1. This Indenture made the fourteen day of April in the fourteenth year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland King Defender of the faith and so
2. forth and in the year of our Lord one thousand seven hundred and seventy four BETWEEN Anna Maria Bold of Bold in the County of Lancaster Spinster Eldest Daughter and a Devisee named of and in the last
3. Will and Testament of Peter Bold late of Bold aforesaid Esquire deceased of the one part and Richard Watkinson of Church Town within the Parish of Northmeols and County aforesaid Husbandman of the other part
4. Witnesseth that for and in consideration of the sum of five pounds five Shillings of Lawfull money of Great Britain to the said Anna Maria Bold in hand well and truly paid by the said Richard Watkinson at or immediately before the ensealing and delivering these presents the
5. receit whereof is hereby acknowledged and confessed and and also for and in consideration of the yearly rent boons duties suits and services hereby reserved and of the covenants provisoes conditions and agreements in these presents mentioned and contained by and on the part
6. and behalf of the said Richard Watkinson his Heirs Executors Administrators and Assigns covenanted and agreed to be observed kept done and performed and for divers other good causes and considerations she the said Anna Maria Bold in pursuance and by virtue of the
7. powers and authorities to her given and granted or in her vested by the said Will of the said Peter Bold or otherwise and her enabling so to do Hath demised granted leased sett and to farm letten and by these presents Doth demise grant lease sett and to farm lett unto the said
8. Richard Watkinson his Heirs and Assigns all that piece part or parcell of unimproved Moss Ground being part and parcell of a certain Moss situate lying and being within the Parish of Northmeols aforesaid commonly called and known by the name of the Church Town Moss as the
9. same piece part or parcell of Moss Ground intended to be hereby demised and granted is now marked mered and staked out containing in the whole by common estimation One Acres of Land of the Measure there used or thereabouts be the same more or less and now in the possession
10. or occupation of the said Richard Watkinson as Tenant or Occupant thereof under the said Anna Maria Bold together with all and singular Lands Meadows Pastures Floodings ways waters watercourses Commons Common of Pasture and Turbary whilst uninclosed and during the Will
11. and pleasure of the said Anna Maria Bold and her assigns for her Life and afterwards of the person and persons who shall for the time being be entitled to the reversion remainder or inheritance of the same premises and his her and their Heirs and Assigns respectively Liberties easements
12. priviledges profitts Comodities Advantages and Appurtenances whatsoever to the said piece or parcell of Land or Moss Ground and premises herein before mentioned and intended to be hereby demised and granted with their and every of their Appurtenances and every part and
13. parcell thereof lying belonging or in anywise appertaining or to or with the same or any part thereof usually had used occupied or enjoyed or accepted reputed taken or known to be as part parcell or member thereof or of any part thereof (Except and our of these presents always
14. reserved unto and for the use and behoof of the said Anna Maria Bold and her Assigns for her Life and from and after her death of the person and persons who shall for the time being be entitled to the remainder reversion or inheritance of the said premises and his her or their Heirs and
15. Assigns respectively all and all manner of Timber and other Trees woods underwoods mines quarries mineralls and delves of what nature or kind soever now growing being or to be found or hereafter during the term hereby granted to grow be or be found in or upon the said
16. premises hereby demised or any part thereof with full and free Liberty and priviledge to fall cut down pill cord pile dig sink forgett cart carry away vend sell and dispose thereof and of every part thereof at her his and their Will and pleasure making a reasonable recompence
17. and satisfaction unto the said Richard Watkinson hi Heirs and Assigns for all trespass and damage that may be done and committed in and upon the said Premises thereby And also except and always reserved unto and for the use and behoof of the said
18. Anna Maria Bold and her Assigns and the person and persons who shall for the time being be entitled in reversion or remainder as aforesaid and his her or their Heirs and Assigns respectively all and all manner of fish fowl and other game and birds and beasts of free
19. warren to be found and caught in and upon the said premises hereby demised with full and free liberty power and authority to angle hawk hunt course shoot kill and destroy the same at her his and their will and pleasure during the said term hereby granted and also
20. further except and out of these presents reserved and foreprized to and for the use and behoof of the said Anna Maria Bold and her Assigns and the person and persons who shall for the time being be entitled in remainder or reversion as aforesaid and his her or their Heirs
21. and Assigns respectively the Liberty and priviledge of inclosing fencing out and improving all or any part of the Moss or waste Grounds within Northmeols aforesaid from time to time and at all times hereafter during the said term hereby granted without the hindrance
22. interruption or disturbance of the said Richard Watkinson his Heirs or Assigns or any of them in anywise) To have and to hold the said piece part or parcell of Land or Moss Ground and all and singular other the premises here in before mentioned and intended to be
23. hereby demised and granted with their and every of their Appurtenances (except as aforesaid) unto the said Richard Watkinson his Heirs and Assigns from the day next before the day of the date of these presents for and during the term of the natural and severall
