Page 110: Zachariah, son of Cornelius and Keziah (Duvall) Duvall, married Sarah Jackson, and "according to tradition, he married 1797 and lived at one time in Franklin Co., Ky." 2. Page 561: "Zachariah enlisted in 1813 at Frankfort, Ky., in Capt. Z. Dudley's Co., 10th Regt. Militia. He married Mary Poe and died May 1847. On Nov 11, 1852, Kesiah Johnson, aged 20 years 11 months, and Mary E. Johnson, age 18, daughters of Zachariah Duvall applied for bounty land in right of their father's service. In 1852 Z. Dudley certified that he commanded a company of 10th Ky. Regt., War of 1812, and that Zachariah Duvall served under him. James Shannon, of Franklin County, Ky., swore that her served with Zachariah Duvall, and that he died leaving two children. Thomas B. Innes swore that Zachariah Duvall married Milly Poe and that they had two daughters, Kesiah and Mary, and if there were other children they were all over 21. Mrs. Lucy Harper, of Franklin Co., Ky., certified that she was acquainted with with Zachariah Duvall and Milly his wife and that he left two daughters, Kesiah Johnson and Mary Johnson, as his only heirs-at-law, both under 21. Ref: Bounty Land warrants, Nat'l Archives." 3. Page 111: The will of Cornelius' son, Henry Howard, dated Oct. 22, 1806, proved the same month in Scott Co. Ky., shows that Henry died a bachelor. In his will he named his father and his brother John as executors. He then divided his estate among his mother, Kezziah Duvall, brother John Duvall's children "if he has any," brother Zachariah Duvall, nephew Henry Clark, nephew John Duvall, and his brother Mareen Duvall "if he returns to this state." (Wills, Liber A, Scott Co. Courthouse). other evidence... 4. Order Book N Page 147, Franklin Co., Ky: "On the sixth (6th) day of January 1857 the following order was made, but not entered on the records of the court, entered as if done on that day...It is hereby certified that satisfactory evidence has been made in open court by the affidavits of Francis Johnson and James Shannon that Kesiah Johnson and Mary Johnson to whom Bounty Land Warrant No. 384 was issued on the 30th April 1853, and who have already endorsed thereon an Assignment in blank of date 28th Sept 1853 have since that time attained the age of twenty-one years, and are the heirs of Zachariah Duvall, deceased, to whom as infant heirs said Warrant was issued as aforesaid, they further state they have no sort of interest in the warrant. Ag't Wm. Lyons heirs and creditors, ordered that the suit be continued..." 5. The marriage of Zachariah Duvall and Milly Poe is referred to in the Forks of the Elkhorn Church with Genealogies of Early Members, Reprinted with Numerous Additions and Corrections, by Ermina Jett Darnell. Situated near the conjunction of Franklin, Woodford, and Scott counties, Kentucky, the Elkhorn Church was a magnet for persons of the Baptist faith who had suffered under the established church in Virginia. Several hundred families are traced by means of entries in the old minute book, family Bibles, wills, land records, tax lists, census records, and in a variety of other sources. Conclusions: That Zachariah Duvall, the father of sisters Keziah (m. Francis T. Johnson) and Mary Elizabeth (m. Melvin Johnson), was the son of Cornelius and Keziah (Duvall) Duvall, is confirmed by the following: 1. The Duvalls of Kentucky have been thoroughly researched. The only Zachariah Duvall found is the one who appears in the records of Fayette Co., Franklin Co. (pt. came off Fayette Co) and later in Owen Co (pt. came off Franklin Co). 2. The marriage of Zachariah Duvall to Sarah Jackson took place on 26 May 1797 in Franklin Co., Ky., as according to the above note on page 561. The two items above match what is called "according to tradition" on page 110 of the Newman book. 3. Zachariah's 2nd marriage took place on 6 Aug 1831 (also in Franklin Co., Ky) to Milly Poe. [Milly was very likely the same person as the Milly Dempsey who m. 1st, on 9 Apr 1810, Franklin Co., Ky., Jesse Poe (bn 1779-1794, he may have been the Jesse Poe killed at the Battle of Raison River, Michigan Territory in the winter of 1813 - see "The History of Franklin Co., Ky," by L. F. Johnson). 4. The only Zachariah Duvall found in Kentucky in the 1840 US Census is the one listed in Owen Co., Ky., on page 205: 1 male age 60-70 [fits his age]; 1 female age 40-50 [fits for Milly's age]; 1 female age 10-15 [unknown]; 2 females age 5-10 [fits for ages daughters Keziah and Mary Elizabeth]. The two items above fit with what is stated in the affidavits regarding the land warrants. 5. Death Certificate for Mary Elizabeth (Duvall) Johnson lists her father as "Z. Duvall" [Zachariah per Order Book N Page 147 Franklin Co]; and lists her place of birth as Owen Co., Ky. - which is where Zachariah (son of Cornelius) resided per the 1840 census. With only one Zachariah Duvall (as head of house) found in Owen Co. in 1840, and Owen Co being Mary's place of birth, this too fits well. 6. A comparison of the signatures of "Zachariah Duvall" on the Franklin Co. Ky Marriage Bonds (first in 1797 to Sarah Jackson, and later in 1831 to Milly Poe) indicates that they were signed by the same person. It is significant to note that the name Zachariah Duvall is unusual and that both Marriage Bonds (in the same county) had signatures - and not just "x's or marks." Especially telling is the unique way which he wrote the letter "Z." Therefore, Zachariah Duvall, the father of sisters Keziah and Mary (Duvall) Johnson, is one and the same as Zachariah the son of Cornelius and Keziah (Duvall) Duvall. Note: The land of Owen County was originally in Virginia, then Fayette County, then Woodford County, then Franklin County, and a part of that went north with the creation of Gallatin County, only to be returned when Owen was finally formed in 1819.
