 Ezra O. Phillips, of Kent Co., Michigan, was nominated to be a Notary Public, 15 April 1887. (Journal of the Senate of the State of Michigan, 1887, Vol II, p. 2328)

 There was an interesting court case involving Ezra O. Phillips (defendant), that went to the Michigan Supreme Court in 1891. The plaintiff, a Mr. Davis, sold a lot in Grand Rapids to Ezra O. Phillips, by deed dated 5 March 1887, for consideration of $2,500. However, instead of cash, Phillips conveyed a 25% stake in an invention he had devised for a better butter churn. Phillips had planned to patent the invention, form a corporation with stock, and put the butter churn into production. It appears that, for whatever reason, the butter churn venture did not pan out. Davis sued Phillips, alleging fraud, and also claiming that Davis was not mentally competent to enter into the contract. The lower court and the Supreme Court each found in favor of Phillips.