24. Life and Lives of him the said Richard Watkinson aged sixty five years or thereabouts John Watkinson son of the said Richard Watkinson aged twenty two years or thereabouts and Ann Watkinson Daughter of the said Richard Watkinson aged eighteen years or thereabouts and
25. of the Survivor and longest Liver of them Yielding and paying therefore yearly and every year unto the said Anna Maria Bold and her Assigns for and during so much of the said term as she the said Anna Maria Bold shall live and afterwards for and during the remainder
26. of the said term to the person and persons who shall for the time being be entitled in reversion or remainder as aforesaid and his her or their Heirs and Assigns respectively the annuall or yearly rent or sum of Two shillings and six pence of lawfull money of Great Britain at and upon
27. every of the feast days of Whitsuntide and Saint Martin the Bishop in Winter by even and equall portions the first payment thereof to begin and be made at and upon the feast day of Whitsuntide now next coming And also grinding all the Corn and Grain to be used and
28. spent ground on the said premises during the said term at the Miln or Milns of her the said Anna Maria Bold and her Assigns and the person and persons who shall for the time being be entitled in remainder or reversion as aforesaid and his her or their Heirs and Assigns
29. within Northmeols aforesaid and not elsewhere And keeping a Greyhound Spaniel or setting Dog or other Dog for her the said Anna Maria Bold or her Assigns or the person or persons who shall for the time be entitled in remainder or reversion as aforesaid his her or
30. their Heirs or assigns when and so often as there to required during the said term And further also paying observing doing and performing suit and service at the Court Leet and Court Baron held for the the Manor or Northmeols aforesaid and the fines rules and orders there
31. to be made and imposed on him the said Richard Watkinson his Heirs or Assigns for or in respect of the said premises and all other Boons dues duties suits and Services that have been heretofore usually paid done and performed for and in respect of the said premises hereby
32. demised during the said term Provided always and these presents are on this express condition nevertheless that if the said rent or sum of Two shillings and six pence or any part thereof shall happen to be behind or unpaid in part or in all by the space of twenty days next over or after
33. either of the said days or times whereon the same ought to be paid as aforesaid (though not demanded) or if the said Richard Watkinson his Heirs or Assigns do or shall refuse neglect or fail to pay do or perform all or any of the aforesaid boons dues duties customs suits
34. and services or all or any of the covenants grants articles clauses provisoes conditions and agreements hereby before served and in these presents mentioned and contained by and on the part and behalf of him the said Richard Watkinson his Heirs and
35. Assigns to be paid done and performed or do or shall make or cause or suffer to be made any wilfull or voluntary waste spoil or destruction in or upon the said premises or any part thereof during the said term or do or shall cutt pull up or destroy any Starr growing on
36. the Sand Hills or Haws within Northmeols aforesaid or do or shall demise assign transferr or exchange the said premises hereby demised or any part thereof to or with any person or persons whatsoever (Except to and for the use and behoof of him the said Richard Watkinson
37. his Wife Child or Children) without the Licence and consent of the said Anna Maria Bold or her assigns or the person or persons who shall for the time being be entitled in reversion or remainder as aforesaid or his her or their Heirs or Assigns respectively first had and
38. obtained in writing under her his or their hand or hands for that purpose then and from thence forth in all or any of the cases aforesaid it shall and may be lawfull to and for the said Anna Maria Bold and her assigns and the person and persons who shall for the time being be
39. entitled in reversion or remainder as aforesaid and his her and their Heirs and Assigns respectively into the said demised premises or any part thereof in the name of the whole to renenter and the same to have again repossess and reenjoy as in her his or their former Estate
40. or Estates any thing herein contained to the contrary thereof in any wise not withstanding And the said Richard Watkinson doth hereby for himself his Heirs Executors and Administrators covenant promise and agree to and with the said Anna Maria Bold and her
41. Assigns and the person and persons who shall for the time being be entitled in reversion or remainder as aforesaid and his her and their Heirs and assigns respectively in manner following that is to say that he the same Richard Watkinson his Heirs and Assigns shall and
42. will from time to time and at all times hereafter during the said term hereby granted well and truly pay or cause to be paid unto the said Anna Maria Bold and her assigns for and during so much of the said term hereby granted as she the said Anna Maria Bold shall live
43. and afterwards for and during the remainder of the said term herby granted unto the person and persons who shall for the time being be entitled in reversion or remainder as aforesaid and his her or their Heirs and Assigns respectively the said yearly rent or Sum of five
44. Shillings at the days and times here in before limitted and appointed for payment thereof And also pay do and perform all and singular the boons dues duties suits customs and services herein before mentioned and reserved And also shall and will over and above the said rent
45. and boons pay bear and discharge all Leys Taxes rates assessments charges and other impositions whatsoever parliamentary or otherwise that shall be taxed laid rated assessed charged or imposed on the said premises hereby demised and granted or on the Tenant or Occupant
46. thereof for or in respect of the said premise hereby demised during the said term and further also shall and will at his and their own Expence Costs and Charges in a Husbandlike manner improve the same premises and make the same into good arable Meadow and Pasture
