof she the said Milisent Husted was of sound disposing mind and memory to the best of the knowledge and belief of him the affirmant. And that Benjamin White Silas White and this affirmant severally subscribed the said Will as witnesses thereto in the Testatro's Presence James Tallmadge, Junr. Surrogate L.S. The people of the State of New York by the grace of God Free and Independent: To all to whom these presents shall come; or may concern, send Greeting: Know ye that at Poughkeepsie in Dutchess County, on the fourteenth day of January in the year of our Lord one thousand eight hundred and five before James Tallmadge Esquire, Surrogate of our said County, the Last Will and Testament of Milisent Husted deceased (a copy whereof is hereunto annexed) was proved, and is now approved and allowed of by us, and the said deceased having while whilst she lived, and at the time of her Death, Goods, Chattels, or Credits within this State, by means whereof the proving and registering the said Will, and granting administration of all and singular the said goods and credits, and also the auditing, allowing and final discharging the account thereof, doth belong unto us; the administration of all and singular the Goods, Chattels and Credits of the said deceased, and any way concerning her Will is granted unto Titus Husted and Annias Husted Executors in the said Will named they being first duly affirmed will and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said Goods, Chattels, and Credits and also render a just and true accounting thereof when thereunto required. In testimony whereof, we have caused the seal of office of our said Surrogate to be hereunto affixed.
