  1. This Indenture made the Second day of October in the Year of our Lord One Thousand Seven Hundred and Thirty four BETWEEN Roger Hesketh of North Meals in the
 2. County of Lancaster Esquire of the one part and Dorothy Rymer of Banks within North Meals aforesaid widow of the other part WITNESSETH That the said Roger Hes-
 3. –keth for and in Consideration of the full and just Sum of Fourteen Pounds and ten shillings of lawfull British money to him in hand paid by the said
 4. Dorothy Rymer the receipt whereof the said roger Hesketh doth hereby acknowledge and thereof and of every part thereof acquit release and discharge the
 5. said Dorothy Rymer her heirs Executors and Administrators and every of them and for divers other Causes and Considerations him the said Roger Hesketh there
 6. unto moving Hath demised granted Sett and to farm Letten and by these presents doth demise grant Sett and to farm Lett unto the said Dorothy Rymer ALL that Cottage consisting of three Bays with two
 7. Closes of Land called the Marsh acre and Nicholas Rymer’s Croft Scituate lying and being in Marsh Side within North Meols aforesaid containing by Estimation one Acre three Roodlands and
 8. twenty two Perches of Land be the same more or less now in the possession holding or occupation of the said Dorothy Rymer and Richard Wright alias Shepherd together with all and Singular
 9. houses Outhouses Edifices Buildings yards Orchards Gardens Lands Meadows pastures Common of pasture only during the will and pleasure of the said Roger Hesketh his heirs or assigns and
 10. Turbary sufficient to be used and spent upon the premisses and not elsewhere ways waters watercourses ditches fences liberties Easements fishings properties and advantages what so
 11. ever to the said Cottage and Closes of land or any part thereof lying belonging or in anywise appertaining or accepted reputed taken or known to be as part parcel or member thereof EXCEPT
 12. and always reserved out of this present demise unto the said Roger Hesketh his heirs and assigns ALL woods underwoods mines delfs and quarries and all manner of free warrens
 13. birds and beasts of free warren with liberty to and for the said Roger Hesketh his heirs and assigns and his and their Servants and others by his and their or any of their order or appoint
 14. –ment to enter into the said demised premisses or any part thereof to hawk and hunt all manner of game and to kill and take by any ways or means whatsoever all fish and wild fowl in and
 15. upon the said premisses and the same so killed and taken to carry away AND except likewise and always reserved unto the said Roger Hesketh his heirs and Assigns full right and free liberty
 16. from time to time and at all times during the term hereby demised & to enclose fence in and improve for his and their own use and benefit any part or parts of the commons or waste ground
 17. which now are or lie open and uninclosed within the Mannor or North Meals at his and their free will and pleasure without the interruption or hindrance of her the said Dorothy her heirs or
 18. assigns TO HAVE AND TO HOLD the said Cottage Closes of land and all and singular other the premisses hereby demised or mentioned or intended so to be with their and every of their Appurtenances
 19. (except before excepted) unto the said Dorothy Rymer her heirs and assigns for and during the lives of her the said Dorothy Rymer aged fifty six years Margaret her Daughter aged twenty years
 20. and Ann her Daughter aged twenty two years and for the life of the Survivor and longest liver of them YIELDING paying doing and performing therefore yearly during the said term unto the
 21. said Roger Hesketh his heirs and assigns the rents boons Suits duties and Services herein after mentionedf (that is to say) the yearly rent of Six Shillings of lawfull British money (clear of all
 22. Parliamentary and other taxes Charges and deductions whatsoever) at and upon the feast days of PENTECOST and ST. MARTIN the Bishop in Winter by even and equal portions Seven Hens yearly
 23. or Three Shillings and Six pence in Money in lieu thereof Four days Shearing in the time of harvest yearly with an able reaper or Two Shillings in money in lieu there of at
 24. the Election and Choice of the said Roger Hesketh his heirs and Assigns AND grinding all such Corn grain and Malt as She the said Dorothy Rymer her heirs or assigns or her or their Under
 25. tenants of the premisses or any of them shall use or spend ground upon the said premisses or any part thereof at all times during the said term at the Miln or Milns of or belonging to
 26. the said Roger Hesketh his heirs and assigns within the said Mannor of North-Meals and not elsewhere AND also yielding performing paying and doing Suite of Court and all such other
 27. boons dues duties Customs and Services as heretofore have been usually paid done or performed for the said Cottage Closes of land and likewise doing observing and performing all
 28. and singular the Covenants and agreements herein after of these presents mentioned by or or on the part or behalf of the said Dorothy Rymer her heirs or Assigns to be observed done or per-
 29. formed PROVIDED always that if the said yearly rent of Six shillings or any part thereof shall be behind and unpaid by the space of twenty days next after any of the days whereon the same
