a. Note:   This Benjamin L[ogan] Rhodes IS NOT the Benjamin L[inton] Rhoads who enlisted in the CONFEDERATE Army as a Private on 5 Jan 1862 at Todd County, Ky, in Company D of the 2nd Unit (Woodward's Kentucky Cavalry). He IS INSTEAD the Benj. L Rhodes who enlisted on the UNION side. The confusion between the two is caused because they were the same age, both from Kentucky, and each served in the Civil War. However, they served on different sides in the war.
  It had been thought that perhaps there was just one Benj L who had enlisted on one side and later switched to the other side. However, this has been disproved. The proof that they were different individuals is that they appear in separate locations in the same (Kentucky) 1870 US Census.
  In 1870, the [other] Benj L who had been on the CONFEDERATE side, lived in Logan County [Clay Precinct, Auburn PO, P. 307(b)], with his parents, Jacob and Elizabeth (Vaught) Rhoads. That Rhoads family, which is not related to this family, is the one for which the town of Rhoadsville, now called Calhoun, was named. It was Henry Rhoads (from PA) of that family, who in 1798, as a state legislator, proposed the name of Muhlenberg for the county. For more info about Henry Rhoads see Roadside Marker info at:

  In that same 1870 Census [this] Benj L, who had enlisted on the UNION side, is shown residing in Ohio County near his brother Samuel G. [Bartlett District - Page 324 - Dwelling 136]. Therefore they had to have been different individuals.
  On 15 Aug 1862, [this] Benj L, at age 21, joined for duty and enrolled at Hartford (Ohio Co), Ky in Company E of the 12th Kentucky Cavalry Regiment of the UNION side. He enlisted as a private, deserted, was taken prisoner in Sept 1862 - not exchanged - was paroled Sept [19], 1862 near Owensboro, failing to report to his company. His brother, Samuel G. Rhodes, and [their] brother-in-law, Ludwell Grigsby, also served on the UNION side in Company E of the 12th Kentucky Cavalry Regiment.

  After the war Benjamin and family lived near his brother, Samuel, as shown in the 1870 US Census - Kentucky - Ohio County - Bartlett District - Page 324 - Dwelling 136 [ancestry.com - image 19 of 408]. The census was enumerated on 24 June 1870 and shows:

  Ohio County Kentucky Circuit Court Case #E478 was a lawsuit "in equity" in which Emma Rhodes, plaintiff, sued Benjamin L. Rhodes, defendant, for recover of $25 in attorney's fees. A judgment in favor of the plaintiff was entered on 29 March 1871.
  "Berthy R. Rhodes, female, born 1 Mar 1875 in Spencer County, father Benjamin L. Rhodes, mother's maiden name Emily Mills, parents born in Spencer, and residing there."
  It has been said that Benj. L. and Emily Rhodes divorced (possibly in 1878 in Spencer County). However, if they were divorced it must have been after Mar 1875. If they did divorce they must have remarried by June 1880 as they are shown as husband and wife in the following 1880 Census. And I find no (re)marriage of either Benj or Emily in the Spencer Co records from 1874 to 1880.
