Note: NJAMIN EGERTON household, however, I haven't found any record of who his wife may have been. Because he was alternately called JERRY FOOTE in some records and JERRY DAVIS in others, it is apparent that he alternated in using the surnames of both of his slaveholders while most of his siblings carried the surname of DAVIS. According to the distribution of the slaves of PETER R. DAVIS in 1850, JERRY was given to the family of ELIZABETH PITCHFORD; her daughter, NANCY, later married HENRY FOOTE, and he was among the slaves who went with the FOOTE family in a later distribution. Additionally, he was among the slaves included in the Slave Distribution of HENRY A. FOOTE in 1863, and from the way he was listed, he may have been married to a slave named FANNIE, b. about 1833, and had children GEORGE, b. 1861, and SAM, b. 1858. There was also a girl named MARIAH, b. 1855, who was listed following them, however, I don't believe she was theirs since there was a person by that name and approximate age among the children of BEN and BETSY FOOTE in the Census. JERRY DAVIS was a witness to the August 1882 Marriage of LEROY CHEEK & EUGENIA DAVIS (dau/of STEPHEN & SARAH DAVIS) in Fork Township. JERRY DAVIS was last recorded in the November 1901 Court proceedings for the settlement of the Estate of his brother, SUMNER DAVIS, where it was indicated that he was no longer in the State. I don't know whether he was dead or had moved elsewhere. ------ 5/22/2010 THEODORE "TRIP" DAVIS and his children were former slaves of PETER R. DAVIS, of Warren County who died in 1850. The following are records from the Estate of PETER R. DAVIS, along with brief entries from records concerning the P. R. DAVIS' family, including his parents, grandparents, and his siblings who were the benefiaries of his estate. Confirmed these relationships and ages from the Estate Records of PETER R. DAVIS, May Court 1850. State Archives CR.100.508, Warren County Will Book 41. List of Negroes and their ages, as well as known on the 1st of January 1850 belonging to PETER R. White Clk ---- In Will Book 41, Pg. 90-91: In obedience to an order of Court for Warren County made at the November Term 1850, we the undersigned commissioners met on Monday the 16th day of December and proceeded to divide the negroes belonging to the Estate of Peter R. Davis deceased as follows (viz): Among the slaves who went to the following: Lot No.1 to MRS. ELIZABETH PITCHFORD's 4 children (PETER's sister ELIZABETH, whose husband, STERLING PITCHFORD, died in 1822): JERRY - Valued at $650 ELIZABETH DAVIS-PITCHFORD, was born 1789/died 1875. The PITCHFORD children were THOMAS JEFFERSON PITCHFORD (1810-1883); REBECCA DAVIS PITCHFORD (1812-1900); NANCY DAWSON PITCHFORD (1815-1900); MARY TURNER PITCHFORD (1819-1889). JERRY must have gone to the family of NANCY D. PITCHFORD, who was married to HENRY FOOTE JR. in 1832, that is probably why he sometimes adopted using the FOOTE surname. His name is found among the Slaves in the Estate of HENRY A. FOOTE, dated 1863. ---------------------- Lot No. 2 to JOHN B. POWELL (husband of PETER's sister NANCY): TRIPPE - Valued at $350 Lot No. 3 to DR. STEVEN/STEPHEN DAVIS (brother of PETER): TOM - Valued at $800 Lot No. 4 to the children of MRS. POLLY KEARNEY (sister of PETER R. DAVIS): SUMMER - Valued at $800 ESTHER - Valued at $200 JIM - Valued at $400 -------- Further research on the slaveowners family shows that PETER R. DAVIS was the son of MATTHEW T. DAVIS & MARY MADDRAY-DAVIS, and that the widow MARY DAVIS received a number of slaves upon her husband's death in 1827, namely GEORGE, SEALEY, EASTER, ISHAM, TEMPERANCE, & REAMUS, it's very possible that EASTER was ESTHER, especially since that was what she was called on JAMES DAVIS marriage license. MATTHEW T. DAVIS was the son of PETER DAVIS (d. 1804) & HANNAH TURNER (d. 1826) DAVIS, all of these families were of Warren County, North Carolina. (see file of THEODORE TRIP DAVIS for more complete details of slaveowners of all members of the family) ================= JERRY DAVIS was last listed in the following court proceedings for the Estate of SUMNER DAVIS: North Carolina Warren County In the Superior Court Before the Clerk Affidavit to Obtain Order of Publication James T. Davis Executor of Sumner Davis, dec’d. vs Mary Davis, widow of Sumner Davis Eddie Green, Henry Davis, Ed Dowtin and Alice Dowtin, his wife, Garfield Davis, Ben Davis, Ann Powell, and Richard Powell, her husband, William Davis, Tripp Davis, Thos. Davis, and Jerre Davis. Jas. T. Davis, being duly sworn, says: That in the above entitled Special Proceeding now pending in the Superior Court of said Warren County, the sheriff of said County has returned the summons issued to him in said Proceeding endorsed, “After diligent search I fail to find Ann Powell, Richard Powell, Jerre Davis, William Davis, Tripp Davis and Thomas Davis in Warren County,” that said Ann Powell, Richard Powell, Jerre Davis, William Davis, Tripp Davis and Thomas Powell <sic> cannot after due diligence be found in the State of North Carolina, that said Ann Powell, Richard Powell, Jerre Davis, William Davis, Tripp Davis, and Thomas Davis are proper parties to said Proceeding, that said Proceeding relates to real estate situated in aforesaid County and State and is instituted for the purpose of having said real estate sold to make assets, that said Ann Powell, Jerre Davis, William Davis, Tripp Davis, and Thomas Davis have or claim, a contingent remainder interest in said real estate sought to be sold. Wherefore affiant prays that an order may be made by the court that service of summons be made on said Ann Powell, Richard Powell, Jerre Davis, William Davis, Tripp Davis, and Thomas Davis for publication in some newspaper published in said Warren County. Jas. T. Davis (“X” his mark) Sworn to and subscribed before me this 20th day of Nov. 1901. H. A. Boyd Notary Public It appearing from the foregoing affidavit of James T. Davis in this Special Proceeding that Ann Powell, Richard Powell, Jerre Davis, William Davis, Tripp Davis, and Thomas Davis, some of the Defendants therein, are not to be found in said Warren County, and cannot after due diligence be found in the State of North Carolina, and it further appearing to the Court, that the said Defendants are proper parties to said Proceeding, that said Proceeding relates to real estate situated in Warren County, state of North Carolina, and is bought for the purpose of having said real estate sold to make assets, and that said Ann Powell, Jerre Davis, William Davis, Tripp Davis, and Thomas Davis, have, or claim, a contigent remainder interest in said real estate sought to be sold. It is therefore ordered that notice of this Special Proceeding be published once a week for six weeks in The Record, a newspaper published in said Warren County, setting forth the title of the Proceeding, the purpose of the same, and requiring the said Defendants to appear before the Clerk of the Superior Court for the County of Warren at his office in Warrenton, N.C. on the 3rd day of January 1902 and answer or demurr to the Petition in said Proceeding, or the relief therein demanded will be granted.
