Note: 1840 Census-Orangeburg County, SC -Lewis Staley is 60-70 yrs. -head of hse. one male-20-30 one male-15-20 one male 10-15 -Samuel one male 5-10 -Christian one male under 5 -Hilliard one female 40-50 -Ann one female 15-20 1850 Census -Orangeburg County, SC -Lewis Staley is 70 yrs. old-married to Elizabeth-age 44 yrs. (second wife) -value of property $8000.00-paid taxes of $32.11 in 1851 for 2,683 acres of land and 54 slaves. Copy of the following probate records Orangeburg County Courthouse Probate records- -recorded in Will Book page 199, Feb. 1871. 142 State of S. C. County of Orangeburg -Court of Common Pleas. An application was made of Christian A. Staley, Hilliard S. Staley, Mary C. Ulmer, Frances D. Staley, and L. Wayne Culler and Anna Culler his wife, respectfully showeth: That Lewis Staley late of Orangeburg District (now County) in the state aforesaid, being seized and possessed of a considerable real and personal estate duly made and published his last will and testament in writing bearing the date- this____day of _____eighteen hundred and fifty-two. That the said Lewis Staley departed this life on the fourth day of May 1855, without altering or reworking the said will. And upon his death, the executors named therein proved the said will in the court of Ordinary for Orangeburg Dist. and took upon themselves the burden and execution thereof. That said last will and testament of the said Lewis Staley, as also the record thereof, was destroyed during the recent war. And that they, together with Wesley Houser (?) and Rachel his wife who now reside in the state of Ga. have like interest in preserving the evidence of the contents of said last will and testament. (There seem to be several different versions of the will and missing parts to the will.) First, I give and bequeath unto my beloved wife Elizabeth, my barouch and the animals which I generally worked in it; also as much provisions as are neccessary to maintain her one year that is to say about one hundred bushels of corn, fodder sufficient and flour, bacon, and lard sufficient to do her at least one year. Also, the priviledge of living at my late residence a year or two, if she chooses to do so after my decease; and also the priviledge of receiving as much of my household and kitchen furniture as may be necessary for her comfort.......... Lewis Staley bequeaths one sixth of the share to each of his two sons, Christian A. and Hilliard S. and one sixth of the share to each of his two daughters, Mary Ulmer and Frances Dorothy, each one sixth of the same. And one sixth of the same, I give and bequeath unto my daughter, Caroline Zeigler's two children vip (?) Anna D. Zeigler and Wayne Zeigler to be equally divided between them, share and share alike. And the remaining one sixth of the share, I give and bequeath unto Samuel Morgan Staley, the son of my son Samuel to have and to hold forever. If, however, said grandson should die without children, then my wish and desire is that if his mother should survive him that she should receive the one half of what he my said grandson was to receive from the estate, and the other half should come back to be divided among my other heirs in the same ratio observed in the distribution above made....if either of my children should die without issue, the same will be done with their portion. Lewis is buried with his first wife, Ann and son Samuel in the Staley Cem., Center Hill Commun. located off of Hwy #172, north of St. Matthews, SC. between hwy. 21 and Kennerly Rd.
