a. Note:   (Research): Noel Price (noel.price1@bigpond.com) There appears to be a mystery surrounding Mary Ann Attewell.
  She married a John CREEN, b. West Indies originally, when she was abt 15 years old. Did they have the marriage annulled ? No one seems to know, but she was listed as being unmarried in 1860 when she gave birth to Julia Hoist Attewell, at Ballarat (who is listed as illegitimate). Also Julia's father was reported to have been a local aboriginal, which has yet to be proven. The information on Julia's birth certificate, given by her mother, Mary Ann Attewell, the informant.
  The following article appeared in the 'Ballarat Star' newspaper, Friday 9th August, 1861, District Police Court - Mary Ann CREEN v. William HORST. Mr Harris for the complainant and Mr Barton for the defendant. This was a case of affiliation brought by a married woman against the defendant, a brickmaker. The case had been before the court on three previous occasions. Formerly, she brought the case under her maiden name, when it proved fatal.
  Now she brought it in her husband's name and could not legally give evidence of the bastardy of her child, in fact that she was not a competent witness. Mr Barton cited Archibold's Justice of the Peace in support of these views. Mr Harris said that there could be no moral doubt that the defendant was the father of the child. The husband of the complainant was a black man, a native of the East Indies, and the child [pointing to it in Court] was evidently the offspring of a white man. They would prove that the husband was not seen by the complainant for two years. The bench said that the difficult point was to prove non-access on the part of the husband. Mr Barton said that he could prove that the husband was repeatedly in Ballarat lately. The bench said that the woman could not prove non-access, neither could the husband. Mr Harris said the defendant had even paid them money. David Attewell was examined, and said he was the father of the complainant, who had resided for two years with him at Dead Horse Gully. During that time he never saw her husband in her company but it was possible for him to have been there. Mr Harris here withdrew the case. Mr Barton applied for costs in order to bar further proceedings. The bench would not grant any.
  The female here made a rush at the defendant through the Court, when an exciting race for the door took place between them. The police joined in the chase after the woman, and she ,the defendant, left them far behind in an incredibly short space of time.
