Monday, March 21, 1938, p 12, Baltimore Sun, Baltimore, MD LAST WILL AND TESTAMENT OF AUGUSTA HUNEKE (27204) I, Augusta Huneke, widow of Charles William Huneke, Sr., of Baltimore City, State of Maryland, being of sound and disposing mind, do make, publish and declare this to be my Last Will and Testament, hereby revoking all other wills or codicils heretofore by me made. FIRST: I direct my Executors hereinafter named to pay all of my just debts and funeral expenses. SECOND: After the payment of all my just debts and funeral expenses, I give, devise and bequeath unto my son, Charles William Huneke, Jr., all of my property, whether real, personal or mixed and wheresoever situate and particularly, but without limiting the aforegoing, all of my fee simple property now known as No. 4813 Belair Road, where I make my home and where the tavern or saloon business, formerly conducted by my deceased husband, is at present conducted, in trust, nevertheless, to and for the following uses and purposes: (A) To take possession thereof and to use the whole or any part thereof, in carrying on and managing the said business and estate for such period or periods of time not in excess of the term hereinafter fixed for the duration of this trust, as the Trustee in his sole discretion may deem fit. (B) To purchase, or contract for, such goods, wares and merchandise, supplies, equipment and machinery as may be necessary or desirable in the conduct of the said business. (C) To enter into, make, sign, execute and deliver, acknowledge and perform any contract, agreement, writing or thing that may in the opinion of the Trustee, be necessary or proper or useful to be entered into, made, or signed, sealed, executed, delivered, acknowledged or performed, for effectuating the purposes and intent of this trust. (D) To appoint and hire foremen, workmen, accountants, appraisers or attorneys and to remove them and appoint others in their place. (E) Generally to do, execute and perform any other sort, deed matter or thing, whatsoever, which ought to be done, executed or performed in and about the performance of the purposes and intent of this trust, or of any part thereof as fully and effectually as I could do if personally present. (F) With and out of the proceeds resulting from carrying on and managing such business and property. (1) To pay the wages and salaries of any and all employees in the said business. (2) To pay any and all taxes, whether Federal, State of Municipal, arising out of or by virtue of the carrying on of said business and preservation and maintenance of said real estate. (3) To pay and discharge in full each debt or liability, of the said business and any and all debts and liabilities incurred in the management of the said business by my said Trustee. (4) To pay to himself as trustee and manager of my estate and business the sum of Twenty-five Dollars ($25) per week (payable to him weekly if he so desires) as compensation for him as Trustee and manager, so long as said business and estate shall be carried on and which sum shall be in lieu of all other fees and compensation that he as trustee might otherwise be entitled to receive. (5) To pay all other expenses, costs and debts resulting from carrying on and managing said business. (6) To pay all of the net income, derived from the said business to my five sons, Edward William Huneke, Charles William Huneke, Jr., Edward Richard Huneke, Louis Harry Huneke and Harry Raymond Huneke, share and share alike. (7) So long as my son Charles William Huneke, Jr., shall continue to manage the business and make his home on the premises he shall not be liable to the trust estate for any rent for the use of the house and grounds as his residence, nor shall any of my minor sons be charged with rent for the use of the property while making their home at No. 4813 Belair Road, with him. (8) This trust shall continue until all of my living children shall have attained the age of twenty-one years at which time the further continuance of said trust shall rest in the sole discretion of my trustee, Charles William Huneke, Jr., as hereinafter outlined. After all my living children shall have attained the age of twenty-one years (and not before) my trustee shall have full power and authority to sell and convey or to lease for a term of years not exceeding five, any part or all of the trust estate and to give deeds therefore (without the necessity on the part of any purchaser to see to the application of the purchase money) and without requiring the trustee to apply to any Court for permission to make the sale and upon the consumation of any such sale this trust shall cease and determine and the proceeds of said sale shall be divided equally among my five sons heretofore named, their heirs, personal representatives and assigns per stirpes and not per capita. Should my son and trustee, Charles William Huneke, Jr., fail to exercise the power of sale vested in him during his lifetime this trust shall cease upon his death and all of the estate shall become the absolute property of my five sons heretofore named, their heirs, personal representatives and assigns, share and share alike. THIRD: I hereby appoint my sons Edward William Huneke and Charles William Huneke, Jr., to be the Executors of this my Last Will and Testament and I request that they be excused from giving bond.