 30. are respectively reserved to be paid as aforesaid altho the same shall not be demanded) OR if the said Dorothy Rymer her heirs or assigns shall fail to yield do pay or perform any of the aforesaid
 31. boons dues duties suites Customs and Services or any of the Covenants and agreements hereinafter in these presents mentioned or contained to be observed done or performed by and on the
 32. part of the said Dorothy Rymer her heirs and Assigns OR shall make cause or suffer to bemade any wilfull or voluntary waste in or upon the said premisses OR shall kill or destroy any Game upon
 33. the same by anyways or means whatsoever OR shall demise grant assign sett over or exchange the said premisses or any part thereof to or with any person or persons (except to and for the use of her self
 34. and Children) without the License and Consent of the said Roger Hesketh his heirs or Assigns first had and obtained in writing under his or their hands that then and from thenceforth it shall and may
 35. be lawfull to and for the said Roger Hesketh his heirs and Assigns into the said demised premisses or any part thereof in the name of the whole to reenter and the same to have again repossess and enjoy
 36. as in his and their former Estate anything herein before contained to the contrary thereof in any wise not with standing PROVIDED also further and upon Condition that if by means or occasion of
 37. any act or thing not herein before provided against that shall be here after committed or done or willingly suffered by the said Dorothy Rymer her heirs or assigns or by any of them the Estate and Interest
 38. which the said Dorothy Rymer her heirs or Assigns or any of them shall or may have by virtue of these presents in or to the said Cottage Closes of ground and premisses or any part thereof shall become
 39. forfeited to any other save to the said Roger Hesketh his heirs or assigns by any manner of ways whatsoever (Outlawry on mean process to be reversed within Six months after proclamation thereof only excep
 40 –ted) then this present demise and ther term hereby granted shall cease and be foid AND the said dorothy Rymer for herself her heirs Executors Administrators and Assigns doth hereby Covenant promise grant
 41. and agree to and with the said Roger Hesketh his heirs and assigns that she the said Dorothy Rymer her heirs and assigns shall and will from time to time and at all times during the term hereby granted
 42. well and truly pay the said yearly rent of six Shillings at the days and times herein before appointed for payment thereof and also pay do and perform all and singular of her the boons dues duties Suits Customs
 43. and Services herein before reserved and also well and sufficiently repair uphold maintain and keep the said demised premisses and all the Gates Styles Hedges ditches drains and fences of in or upon the
 44. same in good and tenantable repair and the same so repaired at the end or sooner determination of the said term shall and will peaceably and quietly deliver and yield up to the said Roger Hesketh his
 45. heirs or assigns AND further shall and will from time to time and at all times during the Continuance of this Lease or demise yearly spend lay and bestow upon the said premisses or some part there of
 46. and not elsewhere all the dung soil and compost which may or shall be gotten had or made upon the same or some part thereof AND moreover that she the said Dorothy Rymer her heirs and Assigns and
 47. Undertenants shall and will from time to time and at all times during the continuance of this Lease or demise grind all his and their Corn grain and Malt which shall be spent ground upon the said premisses or
 48. any part thereof at the Miln or Milns of the said Roger Hesketh his heirs or assigns within the said Mannor and not elsewhere AND the said Roger Hesketh for himself his heirs and assigns doth herby covenant
 49. promise grant and agree to and with the said Dorothy Rymer her heirs and Assigns that she the said Dorothy Rymer her heirs and Assigns paying the rents and boons and performing the Services Covenants
 50. Conditions and agreements herein contained which on her and their parts are and ought to be observed performed and kept shall and may from time to time and at all times during the term herby
 51. granted HAVE hold use occupy possess and enjoy the said demised premisses and every part and parcel thereof (except before excepted) without the disturbance hindrance interruption of him the said
 52. Roger Hesketh his heirs or assigns or any other person or persons lawfully claiming by from or under him them or any of them AND LASTLY the said Roger Hesketh hath constituted and ordained
 53. and in his place and stead put and doth hereby authorize and impower William Dickonson his true and lawfull Attorney for him and in his name place and stead to enter into the said demised
 54. Cottage Closes of land and premisses or any part therof in the name of the whole and thereof to take possession and after possession thereof so had and taken full quiet and peaceable possession and Seizin
 55. to deliver to her the said Dorothy Rymer or her lawfull attorney in that behalf TO HOLD the same unto her the said Dorothy Rymer her heirs and assigns for and during the said term hereby granted
