Note: Montgomery was elected three times to the office of Justice of the Peace in Polk Co., Iowa. Montgomery died at the home of his son John N. McCall.
Montgomerys' Death Certificate has his death on July 5, 1909.(91years 1month 4days) One obituary has his death at 5:20 AM on July 4, 1909. I believe the OB
is correct and he was buried Monday July 5, 1909 The following obituary appeared in many state newspapers across Iowa.

The last of the few old settlers of
Polk county who voted for the constitutional
amendment of 1846 for the
admission of Iowa into the union,
passed away in the death of Montgomery
McCall at Ames. Mr. McCall
lived to the ripe old age of 91 and has
seen Iowa and Polk county transformed
from a wilderness to its present
magnitude. During the greater part of
his life he was engaged in the practice
of law in Camp Township. For
some time he has lived with his son,
John McCall at Ames. The body was
buried in Stuart cemetery, near the
old home.