47. Land within the space of seven years from the date hereof by draining the water of it and marling or manuring the same in the best manner he or they possibly can And likewise shall and will well and sufficiently repair uphold maintain amend keep the Hedges ditches
48. gates styles and fences in upon or belonging to the said premises hereby demised and every part thereof and all the buildings hereafter to be made and erected thereon in good sufficient and tenantable repair when and so often as need or occasion shall require during the
49. said term And at the end or other sooner determination of the said term shall and will peaceably and quietly leave yield and deliver up the same premises unto the said Anna Maria Bold or her Assigns or the person or persons who shall for the time being be entitled in
50. reversion or remainder as aforesaid or his her or their Heirs or Assigns respectively in such good sufficient and tenantable repair as aforesaid And further also shall and will gind all his and their Corn and grain to be used and spent ground on the said premises at the Miln
51. or Milns of the said Anna Maria Bold and her Assigns and their person and persons who shall for the time being be entitled in reversion or remainder as aforesaid and his her or their Heirs and Assigns respectively within the Manor of Northmeols aforesaid during the said
52. term and not elsewhere and also shall and will keep and maintain a Greyhound Spaniel or setting Dog or other Dog for her the said Anna Maria Bold or her Assigns or the person or persons who shall for the time being be entitled in reversion or remainder as aforesaid or his her
53. or their Heirs or assigns respectively during the said term when and so often as thereto required And Likewise shall and will yearly and every year during the said term lay spread bestow and spend in and upon the said premises or some part thereof for the better improvement
54. of the same all the Dung muck manure compost and soil that shall arise or be gathered or gotten from and off the said premises by and from the profitts thereof and not elsewhere And also that he the same Richard Watkinson his Heirs and Assigns shall not nor will do commit permit or
55. suffer to be done any wilfull or voluntary waste spoil or destruction in or upon the said premises or any part thereof during the said term nor shall nor will cut pull up or destroy any Starr growing on the sand Hills or Haws within Northmeols aforesaid nor shall nor will demise assign
56. transferr or exchange the said premises hereby demised or any part thereof to or with any person or persons whatsoever Except as aforesaid without the Licence and consent of the said Anna Maria Bold or her Assigns or the person or persons who shall for the time being be entitled
57. in reversion or remainder as aforesaid or his her or their Heirs or Assigns respectively first had and obtained in writing under her his or their hand or hands for that purpose And the said Anna Maria Bold doth hereby for herself her Heirs Executors and Administrators covenant
58. promise and agree to and with the said Richard Watkinson his Heirs and assigns that he the same Richard Watkinson his Heirs and Assigns paying the said rent and doing and kperforming the said boons dues duties customs suits and services and also the covenants provisoes
59. conditions and agreements in and be these presents reserved mentioned and contained by and on the part and behalf of him the said Richard Watkinson his Heirs and Assigns to be paid observed done and performed shall and may from time to time and at all times hereafter
60. during the said term peaceably and quietly have hold use occupy possess and enjoy the said premises hereby demised with their and every of their Appurtenances (Except as aforesaid) without the Let Stop suit trouble hindrance interruption molestation or disturbance of her the
61. said Anna Maria bold her Heirs or Assigns or of any other person or persons claiming or to claim by form or under her them or any of them or the said Peter Bold in any wise Provided also further and it is hereby declared and agreed by and between the said Parties to these
62. presents for themselves and their Heirs respectively to be the true intent and meaning of these presents and of the parties hereto that by means or occasion of any act or thing not herein before provided against that shall be hereafter committed or done or wittingly or willingly
63. suffered by the said Richard Watkinson his Heirs and Assigns or any of them the Estate and Interest which the said Richard Watkinson his Heirs and Assigns or any of them shall or may have by virtue of these presents in or to the said piece part or parcell of Land or Moss Ground and
64. premises hereby demised or any part thereof shall become forfeited to any other save to the said Anna Maria Bold and her Assigns or the person or persons who shall for the time being be entitled in reversion or remainder as aforesaid and his her or their Heirs and Assigns respectively
65. by anyways or means whatsoever (outlawry on mesne process to be reversed within Six months after proclamation thereof only excepted) Then this present demise and the term and Estate hereby granted and created shall cease end and determine and be utterly void and of no effect
66. anything hereinbefore contained to the contrary thereof in any wise notwithstanding and lastly the said Anna Maria Bold hath made ordained nominated constituted and appointed and in her place and stead put and deputed And be these presents doth make ordain
67. nominate and constitute and appoint and in her place and stead put and depute Lawrence Hall and Thomas Gaulter both of Northmeols aforesaid Yeomen her true and lawfull Attornies jointly and severally for her and in her and in her name place and stead to enter into and upon
68. the said piece part or parcell of Land or Moss Ground and premises hereby demised or any part thereof in the name of the whole and thereof to take possession and Seizin thereof so had and taken full quiet and peaceable possession and Seizin
