Note: James Brooks of Williamson County Tennessee, formerly of Halifax County to John Brooks, 1022 acres of land in Halifax County located on the head waters of Wynn's & Lawson's Creek, where James formerly lived. This deed witnessed by Abner Holt, Elijah Brooks, & Matthew Brooks. Recorded 23 Feb. 1818 Ref: Halifax County, Virginia; Deed Book 27; pg. 8 James Brooks LWT-- In the name of God Amen. I James Brooks of the State of Tennessee and the Co. of Williamson, by the course of nature I know that I cant stay long in this world and knowing that life is very uncertain even with the young, and now being of sound mind and memory, blessed be Almighty God for the same, I do make this my last will and testament in the words and figures following to wit, First of all is that I desire my just debts to be paid, after my being intered in a Christian manner agreeable to the customs of the Baptist Church. Second item, my will is that my daughter Betsy Holt have a negro boy named Frank. Third item, is that my daughter Hannah Brooks have five negros, Fanny, Lucy, Thomas, Sandy, Sarah, and also half of the tract of land whereon I now live, also the cupboard and the sugar chest, by her paying John Brooks & Elijah Brooks one hundred dollars each. Third item, Is that my son Matthew Brooks have one half of the land whereon I now live to be divided in such a manner as to give each half an equal share of the timbered land, by Matthew Brooks paying one hundred and twenty five dollars to my estate, also he shall have one feather bed & furniture. Fourth item Is that my son John Brooks have one cow. Fifth Item Is that my daughter Ann Gray have five negros named Robert, Nancy, Betsy, Lewis & Sally, Sixth item Is that my son Elijah Brooks have his choice of my horses and a good bridle & saddle and one cow and calf and one feather bed & furniture sufficient to dress the bed. Which horse saddle & bridle be received on the day this will was drawn. Seventh item Is after all my debts are payed that the balance of my estate both personal and real be divided equally between my son James Brooks and my son Price Brooks and my daughter Polly Tally, Done this twenty sixth day of September Eighteen hundred and twenty six, and I appoint my son James Brooks and Henry Tally my Executors. The last will and testament of James Brooks deceased is produced in Court for probate, the execution thereof proven thus, John Buchanan and John Gray subscribing witnesses thereto being sworn say they became such in the presence and at the request of the testator and in the presence of each other and that they believe said James Brooks was of sound and disposing mind at the making and publication of said will and under no undue influences, whereupon it is ordered that said will be recorded. James Brooks and Henry Tally the Executors nominated in the said Will appear in open Court and give bond of fifteen Thousand dollars conditioned for the faithful discharge of the trust reposed in them with John Buchanan and Price W.
